SUBJECT:
H.R. 7718, Amendments to the Postal
Reorganization Act.
You asked for the status and the legislative intent of language in H.R. 7718 which
would require that Members of the Postal Rate Commission be appointed with the
advise and consent of the Senate.
The bill H.R. 7718 is pending before the Postal Service Subcommittee of the House
Committee on Post Office and Civil Service. On Wednesday, July 9, 1975, at
9:30 a. m. in room 311 CHOB, the Postal Service Subcommittee will begin mark-up
of H.R. 2445 (Hanley, D-NY) to amend the Postal Reorganization Act. At that
mark-up session it is expected that H.R. 7718 will be offered as an amendment
to H.R. 2445.
H.R. 7718 does amend the postal reorganization act to require that Members of the
Postal Rate Commission be appointed with the advise and consent of the Senate.
The language of H.R. 7718 requiring Senate confirmation is on its face ambiguous.
Such language can be interpreted to mean that the present Members are not subject
to confirmation on re-appointment and the same language can be interpreted to mean
that the present Members of the Commission are subject to confirmation upon re-
appointment.
Ted Kazy was hesitant but insistent that the legislative intent of the Committee
language is that present Members of the Commission would be subject to Senate
confirmation upon re-appointment.
