issues arising out of the Administration's position in the Mabus
case.
As you know, the President has a long and demonstrated history of
support for historically black colleges and universities (HBCUs).
I am pleased that the Administration's brief evidences a
continuation of the Presidents's record of unequivocal support.
As I stated in a letter to the President, the position taken in
the brief "states affirmatively to all Americans and particularly
to those young men and women, now graduated, currently or
prospectively enrolled in HBCUs, that protections provided under
the constitution cannot and will not be eliminated or
compromised."

Dear Governor Sununu:
I have recently been informed of certain legal proceedings
initiated by the U.S. Environmental Protection Agency in the case
State of Alabama, et al. V. U.S. Environmental Protection Agency,
et al., No. 88-V-987-N pending in the United States District
Court in the Middle District of Alabama. This case involves the
attempted collection on an injunction bond by the Environmental
Protection Agency (EPA) for damages allegedly incurred by EPA as
a result of the delay in shipment of some 47,000 tons of PCB-
contaminated dirt from Texas for disposal at the Chemical Waste
Management facility in Emelle, Alabama.
I am extremely concerned that payment of any but a nominal
amount on the bond by the State of Alabama will exacerbate
Alabama's already difficult budgetary circumstances given the
fragile state of Alabama's economy. The attempted collection of
the full bond in this case after all of the PCB-contaminated soil
has been buried in Alabama, and for which the State of Alabama
will become perpetually responsible, would appear to me to be a
vindictive act on the part of EPA to punish the state for having
taken legal action.
I would appreciate any role you can play to ensure that the
State of Alabama is treated fairly and equitably in this matter.
Let me thank you in advance for your review of this issue at your
earliest convenience and any relief from the financial burden
that would be incurred from the enforcement of this bond.

This letter is an invitation for you to participate in a small,
high-level conference in Moscow on "Federalism: Experience and
Problems" on December 17, 18, and 19. Your hosts will be high-
ranking officials from the Union and Russian Federation govern-
ments.
Dr. Georgii Shakhnazarov -- aide to President Mikhail Gorbachev
has asked us to organize an American delegation of twenty
"practitioners" and scholars experienced in the workings of the
American federal system. Our invitation list is attached.
The Soviet participants will include Deputies from the USSR and
the Russian Supreme Soviet, officials from the Union and Russian
Federation governments and prominent scholars. We hope that both
President Gorbachev and President Yeltsin will attend.
The Conference will be sponsored by the Foundation for Social and
Political Research -- a new Presidential "think tank" -- chaired by
Dr. Shakhnazarov. Alexander Yakovlev, Sergei Stankevich, Col.
General Dimitry Volkogonov, Konstantin Lubenchenko and other
prominent democrats serve on the Foundation Board. We have
enclosed the full list.
To help us plan the Conference agenda and select the American
delegation, we have enlisted a planning group from the American Bar
Association, the National Conference of State Legislatures, the
Advisory Commission on Intergovernmental Relations, and the
Congressional Research Service. Many of these specialists will
come with us to Moscow and give expert support to the delegation.
They are listed as the Planning Group with the attached draft
agenda.

The timing of the Conference -- in mid-December -- will coincide
with the most crucial stage of negotiations over the structure of
the new Union and the design of the Constitution. Dr. Shakhnazarov
remains President Gorbachev's principal negotiator for the Treaty
of Union -- the legal basis for a new Soviet federal structure of
government. He will assemble key participants in this process for
our Conference.
We have an historic opportunity to help shape the new democratic
Union of Sovereign States by sharing our American experience of

Dear John,
I am writing in regards to the appointment of the U.S. Attorney
to replace George Terwilliger in Vermont. I have asked Jim
Jeffords to consider John (Josh) Fitzhugh who was appointed by my
husband as counsel to the Governor. He continues, at least
temporarily, in that position with Governor Dean.
My husband thought very highly of Josh's abilities and, as you
know, was not someone who gave praise lightly. Josh is
exceptionally intelligent but, of even more importance, is his
ability to display thoughtful, objective judgment even in times
of crisis. His experience in litigation is included in the
enclosed resume and puts him on an equal footing with other known
candidates for the position.
Additionally, he is a proven Republican who has worked diligently
for Republican candidates. Not all of the candidates can claim
this attribute. I have recommended his appointment to Jim
Jeffords but do not know his current list of eight candidates or
whether Josh is included.
I strongly endorse John Fitshugh as a candidate and hope that he
will be given the opportunity that he deserves.

