10:40 Dawn talked with Ken Lazarus; he suggested there
were two people who were added to the list --
one a close personal friend and the other a former
roommate. She suggested possibly Albert Engle and Leon
Higginbotham might be those two. (She is taking a list over to
Marie Downs this morning to go over the seating arrangement.)
Mr. Buchen advises there was no one on the list who was
a former roommate.
Engle is from Western Michigan. Leon Higginbotham is Judge of
District Court of the Eastern District of Pennsylvania.
He should perhaps be with the President --???---but in terms
of prestige or quality of judges ?????
Then he said he wanted to see the whole package as soon
as he returns from the swearing-in.

I. PURPOSE
To honor the efforts of the men and women of the Federal
judiciary.
II. BACKGROUND, INVITEES & PRESS PLAN
A. Background: For many years there existed the tradition
of an annual White House dinner/reception honoring
Federal judges. This practice was discontinued in the
last Administration, apparently resulting in some
adverse comments within the judicial community.
The reinstitution of the event should be well received
by the judiciary and by Members of Congress and the
public interested in the operations of the Federal
courts. Particular attention should be given to the
event due to the recent retirement of Justice Douglas
and public speculation on potential appointees to fill
this vacancy. Of course, the dinner was set prior to
the resignation of Justice Douglas.
B. Invitees:
GREATO FORD LIBRARY
1. The invitation list included: (1) the Justices of the
Supreme Court; (2) the Chairmen and ranking
Republicans on the Senate and House Judiciary
Committees; (3) all of the Chief Judges of the various
Circuit Courts and other distinguished members of
the Federal bench; (4) the Chairman of the Conference
of State Chief Justices; (5) the Attorney General,

Deputy Attorney General and Solicitor General;
and (6) Phil Buchen, Jack Marsh, Ed Schmults,
Ken Lazarus and Dick Parsons of the White
House staff. Spouses were included.
2. A list of attendees will be provided by Maria Downs.
C. Press Plan: (1) Anticipate pool coverage of
arrivals and toasts; and (2) dinner to be announced.
III. SCENARIO
1. The President and Mrs. Ford and the Chief Justice

Mrs. Ford and I are delighted and honored by the presence here
tonight of so many distinguished jurists.
This dinner revives a custom of the fifties and early sixties --
an annual event at the White House to recognize the vital contribution of
the Federal judiciary to our free republic.
It seemed especially very appropriate to restore this custom in
the year of our Bicentennial. We are looking back with gratitude to the
great Americans who perceived that a strong system of justice is the
firmest pillar of this Nation's freedom.
With a clear understanding of history, these men knew that
justice was too important to leave solely in the hands of individuals. They
knew it was vital to have a rigid framework of justice, carefully constructed
and firmly anchored in a written constitution.

Our founders were confident that once this framework of justice
was built, individuals worthy of maintaining the structure would be found.
In this perception, they were proven right even beyond their most extravagant
hopes. A strong judicial system produced giants of the law, and became
even stronger in the process. The names of those giants ring out from
our history like the sounding of the Liberty Bell itself - -- Marshall, Holmes,
Brandeis, Learned (LUR-NED) Hand, and many others. They symbolize
the genius and wisdom that two centuries of American justice have produced.
Looking back, we can feel pride in this judicial system. Looking
ahead to our third century, we must pledge ourselves to make it even better.
I commend each of you for your outstanding work in preserving and
extending justice during a troubled and perplexing age. On behalf of all
our citizens, I thank you and your colleagues not with us tonight for protecting
the judicial structure which has kept Americans free for 200 years --
and which will keep us free.

the practitioner can produce something that is 200 pages in
length - - and still have it called a brief. Well tonight, let me
assure you that the brief I am about to present -- will be very.

a free republic. And tonight Mrs. Ford and I are delighted and
honored by the presence of so many distinguished jurists.

great Americans who conceived our system of government and
who understood that a strong system of government under law is
the firmest pillar of this nation's freedom.
With a clear understanding of history, the Framers
knew that an independent judiciary as the guardian of a written
Constitution was essential to the preservation of individual liberties
under a government of limited powers.

Our strong judicial system has been an example to the
world of how an independent judiciary can restrain the other
branches of government when they overreach, and, on occasion,
prod them to action when they fail to meet their responsibilities.
It has produced many whom we think of as giants of the law:
Marshall, Holmes, Brandeis, Hand, Frankfurter and others --
including William O. Douglas -- symbolize the genius and wisdom
that two centuries of American justice have produced from men
and women of widely differing political philosophies. But our
greatest pride is not in a few outstanding individuals; it is rather
in the legion of able and honest jurists whose daily performance
has given our entire judiciary a well deserved reputation for
competence and integrity.
I commend each of you for your dedicated work during
a troubled and changing time. On behalf of all our citizens, I
thank and commend you and your colleagues not with us tonight

