Before a General Court Martial which convened at the station of
the Headquarters of the 35th Division, American Expeditionary
Forces, 9th January, 1919 pursuant to paragraph 3, Special Orders
3, 3rd January, 1919, Headquarters 35th Division, was arraigned
and tried;
Privat tho Hartsoe (1461593). Company I, 140th Infantry.

I
: Violation of the 6lst Article of war.
Specification 1 : In that Private Otho Hartsoe, Company I, 140 th
Infantry, did, without proper leave absent himself from his Company
and proper station, Boncourt, France, from about 4 P.M. December
25, 1918, to about 8 P.M. December 25, 1918.
Charge
II : Violation of the 63rd Article of War,
Specification 1 : In that Private Otho Hartsoe, Company I, 140th
Infantry, did, at Commercy, France, on or absut the 25th day of
December, 1918, behave himself in a and insubordinate
manner towards lst Lieutenant M. E. Hollicke, 35th Military Police
Company, his superior officer.
Charge
III : Violation of the 93rd Article of War.
Specification 1 : In that Private Otho Hartsoe, Company I, 140th
Infantry did, at Commercy, France, on or about the 25th day of
December, 1918, with intent to do him bodily harm, feloniously
strike M. Vachey, a Frenchman, in the face with his fist,

: Violation of the 96th Article of War.
Specification 1 : In that Private Otho Hartsoe, Company I, 140 th
Infantry, was at Commercy, France, on or about the 25th day of
December, 1918, drunk and disorderly in uniform, and did thereby
bring discredit upon the military service.
Specification 2 : In that Private Otho Hartsoe, Company I, 140th
Infantry, having been placed under arrest in Commercy, France, on
or about December 25, 1918, by Private Charles F. Harris, (2560461),
35th Military Police Company, said Private Harris being in the proper
execution of his duties, did resist said arrest.