RE: Proposed Regulations for the New Medicare Physician Fee
Schedule
- In 1989, Congress adopted legislation to implement a new physician
payment system for Medicare beginning January 1, 1992 -- the most
sweeping changes in the Medicare program since its inception.
- The key issue in dispute is the Health Care Financing
Administration's proposal to apply a "behavioral offset" and
thereby reduce physician payments by 6.5 percent (which brings the
total reduction in payments caused by implementation of the new
fee schedule to 16 percent). This is a clear violation of
legislative intent and the agreement reached between Congress,
medicine, and the Administration in 1989. The behavioral offset
provision had been dropped from the conference report in favor of
a different volume mechanism (Medicare Volume Performance
Standards).
- HCFA's intransigence is unresponsive to an overwhelming political
reaction in support of medicine's position. HCFA has received a
record 100,000 + comments on the proposed regulations.
- Over 80 percent of the Members of Congress have written HCFA, HHS,
OMB, or the President in support of medicine's position,
indicating the proposed rules violate Congressional intent.
- Medicine has traditionally been a large influential base of
support for Republicans and I see it turning to the side of the
Democrats over this single issue. The Republicans cannot afford
to lose any votes in the upcoming elections.
- HCFA and OMB can remedy this situation by simply dropping plans
for the 6.5 percent behavioral offset.

A while back I mentioned the job status
of Charlie McManus over at Interior. He was
positioned at Interior in the office of Program
Analysis on a contract basis and his contract has
been renewed once, and cannot be renewed again.
His request this Spring for a "Schedule C"
appointment was denied earlier this year by the
White House, although the Personnel Office at
Interior has inquired as to the possibility of a
reconsideration.
I wonder if it would be possible to learn
whether reconsideration is possible or whether the
final decision has been made. I think that would
be a courtesy to Charlie in either event.
If it would be possible to receive a
clarification on this, I would be most apprecia-
tive, as would Charlie McManus.

do advance work for the President once the campaign begins.
Although I would look forward to working on the campaign,
I decided in mid-September to put my name in to fill one of the
four vacancies on the Superior Court of the District of Columbia.
I believe I am highly qualified (I have enclosed relevant
supporting information) and I have received good support from
prominent members of the local bar (Brendan Sullivan and others),
prior colleagues (I served in the United States Attorney's Office
and D.C. Corporation Counsel's Office) and judges before whom I
have practiced or with whom I have worked.
As you know I am a Republican. I have supported the
President's campaigns financially over the last twelve years and I
presently contribute to the Party through the President's Club. I
also worked locally at the polls for the Party during the last few
Presidential campaigns and I actively supported Maurice Turner
during his recent campaign. Being a Republican in the District has
some disadvantages, which is the purpose of my letter.
In the District a seven member D.C. Judicial Nomination
Commission selects three names for each judicial vacancy on our
local courts and sends them to the President who then nominates one
of them. I would appreciate your assistance in this process and,
if it is appropriate, some assistance now before any names are
selected by the Commission. Most of the Commission members are
Democrats and a few are fairly liberal. While I think I have a
mixture of support, a call to Mike Madigan, who is the Commission
member selected by the President, from the appropriate person in
the White House would be helpful for me in the initial selection
process. Mike and I know each other, we were each Assistant United
States Attorneys, but there are apparently quite a few names before
the Commission.

