THE PRESIDENT HAS SEEN THE WHITE HOUSE WASHINGTON December 18, 1969 MEMORANDUM FOR THE PRESIDENT The regulatory agencies are often called the fourth branch of government. To the business community whose activities are closely related to these agencies, this is particularly so. One of the major complaints regarding these agencies for the past eight years has been the bias against business indicated by their chairmen. Your appointments have gone a long way to eliminating that bias and re-establishing respect for the agencies by the businesses which they regulate. The second and equally important complaint leveled against the agencies is the sometimes unconscionable delay in getting action. Particularly in a business venture, "justice delayed is no justice at all." Your budget proposals contemplate not only no increase in the staffs of the agencies, but rather a reduction in the staffs. This comes at a time when for many of them there is an increased case load and when we are attempting to insist that they act promptly on the matters before them. I am concerned that a reduction in staffs will result in even further delays in processing the applications and other cases before the six regulatory agencies. These delays, in turn, can contribute to business's unhappiness with this Administration. I recognize the overriding importance of reducing expenditures, but also recognize that the staff components of the regulatory agencies are relatively small items. I urge that when you review the appeals from the regulatory agencies you relent regarding the steep staff cuts which you directed and restore man day levels in these agencies to close to their current levels.
