My dear Mr. Latta:
The Congress has enacted H. R. 1563, "For the relief of N. Owen
Oxley and the legal guardian of Lamar Oxley, a minor."
It is the purpose of the bill to pay the sum of $301.22 to N. Owen
Oxley, and the sum of $3,169.40 to the legal guardian of Lamar Oxley, a
minor, both of Turthwood, Louisiana, in settlement of their claims against
the United States by reason of expenses and personal injuries incurred as
a result of the explosion on March 14, 1944, of an anti-tank mine fuze
found by Lamar Oxley in an abandoned Army maneuver area near Kurthwood,
Louisiana.
It appears that during the winter of 1943-44, Army troops on maneuvers
occupied and used an area of woodland near the town of Kurthwood, Louisiana;
that on March 13, 1944, when the area was no longer cupied by troops,
Lamar Oxley, nine year old son of N. Owen Oxley, was walking through the
area in question and found an anti-tank mine fuze of the type officially
issued to Army troops for use in practice land mines; that without knowing
what the fuze was, or that it contained an explosive charge, the boy car-
ried it to his home, and on March 14, while he was trying to pry it open,
he dropped the fuze against a metal object, and it exploded.
As a result of the explosion, young Oxley sustained serious burns
on his face, right foot, and left hand, and he was hospitalized for a per-
iod of 49 days.
A facsi mile of the enrolled enactment has been referred to the War
Department, and its reply, interposing no objection to the approval of the
bill, is attached.
The Congress has enacted, and the President has approved, a number
of bills providing relief for personal injury or death in cases where
members of the armed forces have, through negligence, left unexploded
munitions of war in practice areas, especially where such munitions a.re
found by minors who are not aware of their dangerous character, and where
such munitions are accidentally exploded.