Dear Governor Sununu:
We are writing to bring to your attention legislation we have
introduced that that provides an alternative to the Family and Medical
Leave Act consistent with the President's position as expressed in the
Statement of Adminstration Policy of September 30, 1991: The American
Family Protection Act (S. 418 / H.R. 1270) Our legislation would
allow employees to leave employment for up to six years to care for a
new child and up to two years to care for a seriously ill family
member. When the employee wishes to return to the workforce, that
employee would be granted preferred rehire status.
Unlike other substitutes being prepared for the Family and Medical
Leave Act, the Family Protection Act is not a compromise, but an
alternative. It takes an entirely different approach to work and
family time issues than H.R. 2. By not mandating an employment
benefit, the Family Protection Act will keep federal policy out of an
area traditionally, and properly, negotiated between employer and
employee and will avoid the slippery slope leading to paid leave.
The American Family Protection Act is not a mandated fringe benefit.
It is an employment preference for certain returning employees similar
to -- and actually less restrictive than -- veteran's reemployment.
Unlike the Family and Medical Leave Act, employers are not required to
reinstate the employee whenever he or she wishes to return or to
continue health insurance while the employee is on leave. An employer
would have only two requirements under this bill. First, he or she
must notify an employee who wishes to return to the workforce of
positions that become available for one year after the employee
applied to return. Second, they must reinstate the employee in the
first position for which the employee is qualified that becomes
available. The employee bears the burden of proof.
Unlike the mandated one-size-fits all approach of H.R.2, the Family
Protection Act provides employers and employees with the flexibility
to work together to meet their mutual needs. This legislation will
allow Congress to support the principle that the workplace should be
flexible. This legislation allows opponents of mandated leave to
demonstrate that it is possible to be both pro-family and
pro-business. We believe that it is important that those of us who
oppose the mandated approach of H.R. 2 to offer an alternative that
members can be for that does not mandate benefits. Many conservative

and moderate Democrats who have supported the administration's
position in opposition to the Federal government mandating employee
benefits are uncomfortable with a "just say no" approach to this
issue.
An administration endorsement of the American Family Protection Act
would contribute significantly toward its standing as the principal
alternative to H.R.2. This would divert Members of Congress away from
split-the-difference compromises that merely water down H.R. 2 and
could well acquire veto-proof support. As you know, several members
in both parties have plans to offer such compromise benefit mandates.
We have enclosed information about this legislation for your perusal.

My Dear Governor:
Thank you for your kind letter of September 4th, and thank you
also for your interest in my concerns on the economy. Events
subsequent to our correspondence are certainly reinforcing
these concerns.
I have reviewed the material which John Heinz and I had been
discussing, and have brought it up to date, and in this letter
will present a summary of the areas of concern with
recommendations. I hope that the summary will be more useful
to you than the voluminous source material.
ON BANKING:
The regulators claim that they really haven't changed the
rules. While this may be de jure so, it is de facto nonsense.
They may be the same old rules, but the interpretation and
enforcement thereof is now draconian, and as a consequence,
bankers feel deprived of the opportunity to manage their
business as managers, using business judgments to solve
problems, and loan officers feel terrorized and, consequently,
not at all interested in taking even normal and prudent
business risks. The consequences of this all-pervasive mood to
the economy are becoming obvious to even the most casual
observors. Specifically, there can be no doubt that the
regulators have become much more stringent in the examination
process and, although some of these changes are warranted, many
are severely impacting on the banks' ability to deal with
existing customers and new customers. Examples are:
There is little or no flexibility allowed in trying to
negotiate a restructuring of an existing debt without
having to classify the loan as a non-performing loan.
Loans are being classified "Special Mention",
"Substandard" or "Doubtful" on a more frequent basis than
they have in the past, which is resulting in a larger
number of problem assets on bankers' books. In many
banks this has produced a flight to only the highest
quality loans.

New real estate appraisal regulations require that a
discounted cash flow analysis be completed, and at very
high discount rates and capitalization rates, which
severely impacts the value of the underlying collateral.
An additional consequence is that banks are simply
lending no money at all on raw land of any kind,
regardless of value.
o
Highly leveraged transactions (HLT's) are getting a high
level attention from the Regulators, to the extent that
new credits are virtually non-existent. Perhaps not
doing any of these deals today is okay, but a serious
problem arising from this policy is the impossibility of
restructuring or refinancing existing transactions,
bringing on unnecessary distress and failures.
The sum of these policies is to put the banking industry in
extremus and sectors of the economy along with them. What's
needed here, John, is not so much a change in the rules (which
might be politically difficult), but instead a change in the
interpretation and enforcement of the existing rules so that
the OCC and the bankers would understand that the clear
intention of the government was business as usual or an
evolutionary improvement in practices instead of a
revolutionary, "everything must be fixed today" attitude. I
believe that the OCC could communicate its determination to
have a banking system more sound than that which existed a few
years ago without the present excesses as outlined above, which
are clearly further endangering the banking system and the
general economy as well In this case, the prescription is
rather simple: "lighten up.
TAX LAW

