Mr. Schonfeld was recently denied his request for reentry into law school under the vocational rehabilitation program of the Veterans Adminis- tration. I have enclosed a copy of his statement in support of claim which will give you a good overview of my constituent's situation. In addition, I am enclosing other pertinent documentation relative to his case. It is my understanding an appeal would take a considerable amount of time and may not conclude until after his eligibility expires. Also of importance is the fact he has been permitted to begin fall quarter of Law school and is currently auditing classes. Although the school has been very kind in extending him every consideration, he cannot continue in this status for more than another week. I have met personally with Mr. Schonfeld on different occasions and have found him to be a very intelligent and articulate individual. He has indeed demonstrated to me his aspirations and motivations to become an attorney. I feel has has what it takes to become a fine lawyer. His great concern for all veterans and involvement in various veteran organizations are to be commended and recognized. Thus, I do not hesitate to recommend that Mr. Schonfeld be allowed to continue his training in law school, and I respectfully petition your kind consideration of his request. Hunter Member, United States House of Representatives 2530 Highland Avenue National City, CA 92050 Dear Mr. Hunter: Your letter of September 29, 1982, on behalf of your constituent, Mr. Bernard Schonfeld, was referred to this Service of the Veterans Administration for response. We have been in touch with the San Diego Regional Office and are aware that the regional office director responded to an earlier inquiry from your office. The San Diego staff presented Mr. Schonfeld with two options outlined in the October 6, 1982, letter to you. Now that we have discussed the case with them, the regional office staff agrees that there may well be other options which could be developed and they will be glad to consider other alternatives with him. In addition, because Mr. Schonfeld has a serious employ- ment handicap, he may be eligible to receive training beyond the usual 48 month limitation. Thus, the voca- tional objective of lawyer, with ongoing program support and assistance, will be reconsidered. Every effort will be made to reach agreement on a program which will have substantial promise for Mr. Schonfeld's bona fide rehabilitation. If the objective of lawyer is to be pursued, Mr. Schonfeld, as would all such trainees, will need to meet or become qualified to meet the admission requirements of a regionally accredited school of law that is approved for students to receive veterans benefits. A copy of this letter is being forwarded to the VA regional office in San Diego. Our staff will contact Mr. Schonfeld and schedule another counseling appoint- ment for a mutually agreeable time. STARBUCK Chief Benefits Director Sec. 1506 178 independent living services and assistance for a veteran under this chapter (following a determination by the Administrator that such veteran's disability or disabilities are SO severe that the achievement of a vocational goal is not reasonably feasible) may not exceed twenty- four months. (Amended P.L. 94-502, § P.L. 96-466, § (a).) § 1506. Initial and extended evaluations; determinations regard- ing serious employment handicap (a) The Administrator shall provide any veteran who has a service- connected disability described in section 1502(1) (A) or (B) of this title and who applies for benefits under this chapter with an initial ovaluation consisting of such services described in section 1504 (a) (1) of this title us are necessary (1) to determine whether such veteran is entitled to and eligible for benefits under this chapter, and (2) in the case of a veteran who is determined to be entitled to and eligible for such benefits, to determine- (A) whether such veteran has a serious employment handicap, and (B) whether the achievement of a vocational goal is reasonably feasible for such veteran if it is reasonably feasible to make such determination without extended evaluation. (Amended P.L. 96- 466, § 101 (a).) (b) In any case in which the Administrator has determined that a veteran has a serious employment handicap and that the achieve- ment of a vocational goal is reasonably feasible for such veteran, such veteran shall be provided counseling in accordance with an individ- unlized written plan of vocational rehabilitation developed under section 1507 (a) of this title. (Amended P.L. 96-466, § (a).) (c) In any case in which the Administrator has determined that a veteran has a serious employment handicap but the Administrator is unable to determine, in an initial evaluation pursuant to subsection (a) of this section, whether or not the achievement of a vocational goal is reasonably feasible, such veteran shall be provided with extended evaluation consisting of the services described in section 1504 (a) (1) of this title, such services under this chapter as the Administrator determines necessary to improve such voteran's potential for partici- pation in a program of services designed to achieve a vocational goal and enable such veteran to achieve maximum independence in daily living, and assistance as authorized by section 1508 of this title. (Amended P.L. 96-466, § 101 (a).) (d) The Administrator shall in all cases determine as expeditiously as possible whether the achievement of a vocational goal by a veteran is reasonably feasible. In the case of a veteran provided extended evaluation under subsection (c) of this section (including any periods of extensions under section 1505(a) of this title), the Administrator shall make such determination not later than the end of such extended evaluation or period of extension, as the case may be. In determining whether the achievement of a vocational goal is reason- ably feasible, the Administrator shall resolve any reasonable doubt in favor of determining that such achievement is reasonably feasible.
