SUBJECT: Operation and maintenance of Imperial Dan and part of the
All-American Canal.

I net with these Senators at this time pursuant to
a call from Senator Nc/arland to my office.
Benator Hayden opened the neeting with a brief state-
ment of Arizona's interest in having the operation and
maintenance of the All-Aserioan Canal works performed by
the Federal Government, and then referred the conversation
to Senator to continue.
Senator ille Farland went over again in considerable
detail the same arguments which he and Senator Bayden
have presented in the past to support their views. He
referred to and read portions of Articles 2 and 23 of the
Water Treaty of 1944 and of the Protocol thereto. In
particular he argued that the clauses of Article 23
requiring *direct ownership, control and jurisdiction
in conjunction with the clauses in the Protocol providing
for construction, operation and maintenance of certain
treaty works by a Federal agency, require the Federal
Government to operate and maintain the Imperial Dam and
the part of the All-American Canal. Next, Mr. MeParland
argued that during the Senate hearings on the Treaty the
Department had stated that the Bureau of Reclamation
would operate and maintain the works, that the Senators
understood this to be true and that they voted for the
Treaty