The Tax Reform of 1986, with the changes made to passive
income and passive loss rules, has had a materially
adverse effect on real estate values Capital is not
flowing to real estate at anywhere near the same levels
as in the past, and it would seem to me that this matter
must be revisited in order to provide a potential
stimulus

In the same vein, changes in the tax investment credit
laws seriously curtailed economic incentives to get the
economy going. I believe that investment tax credit

benefits would motivate companies to re-evaluate capital
expenditure plans and boost much needed capital goods
spending with a potential multiplier effect. Our nation
suffers from an inadequate net savings rate compounded by
the federal deficit. Investment tax credits would
stimulate "savings" in the form of capital investment.

Tax-free incentives and depreciation rates were both
adversely affected in recent tax overhauls. Both need to
be revisited as potential stimulants.
Capital gains -- No one has worked harder for capital
gains than you and the President. Be that as it may, it
is clear that while Congress may have been taking aim at
the rich when they curtailed capital gains, they have
only succeeded in shooting the economy in the foot.
ENVIRONMENTAL LAW:
Unthoughtul and uneconomic environmental law is, in my view, an
important drag on the economy. A few examples suffice.

Spending tens of billions of dollars on sulphur dioxide
emissions (acid rain), after a $600 million government-
sponsored scientific report indicating that these
expenditures are not in any way justified by the facts,
seems a luxury we cannot afford.
Over-zealous wetlands laws are playing hob in the
development industry.
0
The environmental cleanup laws provide for, in addition
to excessive cost and liability claims, provision for
specific liability by innocent and unknowing parties as,
for example, banks. Banks are forced into the position
of being uncertain as to their liability, and this is
having a substantial impact on their willingness to lend
to many industries. The legislation that has created the
Super Fund and the management thereof is a fine example
of folly. We have spent 40% of the money cleaning up 2%
of the sites, and most of the money has gone to
litigation, not cleanup. The effort by Congress to
protect the taxpayers from the cost of cleanup has only
succeeded in running up these costs, delaying the
cleanup, and most likely in the long run, the taxpayers
will end up with the tab anyway.

ACCOUNTING ISSUES:
The Financial Accounting Standards Board (FASB) continues to
render opinions and promulgate regulations which make it more
and more difficult to negotiate workable arrangements by banks
to help troubled borrowers. Some of these changes, which might
seem arcane, in fact go right to the heart of the bank's
balance sheet.

When must a loan go into non-accruing status? The rules
have been moving to force banks to classify loans as non-
performing more quickly, which increases the bank's level
of non-performing loans and decreases their willingness
and ability to work out problems in a businesslike way.
0
Similarly, recent proposals for "loan-splitting", which
would have allowed, in certain circumstances, that a
portion of a loan could be written off and the balance
made performing, has been rejected by FASB, the GOA and
the SEC. These proposals were designed to take some of
the short-term pressure off of banks, which badly needs
to be done.
These changes taken together simply add to the pressures on
banks, which are already very great, causing them to further
retreat from their very critical function in our economy of
keeping the system adequately liquid and providing the funds
for business expansion.
Well, John, this letter is already embarrassingly long. I have
no doubt that you well understand the thrust of my concerns
and the policies recommended to improve our situation. The
regulatory pendulum was on the permissive side in the mid-80's.
Instead of returning it to equilibrium, the regulators have
brought it totally to the other side. Too much money was being
lent too easily. Now not enough money is obtainable under
reasonable circumstances. I urge some pretty prompt action
because I think things are seriously amiss and getting worse.
In this case, a stitch in time might save twenty-nine.
For good measure, you might want to consider the value of
having Clarke's reappointment be rejected by the Senate.
That's probably a double-edge sword, but I think Clarke has
been particularly insensitive and intransigent, and I suspect
he thinks that by being so tough on the banks, he is protecting
the OCC from political assault. Perhaps so, but at what cost

to the country? We need a Comptroller of the Currency who is
more interested in defending the country and less interested in
protecting his own bureaucracy from the slings and arrows of
outrageous fortune. That sort of sacrifice is, as you know
better than anyone, John, what makes up real statesmanship.

can do, but you know that I would be more than happy to be
helpful any way that I can.

