Here's some language on the tires bill. Maybe too much, but please feel
free to slash as necessary. DOT mentioned to me that they may not be
recommending any signing -- and they're dragging their feet on the
directive. Don't know how that all plays into our calculations.

Proposed Signing of H.R. 5164 (The TREAD Act)
In the coming days, Congress will forward to the President for his
signature H.R. 5164, the Tire Recall Enhancement, Accountability, and
Documentation Act (TREAD). This legislation responds to the vehicle
safety issues associated with the National Highway Traffic Safety
Administration,s (NHTSA) investigation into faulty Firestone tires that,
to date, have been linked to at least 119 deaths and over 500 injuries.
Some of H.R. 5164,s major provisions are:
1.
A New Early Warning System. The bill authorizes NHTSA to
require car manufacturers to report any information, including from their
foreign branches, that may assist in the identification of safety defects
(i.e., data on claims submitted for serious injury, customer satisfaction
campaigns, consumer advisories, recalls, etc.). Car manufacturers would
also be required to report safety defects in foreign countries with in 5
days.
2.
More Time for Free Repairs/Replacement Parts. The bill extends
to 10 years, from the current 8 years, the period of time that car
manufacturers are obligated to replace for free defective parts. And the
bill extends to 5 years, from the current 3 years, the period of time that
tire manufacturers are obligated to replace for free defective tires.
3.
Increased Penalties. The bill increases various civil penalties
for violations of the motor vehicle safety statute, including raising the
maximum penalty for a series of violations from $800,000 to $15 million.
The bill also provides a new criminal penalty of up to 15 years
imprisonment for persons who intentionally falsify and withhold
information related to safety defects that later result in deaths or
serious injury.
4.
Other New Safety Standards. The bill also requires DOT to study
and/or issue new safety regulations and standards on tire endurance,
vehicle rollovers, and child safety restraints.
Although H.R. 5164 is not whole-heartedly supported by the consumer groups
(who preferred a much stronger bill), it is the first legislation since
1974 to strengthen enforcement of the nation,s motor vehicle safety laws )
and it deserves to be accompanied by a strong public statement and/or
event from the President. Nonetheless, to address some of the consumer
groups concerns, we are working with DOT to try and develop a Presidential
directive that alleviates some of their concerns by: (1) promising to
publicly disclose of certain early warning data submitted to NHTSA; (2)
providing accelerated timelines for the development of some of the safety
regulations most important to consumer groups; and (3) dedicating some of
NHTSA,s new resources ($9 million) for these or related purposes.

Government to pay victims of terrorism
WASHINGTON (AP) * The U.S. Treasury will pay Terry
Anderson and
other American terrorist victims and their families
hundreds of millions of
dollars in legal damages owed by Iran, according to
White House and
congressional officials.
President Clinton is expected to sign legislation *
already approved by
Congress * that would pay a limited group of victims
with U.S. funds and
then make the government responsible for collecting the
claims through an
international court or negotiations with Iran, an
administration official said
Sunday, speaking on condition of anonymity.
If signed, the new law also would allow the government
to use frozen Cuban
assets to pay the families of pilots shot down off the
coast of Florida by
Cuban fighter jets in 1996.
The measure will satisfy judgments from cases brought to
trial under a 1996
law that allows American victims of terrorism in foreign
countries to sue in
U.S. courts if the State Department lists those nations
as sponsors of
terrorism.
In addition to Iran, lawsuits have been filed against
Iraq by Americans used
as human shields during the Persian Gulf War and against
Libya on behalf of
the victims of the 1988 bombing of Pan Am Flight 103.
Out of about $400 million available for the cases
against Iran, eight families
who have won lawsuits will receive more than $213
million plus interest.
The remainder would be available for cases still pending
against that nation.
The victims will be paid within 60 days of the president
signing the
legislation.
"I am elated for the families. They have finally
received the justice they
deserve," said Sen. Connie Mack, R-Fla., who sponsored
the legislation in
the Senate. "The message is clear to terrorist nations
* there is a price to
pay for killing Americans."
Mack, along with Sen. Frank Lautenberg, D-N.J., and Rep.
Bill McCollum,
R-Fla., negotiated an agreement with the administration
on the bill, which
passed the Senate this month. The House approved a
similar measure earlier
this year.
White House spokesman P.J. Crowley said the bill
supports victims and
serves the country's national security concerns.
"This compromise allows us to demonstrate that support
without
compromising diplomatic protocols that might result in
retaliations by other
governments against the United States," Crowley said.
A message left at Iran's mission to the United Nations
was not immediately
returned Sunday.
Among those benefiting from the measure would be
Anderson, a former
chief Middle East correspondent for The Associated
Press, who was held
captive in Lebanon for nearly seven years. He and his
family would receive
$41.2 million in compensatory damages within the next
several months.
Anderson won a judgment against Iran this year, which
also included an
additional $300 million in punitive damages not covered
by the new
measure.
While about $400 million in Iranian assets are frozen in
the United States,
that money is tied up in international litigation before
the Iran-United States
Claims Tribunal at The Hague, Netherlands. So the
Treasury will pay the
victims and the government will continue the litigation
and negotiations with
Iran seeking access to those funds.
The new law, however, would allow access to frozen Cuban
assets in the
United States to pay the families of the Brothers to the
Rescue pilots killed
in 1996. Those families will receive at least $49.9
million plus interest, and a
decision on another $37 million in sanctions is still
before the courts.
"It's not total justice because it cannot give us back
our loved ones," said
Maggie Khuly, sister of Armando Alejandre Jr., who was
among those
killed. "But it is a step in the right direction."

