At his request I had further conversation with Ind Fon Secy
R. K. Nehru this afternoon. He said that GOI had received
telegram from its del NY in which was stated that Ind del
proposed to clarify or amplify certain points in its res
concerning which other dels had some doubt or did not (rpt not)
clearly understand them.
Among these points were the fol:
(1) Composition of the commission: Ind del believed umpire
should be incl in repatriation commission. At first
meeting of commission and prior to armistice agreement,
decision should be reached re choice of umpire who at all times
should be available to commission and who should act as chairman
unless commission otherwise agreed. If no (rpt no) decision,
matter would be referred to UN.
(2) Disposition of prisoners not (rpt not) repatriated: At
end of 90 days after armistice agreement has been signed
disposition of any prisoners who have not (rpt not returned to
their homes shall be referred with recommendations for their
disposition incl target date for determination of their detention
to polit conf. If at end of another 60 days there are any
prisoners whose return to their homes has not (rpt not) been
provided for by polit conf, responsibility for their care and
maintenance until end of their detention shall be transferred
to UN.
Nehru said Ind del in its telegram had not (rpt not) referred to
points C, D and E, in DEPTEL 1538 but suggested US del clear this
up in conversation with Ind Del.
Nehru again stated that he was informing Ind del NY of his con-
versations with me and that US del would be approaching Ind del
re these matters.
PM Nehru has not (rpt not) yet seen tel from Ind del. R. K. Nehru
thought he would find it unobjectionable. However, he will call