My interview with Barbara Davidson of the U.S. Department
of Education (she's the White House liaison to Sec. Lamar
Alexander) went very well on September 25th.
Ms. Davidson seemed eager to see me get placed within the
department, as did John Flores of the new Hispanic Task
Force.
Would appreciate it greatly if you could Followup on this
for me. A good word from you could make all the difference
in the world. I'm suppose to call Davidson back in two weeks
or on October 8th to see how things are coming along.

Dear John,
Thanks SO much for getting the President's autograph on my picture giving
him my Estonian story. And, despite my little jab about the Gregg's (I
loved your wonderful response) I think you are doing a fabulous job for the
President and you have no stronger admirer or outspoken supporter than 1.
I'm hoping to return to Estonia this November 5. I have several small
businessmen and doctors over there for whom I am establishing contacts
here in the United States. The businessmen are looking to buy computers,
the doctors medical supplies, etc. Nashua Corporation is giving me some
floppy disks and copy cartridge toner to see if I can locate a distributor.
Several of the Estonians have visited me already. I have two Estonians
living with me now - one is Liina Sild, whom I am trying to get into
Northeastern Graduate School of Business Administration. When she goes
home she will be my contact in Tallinn. She speaks five languages
fluently and has translated for several joint ventures.
I attended Warren and Bob's super International Trade Conference Monday,
and I. am anxious to get some Estonian names in the the National Trade
Data Bank (there are none now.) I wonder whether the President will be
sending some Americans over to work on business contacts. I would love
to do that and to promote some NH businesses. And to see an American
Embassy set up soon SO Estonians can register in the NTDB in Commerce.
If you have any thoughts or other people to whom I should speak, I would
appreciate your advice. I love the Estonians and really want to help them,
in any small way, both to get through this winter and to establish trade
with the US.

I am writing on behalf of Bob Wallace, the Veterans of Foreign Wars Commander-in-
Chief, 1991-92; Larry Rivers, Executive Director, VFW; and myself, to request a meeting with

I have known Bob for several years. He has been an effective and key leader for
veterans in the State of New Jersey and nationwide. A Vietnam Veteran, Bob was appointed
by Governor Tom Kean as New Jersey's first Deputy Commissioner on Veterans Affairs. In
1989 he became the VFW's Junior Vice Commander-in-Chief; in 1990 he was named the Senior
Vice Commander-in-Chief; and last year he was elected to serve his current term as
Commander-in-Chief at the National Convention in New Orleans.
As the leaders of the nation's largest veterans organization, I am confident that Bob and

Dear John:
I am writing to personally express my adamant opposition to the
various legislative proposals which make the Social Security
Administration (SSA) an independent agency. As we are confronted
with decisions on other SSA proposals, such as the Retirement
Earnings Test proposal, we must hold firm on our refusal to
accept any provision to strip SSA from the Department.
It is my heartfelt belief that making SSA an independent agency
would be detrimental to our Nation's elderly. As you know, SSA
acts as a conduit for a wide and well-coordinated array of
Federal and State services available to elderly and disabled
citizens. Separating SSA from the Department of Health and Human
Services (HHS) would destroy that coordination and make access to
these vital services much more difficult.
There simply is no compelling reason to change the status of SSA.
According to independent surveys, public satisfaction with the
service SSA is currently providing is extremely high. There are
no territorial fights or interagency quarreling, and there will
not be as long as all services are coordinated under central HHS
guidance. The public is being well-served under the current
arrangement.
The Congressional attempt to make SSA an independent agency is
one of the most critical issues facing this Department - and one
that I am personally committed to fighting. I greatly appreciate
your continued support on this issue of vital importance to HHS.

I was traveling when the President's new policy on wetlands
was released, and since my surgery, I've reviewed the White House
release outlining the policy. It is a balanced approach which
protects our wetlands resources.
Thank you for your understanding and help with developing a
policy that respects Alaska's wetland situation. This is a very
important issue for the future of my state. I appreciate your
consistent support throughout this process.
I also look forward to working with you and your competent
staff on implementing the new policy statement. Ms. Teresa
Gorman is a very capable young woman who has shown an
understanding of the complicated issues with respect to Alaska.
Her assistant, Mr. Ed Goldstein, is capable and helpful as well.
As the Administration implements the new policy, the Alaska
delegation remains ready to assist in any way we can. We want to
make sure that Alaska is part of the national policy.

