My dear Mr. Latta:
On April 16, 1946, you advised this office that H. R. 2318,
"For the relief of Mrs. Mertie Pike and the estate of Mrs. Burnice
Smotherman, deceased", had been received at the White House, and re-
quested reports and recommendations as to the approval of the bill.
It is the purpose of the bill to pay the sum of $3,500 to Mrs.
Mertie Pike of Murfreesboro, Tennessee, and the sum of $5,000 to the
estate of Mrs. Burnice Smotherman, in full settlement of all claims
against the United States by reason of personal injuries sustained
by Mrs. Mertie Pike and by reason of the death of Mrs. Burnice Smother-
man, as the result of being struck by a United States Army vehicle
near Murfreesboro, Tennessee, on October 15, 1943.
It appears that, on the date in question, a convoy of three Army
trucks on official business, was proceeding north on State Highway No.
10, near Murfreesboro, Tennessee; that the driver of the last truck
in the convoy, towing a loaded trailer, steered to the left side of
the highway and increased his speed in order to pass another Govern-
ment truck which was between his truck and the second truck in the
convoy; that at the same time a group of civilians were walking north
on the west side of the road; that at a distance of about 50 yards
from the pedestrians, the driver of the passing Army truck seeing them,
sounded his horn, and continued overtaking the vehicle immediately
ahead of him; that when he reached a point three feet from the rear
of the vehicle he was overtaking, the Army driver, seeing that there
was insufficient room to pass between this vehicle and the pedestrians,
suddenly tumed his truck to the right, away from the pedestrians, and
applied his brakes; and that this action caused the rear end of the truck
and the trailer attached thereto to swing to the left and strike two of
the pedestrians, namely Mrs. Pike and Mrs. Smotherson.
As a result of the accident, Mrs. Pike, who was 40 years of age
at the time of the accident, sustained fractures of two bones in the
right leg, one of which penetrated the skin, and a fracture of the upper
part of the left thigh bone. Medical and hospital expenses in the amount
of $988.07 has been paid administratively. Mrs. Pike was a housewife and,
therefore, sustained loss of wages. The medical evidence indicates that
she has a limitation of the motion of the left hip, swelling and tender-
ness in the right leg, and suffers from pain in the hip and leg on change
in weather.
Mrs. Burnice Smotherman, who was 16 years of age, sustained a head
injury from which she was pronounced dead upon admission to the hospital.
Burial expenses in the amount of $259 has been paid administratively.
Mrs. Smotherman, who was a housewife, is survived by her husband Tazie
Smotherman, and a son, 18 months of age.
