Dear Mr. Parran:
Thank you for your recent letter in which you expressed
your opposition to the provision in the Senate-passed
trade bill requiring advance notice to employees of plant
closings and layoffs of 50 or more employees during any
90-day period.
The Administration will insist on removal of the Senate
provision during the House-Senate conference on the trade
bill. Contrary to the objectives of trade legislation,
mandatory advance notice would make America less competi-
tive, not more.
In his most recent letter to the Senate on this
legislation, the Secretary of Labor stated that inclusion
of any mandatory plant closing provisions would make it
impossible for the President's senior advisors to recommend
approval of a trade bill.

nomination of Judge Robert H. Bork to the position of Associate
Justice of the U.S. Supreme Court.
President Reagan believes Judge Bork to be a man of the highest
integrity and qualification as well as an eloquent and powerful
advocate of judicial restraint, a philosophy whose guiding
principle is that it is the legislature's role to enact laws
and the court's role to interpret them.
In making the nomination, the President stated:
Judge Bork is recognized as a premier Constitutional
authority. His outstanding intellect and unrivaled
scholarly credentials are reflected in his thoughtful
examination of the broad, fundamental, legal issues of
our times.
We're fortunate to be able to draw
upon such an impressive legal mind; an experienced
judge and a man who already has devoted so much of his
life to public service. He'll bring credit to the

The American Bar Association gave Judge Bork its highest rating --
"exceptionally well qualified" -- when he was confirmed by the

Dear Mr. Hosie:
Thank you for your messages expressing the concern of the
Sun-Diamond Growers of California about the U.S.-EC dispute
over EC pasta imports and the possibility of EC retaliation
against U.S. walnut exporters. I am pleased to say that we
have reached an agreement which will end this dispute and
avoid a destructive trade war.
Under the terms of the agreement, which takes effect
October 1, the EC's export subsidy on pasta will no longer
apply to fifty percent of the EC's exports to the United
States. Furthermore, the duty refund will be reduced by
27-1/2 percent on the remaining 50 percent and is expected
to be reduced further in the months ahead. The agreement
will be monitored closely to ensure that the EC abides by its
terms. The EC has agreed not to introduce new subsidies for
pasta exported to the U.S. and not to operate its existing
subsidy system in a way that would violate the agreement.
This issue was an extremely difficult one to settle and
required compromises on both sides. Negotiations were
long and complicated. In the end, however, the United States
achieved a settlement that, I believe, will benefit American
pasta-makers.
I am relieved that a confrontation over this issue was
avoided at the last minute, but I am sure you will agree
that we should not have to go to the brink of a trade war
every time a trade dispute arises. This case exemplifies

Dear Mr. Gallagher:
Thank you for your letter expressing your concern about the
U.S. -EC dispute over EC pasta imports and the possibility of
EC retaliation against U.S. walnut exporters. I am pleased
to say that we have reached an agreement which will end this
dispute and avoid a destructive trade war.
Under the terms of the agreement, which takes effect
October 1, the EC's export subsidy on pasta will no longer
apply to fifty percent of the EC's exports to the United
States. Furthermore, the duty refund will be reduced by
27-1/2 percent on the remaining 50 percent and is expected
to be reduced further in the months ahead. The agreement
will be monitored closely to ensure that the EC abides by its
terms. The EC has agreed not to introduce new subsidies for
pasta exported to the U.S. and not to operate its existing
subsidy system in a way that would violate the agreement.
This issue was an extremely difficult one to settle and
required compromises on both sides. Negotiations were
long and complicated. In the end, however, the United States
achieved a settlement that, I believe, will benefit American
pasta-makers.
I am relieved that a confrontation over this issue was
avoided at the last minute, but I am sure you will agree
that we should not have to go to the brink of a trade war
every time a trade dispute arises. This case exemplifies
not only why we need stronger international rules to settle
trade disputes, but also the dangers of the proposed legis-
lation that would require the United States to retaliate on

History students concerning the POW/MIA issue. It is heartening
to both the President and me that they care so deeply about our
missing men and their families.
When President Reagan assumed office in 1981, he directed
that a priority effort be made to achieve the fullest possible
accounting of our men still listed as missing in Southeast Asia.
At that time, intelligence priorities were down, no negotiations
had been ongoing, and the families of these men felt ignored by
their own government.
Since then, great progress has been made and many families have
received answers to their uncertainty. Long and intense nego-
tiations have been conducted by the Reagan Administration for the
past few years, intelligence priorities are at their highest, and
more progress has been made in the past three years than at any
time since the end of the war.
Early this year, President Reagan named former Chairman of the
Joint Chiefs of Staff, John Vessey, as his special emissary to
Hanoi on this issue. He returned from Hanoi last month with new
agreements that, if honored by the Vietnamese, will bring even
greater progress.
As your students will be able to see from the enclosed material,
the problem is not in Washington, but Hanoi. The President is
determined to continue this priority effort for the remainder of
his term. We hope we can count on the support of a concerned
American citizenry to demonstrate to Vietnam and Laos our united
stand on this important issue.

Thank you for your letter expressing the National Federation of
Independent Business's views on the omnibus banking and thrift
legislation, H.R. 27.
The President recently signed this legislation, which was
urgently needed to help troubled thrift institutions whose
problems have contributed to a weakening of that industry. The
"Competitive Equality Banking Act of 1987" contains most of the
provisions included in the Administration's original plan to
recapitalize the Federal Savings and Loan Insurance Corporation
(FSLIC) and provides an acceptable level of funds to help resolve
the large caseload of savings and loan insolvencies. In
addition, it provides important new tools that banking and thrift
regulators can use to handle troubled institutions.
Unfortunately, the legislation does not include any measures to
help modernize our financial system, which continues to operate
under antiquated laws that date from the 1930s. These laws,
including portions of the Glass-Steagall Act, the McFadden Act,
and the Douglas amendment to the Bank Holding Company Act, have
become increasingly outdated as a result of the fast-changing
global financial services marketplace with its explosion of new
products and services designed to satisfy consumers' changing
needs.
Instead, the legislation includes a number of restrictions and
prohibitions that stand in the way of heightened competition,
lower costs, and increased efficiency in the delivery of
financial services. These restrictions include the closing of
the so-called "non-bank bank" loophole (which provided consumers
the substantial competitive benefits of new entrants into the
financial system) and a moratorium on expanded banking services
that is even more restrictive than the antiquated Glass-Steagall
provisions. As you know, the Administration has consistently
raised concerns about the adverse effects such restrictions may
have on both the competitive position of U.S. financial firms and
consumers' needs for a variety of competitively priced products
and services.

I certainly share your view that everyone interested in this
complex but critically important issue must work together over
the coming year to develop a reasonable approach. A financial
system that is composed of institutions that are profitable and
risk-diversified through increased competition can only serve to
promote the safety and soundness of our nation's financial
system. The Administration is confident that all members of that
system, including insurance agents, securities firms, realtors,
banks, thrifts and others, will benefit from the increased
competition that restructuring can provide.
I look forward to working together with you and other concerned
parties on these issues in the future with the parallel goals of
strengthening the competitive position of U.S. financial firms
and providing consumers with the products and services that they
desire, efficiently and at a reasonable cost.