As you may know, our Inaugural Celebration for The Year of Clean Water is scheduled for
October 30, 1991. America's Clean Water Foundation's Board of Governors' Co-Chairs,
Senator Edmund Muskie, Senator Howard Baker, Representative John Blatnik, and
Representative William Harsha are officiating this significant event (agenda attached). An
invitation was sent to President Bush inviting him to speak, however, his office declined due
to scheduling conflicts.
The Inaugural Celebration for The Year of Clean Water provides an ideal time to announce
the Presidential Proclamation (draft attached) and I would be honored to have you or a
member of the President's Senior Staff present the Proclamation to our Board of Governors.

Dear Governor Sununu:
I have recently become aware of administration testimony concerning
changes in the implementation of the young child tax credit. I am
writing to express my concern about the apparent change in
administration policy on this important provision of the tax code.
The inclusion of the so-called "wee tots" provision in the child care
agreement in the budget reconciliation package passed by Congress was
of great importance to those who do not like the current bias in the
tax code against families who choose in-home parental care rather than
out-of-home care. I believe that this victory was made possible by
your personal persistance on the issue.
As you are aware, the "wee tots" credit provided balance in the tax
code for parents who give up one income to have one parent stay at
home by being tied to a "no double-dip" requirement vis-a-vis the
dependant care tax credit. Eliminating the interaction between the
supplemental young child tax credit and the dependant care tax credit
would undermine the intent of the young child tax credit.
It is for this reason that I was concerned to note the testimony by
Assistant Secretary of Treasury for Tax Policy, Kenneth Gideon, before
the Senate Finance Committee on September 10 He proposed repealing
the interaction rules between the young child tax credit and the
dependent care tax credit in order to simplify the earned income tax
credit. While reducing the complexity of the tax code is an admirable
goal, I would urge the administration to explore ways to achieve this
goal without eliminating the one small credit in the tax code that is
available exclusively to families who choose in-home parental care for
there children.

Rotunda of the Russell Senate Office Building? We hope so, because
we're bringing a bit of Alaska to the U.S. Senate.
You are invited to visit "LAND OF THE MIDNIGHT SUN", an
exhibit of the people, environment, wildlife, and natural resources of
Alaska's North Slope. The exhibit will be on display in the Russell
Rotunda from Monday, September 16th through Friday, September
20th, from 9:00 am to 6:00 pm.
"LAND OF THE MIDNIGHT SUN" will bring a visual image to the
Senate through photographs, demonstrations and interpretation of
native handiworks and artforms by visiting Eskimo artists, and a
display of Eskimo artifacts and implements of Eskimo culture.
We would also like to extend a special invitation to you to attend
a reception we are hosting Thursday night, September 19, from 6:00
pm to 8:00 pm. It will be held within the exhibit in the Russell
Rotunda. Drop by for an Alaska seafood buffet. Try a taste of
traditional Eskimo food. The reception will feature a stirring special
performance of Eskimo dance by Native Alaska dancers. Visiting
Alaska leaders will be present to discuss some of the major policy
issues affecting the North Slope. The reception will join together the
people, sights, sounds, and tastes of Alaska in one memorable evening.

recommending Vaughan Edward Taylor for nomination to the
Court of Military Appeals. As I stated in the initial
correspondence, Vaughan is not a constituent of mine, nor do
I have any political connections with him. He is simply
supremely qualified to serve on the Court.
Subsequently, I sent four followup letters to, and spoke
on numerous occasions with, Chase Untermeyer in support of
Vaughan's candidacy. Moreover, I discussed the issue with
members and staff of the Senate Armed Services Committee,
whose feedback was consistently positive. Further, my staff
contacted Judge Cox, a member of the Court who is thoroughly
familiar with Vaughan's qualifications, and strongly supports
his candidacy. In short, I researched and fully answered
every conceivable concern regarding Vaughan Taylor's
professional and political suitability for nomination.
Yet, irrespective of my efforts, it seems that no action
has been taken on this matter. Presently there are three
open seats on the Court. By law, no more than two of these
three vacancies can be filled from one political party.
However, since Vaughan has registered as an independent, his
nomination would comply with the requisite statutory ratio.
Additionally, the Court would gain an exceptionally qualified
jurist.

