PHW THE PRESIDENT HAS SEEN IC THE WHITE HOUSE INFORMATION WASHINGTON May 17, 1974 MEMORANDUM FOR: THE PRESIDENT THROUGH: KEN COLE FROM: GEOFF SHEPARD)S SUBJECT: Civil Rights HEW has completed preparation of draft regulations for Title IX (Outlawing Sex Discrimination in Higher Education) of the Education Act Amendments of 1972, and had intended to publish them next week in the Federal Register for comment. These are said to be the most controversial regulations HEW has issued in the last ten years. Among other things, they would eliminate (1) all scholarships based on sex. This would virtually end athletics scholarships and force the reopening of thousands of private bequests of all kinds (e.g. "for a young man from Peoria", "for five men from Exeter majoring in chemistry", etc.). (2) Any sex discrimina- tion in the use of facilities, athletic or otherwise. (3) Any curriculum or course of study using materials showing sex discrimination.
