Subject: Native Hawaiian Status Clarification bill
Dear Mary,
After we met with you, we consulted with the Federal working group
and had a conference call with the Native American/constitutional
scholar working group, and AFTER that, we met on Monday of this week
with the members of Hawaii's congressional delegation. We now have
new marching orders from them, which is to develop just one bill
rather than a two-step process. The bill would have three components
- - the first component would be what you have with some amendments,
including removing any reference to "trust responsibility" and
referring instead to a "political and legal relationship with the
United States". The second component is to authorize funding for the
organization of an interim council and elections. The third component
is a process for securing Federal recognition which I am attaching in
draft form for your review and for purposes of discussion at the
meeting tomorrow with DOI and DOJ. We do not want to have this
distributed at that meeting however, because the members of the
delegation have not yet reviewed this portion, and we want to give
them a whole bill to review - - hopefully by Monday. But I thought
this would give you a sense of the direction in which we are now
heading. I have provided a copy of this to Mark Van Norman and Karen
Sprecher-Keating with the same request that it not be distributed.
The delegation agreed to hold hearings on this measure, which we hope
to introduce next week, during the week of August 7th (the whole week)
in Hawaii, possibly in conjunction with the House Resources Committee.