Dear Dr. Sununu:
I write to you as a fellow member of the National Academy of
Engineering, to help with a major detriment that is about to descend upon
government engineers and scientists. This is a regulation by the Government
Ethics Office to prohibit government employees from serving as officers of their
professional societies. As a participant in the space program and as 1989
President of the American Meteorological Society, I am deeply concerned with
the damage this rule will do to the quality of government engineers and
scientists as well as to societies such as the American Meteorological Society
and the American Geophysical Union, which have a membership comprising
about one-half government employees. I am sure a major adverse impact will
also accrue to the engineering societies.
Morale at the Goddard Space Flight Center (where I work as Chief
Scientist for Meteorlogy and Project Scientist for an important satellite in
MIssion to Planet Earth) has plummeted on hearing of this regulation. The best
scientists and engineers can always get jobs elsewhere and many of them will
leave, with the more mediocre ones left in the government. I never would have
left an endowed Chair Professorship at the University of Virginia to join
Goddard if such a regulation had been in effect. This will do untold damage in
recruiting young scientists and engineers into the space program. One of my
best post-docs about to be hired into NASA has changed his mind at the last
minute because of this ruling.
I earnestly hope that you and your staff will do everything you can to
stop this outrageous extension of bureaucracy, which will surely make
government scientists and engineers into second-class citizens of their peer
communities.

Dear Governor Sununu:
Enclosed please find a copy of a letter I sent to the President today outlining my recent
trip to war torn Yugoslavia. I traveled with Rep. Frank Wolf and former Under Secretary of
State Richard McCormick from August 28th -- September 3rd.
There is not doubt in my mind that the conflict between Croatia and the Serbian
insurgents could quickly escalate into an all out civil war with hundreds of thousands being
killed or wounded. We met with both President Tudjman and President Milosevc and it appears
that peace will be impossible without increased U.S. attention and visible solidarity with the EC
efforts to resolve the crisis in Yugoslavia.
For this reason, I believe it is urgent for our delegation to meet with the President as
quickly as possible. Any help you may render in scheduling a meeting would be most
appreciated.

It was great seeing you at Waterville Valley the other day.
I am writing to ask you if it would be possible to arrange
for the New Hampshire State Society to hold a White House buffet
luncheon featuring New Hampshire food products.
My firm, YOUR NEW HAMPSHIRE SOURCE , can provide some of the
finest smoked turkey, smoked ham, smoked cheeses, etc. The food
would come from the North Country Smoke House in Claremont, NH.
Also if the idea appeals to you, I can arrange for other food
companies in New Hampshire to participate. I am sure that all of
the NH food companies would bust their backs to make the affair
memorable You know how great New Hampshire foods can be.
It would be an occasion where you, as the host, could be among
many of your friends. You might be able to show off New Hampshire
to people who don't know that New Hampshire is truly a state where
the Good Lord has chosen to provide superior quality in many ways.
YOUR NEW HAMPSHIRE SOURCE was organized by me at my age 76
to try to bring some life into the economy and at the same time
earn a few dollars to supplement my retirement income.

was a great honor for us to have you there and to have the
President represented. My only regret is that I must have been
in more of a daze than I thought, because I did not ask you to

address the National Summit of Independent Higher Education on February 6, 1992 in
Washington, D.C. I enclose a copy of my letter to President Bush in which I encourage
him to accept the invitation.
If President Bush were able to address the meeting, the format and timing would be
arranged to suit the President's convenience and desires. I have been asked to introduce
the President and would be extremely honored to do so. The President also has been asked
to consider attending a small meeting of selected university presidents and trustees if his

