My dear Mr. Latta:
The Congress has enacted H.R. 3224, "For the relief of Mrs. Lionel
Comeaux and New Orleans Public Service, Incorporated."
It is the purpose of the bill to pay the sum of $2,089.78 to
Mrs. Lionel Comeaux of New Orleans, Louisiana, and the sum of $1,570.97
to the New Orleans Public Service, Incorporated, in settlement of their
claims against the United States for personal injuries and loss of
earnings sustained and for damage to streetcar owned by the New Orleans
Fublic Service, Incorporated, as the result of being struck by a
United States Navy bus at a street intersection in New Orleans,
on May 4, 1944.
It appears that on the date in question, a Navy bus driven by an
enlisted man of the Navy was being operated in a northerly direction on
one of the main streets in New Orleans on official business; that the
Navy vehicle was approaching a street intersection on which the New Orleans
Public Service, Incorporated, was operating a streetcar and approaching
the same intersection; that Mrs. Comeaux was acting as conduc torette;
that there were no passengers in the streetcar at the time of the acci-
dent; that there were stop signs for traffic proceeding on the street
on which the Navy vehicle was being operated; that the driver of the
Navy vehicle observed the streetcar and concluded that it was going to
stop, so without stopping in obedience to the stop sign, he proceeded
through the intersection; and that the operator of the streetcar
apparently had no intention of stopping and proceeded into and through
the intersection, with the result that the two vehicles collided.
As a result of the accident, Mrs. Comeaux sustained a fracture of
the frontal bone of the skull, a fracture of the second, third, fourth,
fifth, and sixth ribs on the right side, contusion to both eyes, and
abrasions to the upper and lower extremities. She was earning $65 per
week and sustained a loss in pay, in addition to payments made to her
under the Workmen's Compensation Act, of $589.78. She has apparently
recovered from the injuries sustained without any permanent disability
or decrease in earning capacity.
The streetcar of the New Orleans Public Service, Incorporated, was
repaired at the total cost of $680.36, and the payment to the Company
Relations
