My dear Mr. Latta:
On June 1, 1945, you advised this office that H. R. 2600, "To
amend section 9 of the Act entitled 'An Act to facilitate the con-
struction, extension, or completion of interstate petroleum pipe
lines related to national defense, and to promote interstate com-
merce,' approved July 30, 1941, as amended, " had been received at the
White House, and requested reports and recommendations as to the ap-
proval of the bill.
The purpose of this bill is to extend for one year, or from June
30, 1945, until June 30, 1946, the provisions of the so-called Cole
Pipe Line Act. This statute was enacted as a war measure, and vests
in the President certain powers designed to facilitate the construc-
tion of petroleum pipe lines necessary to the national defense. In
view of the impossibility of anticipating contingencies that might
arise with respect to our petroleum needs between now and the end of
the war in the Pacific, it is considered desirable to retain, at least
for the further one-year period proposed in the bill, the powers which
the Cole Pipe Line Act has vested in the President.
Facsimiles of the enrolled enactment have been referred to the
Petroleum Administrator for War and the Attorney General, and their
replies are attached. The Petroleum Administrator for War recommends
that the bill be approved, and the Attorney General interposes no
objection to its approval.