My Dear Governor:
I had been contemplating for some time prior to the tragic
events of the 13th a letter to you on the nation's economy.
Even now, it seems important enough to make the effort.
First, let me start with a little "joke" told me by Bruce and
Bob Beal of Boston, with whom I believe you are acquainted:
How do you tell the difference between a national
bank examiner and a terrorist? Answer: you can
reason with a terrorist.
John, I am genuinely quite concerned that what is going on in
our banking system is liable to provoke another recession and
also to deprive us of some of the great opportunities which we
would otherwise have next year to elect a more enlightened
House and Senate.
Allentown is a small city, but in many ways a microcosm of the
nation. Our economy is soundly based and diversified. Our
real estate market is in good shape, and we have not
participated in any easy-money excesses. Nevertheless, good
people are starting to suffer a good deal from the credit
crunch.
I am personally involved in venture capital and in real estate.
In both of these businesses, I see continuing and, indeed,
intensifying pressures that show no signs of amelioration. I'm
not worried about what's happening to inexperienced or reckless
managers or to over-leveraged folk. My concern is for solid,
able conservatives who are being hurt and hurt badly by what
appears to me to be very close to a simple unwillingness on the
part of banks to lend to small business and real estate. Let
me give you some examples.

In early stage and startup venture capital, in which I am
involved, we normally put up perhaps $300,000 to $500,000 to
start a new enterprise. After a company demonstrates for a
year or so consistent and exciting growth and profitable
operation, we could take them to a bank for additional
financing, and they would no longer be dependent upon us.
That's no longer true. Now we have to stay with even our most
successful companies for another stage or two, thus greatly
limiting the number of startups which we can manage with our
capital. Since such startups are vital to job formation in our
nation, the reduction in entrepreneurial effort as a conse-
quence of the credit crunch places real limitations on the
growth of the economy.
In the real estate business, the bank windows are just plain
closed. Good deals are falling apart for lack of even
conservative financing. John, I fear it's going to snuff out
and reverse the recovery if something is not done promptly and
effectively.
I know that the banks publicly state that they're lending and
it's business as usual. When you get them in a quiet corner
though and they let their hair down, they admit that the truth
is far from their public utterances. And if they're sure
nobody's listening, they blame Clarke and the feds.
I have been raising alarms on this matter for well over a year.
John Heinz and I worked very closely together, and John set up,
at my request, a meeting last fall with the principal able
developers of eastern Pennsylvania (Rouse, Linpro, Evans,
etc.), some principal bankers, and some principal businessmen.
The meeting was notable for Clarke's lack of candor on the
matter and for the banks' timidity in openly facing up to the
problem. of course everybody wants a sound banking system, but
as a conservative I believe in evolution, not revolution, even
in regulatory matters.
Congress started the trouble by cutting the value of real
estate about 30% (depreciation rules, active/passive rules,
capital gains). You can't expect to reduce banks' principal
assets by 30% by legislative fiat and not have dislocations.
These dislocations need to be handled delicately. I'd be glad
to share the material that John Heinz and I were working on

before his death with any member of your staff if that would be
helpful. The long and the short of it is that I think the
economy is a good deal more precarious than is being publicly
admitted, and I fear for next year.
John, it was so very kind of you and Nancy to come to
Montpelier last Friday for Dick's service. I know he would
have been pleased.

Enclosed, please find a copy of the 1991 report written for Environment
Opinion Study, Inc. (EOS). This is the second in a series of annual public
opinion surveys of environmental issues on which I have been one of the
principal investigators.
EOS2 examined public awareness and perceptions on a number of
general environmental issues, as well as five specific issues with which
Congress has been dealing this session. Those issues are: oil exploration and
drilling in the Arctic National Wildlife Refuge (ANWR); Corporate Average Fuel
Economy Standards (CAFE); wetland protection; and the reauthorizations of the
Clean Water Act and the Resource Conservation and Recovery Act.

Dear John,
I am very interested in exploring the possibility of working
with or serving on the President's Council On Competitiveness.
It has been an avid interest of mine for many years. In
addition, as you know I am a lawyer. Having been a civil
litigator for many years (four of which as an Assistant United
States Attorney representing the United States and the various
Federal agencies when they were named as defendants), I
wholeheartedly agreed with the recent comments made by the Vice
President on the role the legal profession is having on the
competitiveness of American industry. I would appreciate
whatever assistance you could give me or if you could point me in
the right direction.
So that I will not bother you twice, I am also interested in