Expanded Investment in Urban and Rural Areas. The
Clinton-Gore Administration created 31 Empowerment
Zones and more than 100 Enterprise Communities,
including 50 rural ECs, that have created new jobs, new
opportunities and stronger communities. [National

Communities with the New Markets Initiative.
President Clinton,s New Markets Initiative will help
bring
economic development and renewal to communities that
have not benefited from the soaring economy by spurring
more than $22 billion in new investment in urban and

President,s New Markets Initiative in a historic
bipartisan
agreement that included extension and expansion of
Empowerment Zones, and an increase in the Low Income

Providing Incentives to Save. President Clinton signed
legislation creating Individual Development Accounts,
providing incentives for low-income families to save for

first home, higher education, or to start a new business,

accounts for over 10,000 low-income workers in 40
communities, and an additional $10 million will be
awarded in FY 2000. The President,s budget provides
$25 million for IDAs in FY 2001 and proposes to allow
low-income working families to use IDAs to save for a car

from the current list of pending bills.

After our meeting w/NHTSA this week I feel better about where they stand
on the public disclosure of info. Basically, they're willing to commit to
interpret the new law, for all practical purposes, in the same way they do
current law. Moreover, they're okay with a POTUS directive calling for
maximum disclosure of info, and they're willing to put out new legal
guidance on the disclosure of TREAD data being similar to current law.
What do you think?
Beyond this, however, is the issue of how/when to sign the bill. With the
President apparently traveling next week, it's seems less and less likely
that we'll have a chance to do anything. If that's the case, what's the
best way to proceed? Should we just do a signing statement? Or should we
still consider the directive, a POTUS statement, etc.?
Let me know what you think. I may crach the 2:30 message meeting
tomorrow, and try and get a better perspective of the broader message
context next week.

difference is that I've gone ahead and incorporated the directive-like
language we discussed with them last week. Since Sean is away, I'll go
ahead and forward this to DOT for a final comment. Otherwise, if everyone

FYI -- DOT has already signed off on their internal legal memorandum

STATEMENT BY THE PRESIDENT
Today I am pleased to sign H.R. 5164, the Transportation Recall Enhancement, Accountability,
and Documentation (TREAD) Act. The TREAD Act represents an important first step towards
strengthening our nation's motor vehicle safety laws, and its vigorous and quick implementation
will help save lives and prevent injuries.
Most importantly, the Act responds directly to some of the key shortcomings in identifying the
recent Firestone tire problem. Some of the deaths and injuries associated with these tires might
have been prevented if automobile manufacturers and their suppliers had been required to
provide the government with more timely information about potential safety defects. The Act
addresses this by: (1) specifically requiring manufacturers, within 5 days, to report to the
Secretary of Transportation any relevant safety recalls or campaigns in foreign countries; and (2)
by granting the Secretary new authority to develop an early warning system that better protects
American consumers from defective vehicles and equipment.
But let me be clear: with this powerful new authority comes the important responsibility to notify
the public, as quickly as possible, of any investigative efforts and other safety-related
information that results from the new early warning system. Thus, today I am also directing the
Secretary of Transportation to implement the information disclosure requirements of the Act in a
manner that assures maximum public availability of information.
Finally, among many other important measures, the Act also includes proposals put forth by my
Administration to provide for longer recall periods, to increase civil penalties for violations of
the motor vehicle safety laws, and to authorize more funds for investigations into defective cars
and their parts. I strongly support all of these provisions.

Today I am pleased to sign H.R. 5164, the Transportation Recall Enhancement, Accountability,
and Documentation (TREAD) Act. The TREAD Act represents an important first step towards
strengthening our nation's motor vehicle safety laws, and its vigorous and quick implementation
will help save lives and prevent injuries.
Most importantly, the Act responds directly to some of the key shortcomings in identifying the
recent Firestone tire problem. Some of the deaths and injuries associated with these tires might
have been prevented if automobile manufacturers and their suppliers had been required to
provide the government with more timely information about potential safety defects. The Act
addresses this by: (1) specifically requiring manufacturers, within 5 days, to report to the
Secretary of Transportation any relevant safety recalls or campaigns in foreign countries; and (2)
by granting the Secretary new authority to develop an early warning system that better protects
American consumers from defective vehicles and equipment.
But let me be clear: with this powerful new authority comes the important responsibility to notify
the public, as quickly as possible, of any investigative efforts and other safety-related
information that results from the new early warning system. Thus, in signing the Act, I have also
directed the Secretary of Transportation to implement the information disclosure requirements of
the Act in a manner that ensures maximum public availability of information. I understand that
he intends to treat the disclosure of information gathered under the TREAD Act in the precisely
the same manner as other related information that is collected under current law.
Finally, among many other important measures, the Act also includes proposals put forth by my
Administration to provide for longer recall periods, to increase civil penalties for violations of
the motor vehicle safety laws, and to authorize more funds for investigations into defective cars
and their parts. I strongly support all of these provisions, and I am pleased to announce that the
Secretary intends to take immediate steps to implement the life-saving provisions of the TREAD