THE PRESIDENT: Mr. Chief Justice, distinguished
members of the Judicial system, both Federal and State, honored
guests, ladies and gentlemen:
It has been said that the law is the only profession
in which the practitioner can produce something that is 200
pages in length and still have it called a brief. (Laughter)
Well, tonight let me assure you that the brief I am
about to present will be very. This dinner revives an annual
White House custom of past years to recognize the vital contri-
bution of the Federal Judiciary to the maintenance of the free
republic.
Betty and I are delighted to -- and I should say
highly honored -- by the presence of SO: many distinguished
jurists and their spouses. It is appropriate, in my judgment,
to restore the customs as we approach this Bicentennial.
It is vital, as I see it, to renew our gratitude to the great
Americans who conceived the American system of Government.
They, under that Government under law, with its
proven checks and balances, is the firmest pillar of this Nation's
freedom, with a clear understanding of history, the framers knew
that an independent Judiciary, the guardian of a written
Constitution, is essential to the preservation of individual
liberties under a Government of limited powers.
Our strong Judicial system offers the world an example
of how an independent Judiciary can restrain the other Branches
of Government when they over-reach and, on occasion, force them to
meet their responsibilities under our Constitution.

The American legal system we all know has produced many
giants of law, both of the bench and of the bar. They symbolize
the genius and wisdom of two centuries of jurisprudence which has
produced from men and women of widely differing political phil-
osophies a great historical precedent.
It seems to me, Mr. Chief Justice, that our great
pride is not only in a few outstanding individuals, it is in the
many able and honest jurists whose daily performance gives our
entire Judiciary a well-deserved reputation for competence
and total integrity.
The Judiciary, as I see it, truly represents the broadest
and the deepest respect of the American people. As one of the
three separate Branches of the Federal Government, the Judiciary
also deserves the highest respect of the Congress and the
Executive Branch of the Government. In this spirit, Mr. Chief
Justice, I am honored to propose a toast to you for your
dedicated work on behalf of all Americans and I thank you and
your colleagues for being with both Betty and myself on this
occasion this evening.
You and your associates in the Judicial Branch of
the Government have kept the Constitution alive and I should say
vigorous for 186 years. And it remains today our strongest
guarantee of freedom for the future.
And with that, to you, Mr. Chief Justice, all that
you and your associates represent.
CHIEF JUSTICE BURGER: Mr. President, Mrs. Ford,
Mr. Attorney General, Mr. Solicitor General, my brothers of
the Judiciary and my sisters of the Judiciary, ladies and
gentlemen:
Mr. President, you and Mrs. Ford have done more than
restore an ancient tradition, and a very pleasant and happy
tradition that goes back literally, as you suggest, 186 years,
and I was reminded of it as I had the pleasure of visiting with
Mrs. Ford and Mrs. House, the wife of the Chief Justice of
Connecticut, of a gift that was recently made to the newly
formed historical society of which my brother, Tom Clark, is
Chairman. The gift is a small card, not much bigger than one of
the placecards, perhaps half as big as the menu, and it reads
something like this, "Mrs. Washington and I request the honor
of the presence of Judge Cushing" -- they were called Judges
not Justices then -- "for dinner at our house on Thursday" --
naming the date -- "at 8:00 p.m.," signed personally by George
Washington, not by some staff member. (Laughter)

That is now a treasured item in the Supreme Court
of the United States in the custody technically of its historical
society.
And, Mr. President, you and Mrs. Ford, perhaps, do not
sense it as much as we do, your guests tonight, that you have not
only revived a splendid and ancient custom by inviting the
Federal Judges to your house, the people's house, Mrs. Ford
reminded me -- this is her name for the White House -- you
have honored our colleagues of the State Courts by inviting
distinguished leaders of the highest courts of the States who,
in the time of George Washington and for many years thereafter,
were regarded not as equals, but much superior to Justices
of the Supreme Court of the United States.
I don't think we would want to give that up, with
all deference to our brothers and sisters of the State Courts,
but we would like to maintain parity and you have, of course,
in inviting us tonight, the Federal Judges and the State Judges,
you have invited us as representatives of our colleagues and
I will presume to speak with leave, sir, for both the Federal
and the States Judges and say that we are all very grateful
to you for your hospitality and for the honor you do us by
inviting us to your house.

Dick Cheney asked me to respond to your note of November 26th
suggesting we print the President's remarks at the dinner
for the Judiciary in the way we do proclamations and 11 smooth
out the text" in order to send it to the attendees at the dinner.
This procedure could cause us some problems. There might
be some confusion caused by altering the text of remarks
made by the President at a dinner, which were subsequently
made public in a press release, and printing them in the form
we use for proclamations. By doing this we could be setting
an undesirable precedent, and it is difficult to see how much
we would gain from this. I expect those who were invited
and attended were honored by attending the dinner and appreciated
the President's remarks as he made them. If Phil Buchen
thinks it a good idea, he might want to send the text to the
attendees with a cover note calling attention to the President's
remarks as a measure of his great respect for the Judiciary, etc.,
but I am not in favor of any smoothing out or alteration of the
text since his remarks are already on record.
