ARCHIVES AND RECORDS GENERAL COURT- ) SERVICE" 826 MARTIAL ORDER ) ) No. 3. ) Before a General Court Mertial which convened at the station of the Headquarters of the 69th Infentry Brigade, 9th J muary, 1919, pursuant to prograph 10, Special Orders 264, Hecdquarters 35th Division, lst November, 1918, as modified by paregraphs 10- and 11 Special Orders 297, Headquarters 35th Division, 5th December, 1918, and paragraphs 5 and 6, Special Orders 299, Herdquarters 35th Division, 7th December, 1918, and paragraph 1, Special Orders 6, Headquarters 35th Division, 6th January, 1919, was arraigned and tried: Captain Tio S. Johnston, 13th U.S. Engineers (RY) . Charges. Charge I : Viol tion of the 96th Article of War. Specification 1 : In thet Captain VI. S. Johnston, 13th Engineers, U.S.Army, did. at Lerouville, France, between the 14th day of December, 1918 and the 38th day of December 1918, then and there being in command of detachment of Engineers, U.S.Army, negligently fail and neglect to make proper inspections of the billets and quarters occupied by the members of his said detachment, This to the prejudice of good order and military discipline. becification 2 : In that Captain S. Johuston, 13th Engineers, U.S.Army, at Lerouville, Frence, between the 14th day of December, 1918, and the 28th day of December, 1918, did knowingly and wilfully permit the members of his detachment, withcut authority, to have and keep in their possession government property to which they were not entitled, and in excess of the amount euthorized, without taking any disciplinary action. This to the prejudice of good order and militer discipline. Specification 3 : In thet Captain V. S. Johnston, loth Engineers, U.S.Aimy, at Lerouville, France, between the 14th day of December 1918 and the 28th day of December 1918, knowing that the members of his detachment had in their possession various and sundry articles of government property which had been stolen, received by them im- properly and without authority, did fail to take any disciplinary action. This to the prejudice of good order and military discipline. Sedification 4 : In that Captain W.S. Johnston, 15th Engineers, U.S.Aimy, at Lerouville, France, between the 14th day of December 1918 and the 28th day of December 1918, then and there knowing that various and sundry articles of government property were in the possession of members of his detachment, and then and there knowing that the articles so in their possession were of the identical description of articles of government property which had been stolen, did negligenti; fail to make a proper investigtion and feiled to toke proper disciplinary action. This to the prejudice of good order and militery discipline. Pleas: To Svecification 1; Charge I : Not Guilty.