John,
Michael asked me to respond to you conerning Joan Claybrook's letter to
you on the TREAD Act. I've been working with DOT, Nancy McFadden, and WH
Counsel to address some of the issues raised by Joan and the consumer
groups, and I think they'll be fine with our signing the bill tomorrow.
In brief, here's where we stand:
1. Secrecy. To address this issue, NHTSA has agreed to issue a legal
memorandum clarifying that they intend to interpret the TREAD Act's
disclosre provisions in the same manner as current law. In fact, thinking
that the bill might be signed sooner, NHTSA and the DOT Counsel already
signed off on such a memo last Friday. I can forward you a copy of this
memo if you like.
Additionally, to make the President's position on the public disclosure of
records abundantly clear, we've proposed that the President, in his
signing statement, include language directing the DOT Secretary to
implement the TREAD Act in a manner the ensures the maximum public
disclosure of information (see attached).
Also, 1 took the liberty of sharing both of these documents with Joan
today, and she was very, very pleased. Although she thinks the courts
will interpret the new statute's language differently, she believes
NHTSA's legal opinion and our proposed signing statement will help her and
other consumer groups make the case for broader disclosure when/if they
have to litigate the matter.
2. Deleted Approps Language. Short of helping Joan to pass new
legislation as part of the remaining approps bills, I'm afraid there is
little we can do to address this issue. Joan knows this. Her only
request to me on this front was to include some related language in our
signing statement that specifically mentions "analysis" as part of the
information to be collected by DOT, which I've done.
3. Criminal Penalties. Finally, Joan's remaining concerning (though not
specifically mentioned in this most recent letter) is the limited scope of
the criminal penalties in the TREAD Act. Again, she recognizes there is
little we can do on this now, but she thought the use of criminal
penalties deserved a mention in the signing statement. Since we did not
call for criminal penalties in our bill, and since DOT is a bit squeamish
on this issue, I thought it best to just avoid the whole issue in our
statement. But I don't think this is a big deal one way or the other.

Killer cops
The slaying of actor Anthony Dwain Lee by a black
officer is
evidence that many black cops have the same
prejudices as
their white colleagues

Nov. 1, 2000 I -- Anthony Dwain Lee told a
friend that he
feared he would be killed by the police because
he's a tall
black man. The promising and popular film and TV
actor's
worst horror became a deadly reality when he was
gunned
NO
down by an officer at a Halloween costume party
in Los
Angeles last weekend. The officer claimed he
fired on Lee
through the window of the home when Lee pointed a
gun at
him. The gun was fake. Partygoers instantly
disputed the police
version of events and said that Lee could not
have seen the
officer through the window. The killing had an
even more tragic
twist that Lee probably could not have imagined.
The officer
who shot him, Tarriel Hooper, is African-American.
Surprised? A black cop killing an unarmed black
under highly
questionable circumstances is no longer an
oddity. In the past
two years black cops have gunned down unarmed
blacks in
Chicago, Cincinnati, Atlanta, Baltimore,
Washington and Los
Angeles. The irony is that black leaders have
long clamored for
more black cops -- arguing that black officers
would be less
likely than racist white cops to brutalize other
blacks. This, of
course, is pure fiction.
A recent report by the Justice Department
found that a majority of white cops do not
think that police are prone to treat blacks
more harshly than whites. A sizable number
of black cops agreed. Worse, many black
cops are also infected with the "us vs. them"
police siege mentality, and will commit and
then attempt to cover up misconduct or
brutal acts. Despite massive public attention
and outrage over the blue code of silence,
the Justice Department survey found that 80
percent of police officers either believed the
code of silence was necessary to do good
police work or feared retaliation from other
officers or the top brass if they squealed on
bad cops.
The problem of blacks using deadly force against
other blacks
will probably get worse. Since the 1970s, the
number of black
officers has soared. There are now more blacks on
big-city
police forces than ever before, and many of them
are young,
recent recruits. Hopper had only served on the
LAPD three
years before last weekend's incident. Black
officers are often
assigned to work in low-income, black
neighborhoods. It's a
sad but undeniable fact that black and Latino
males commit
more major and violent crimes than whites, that
many police
are convinced black communities are dangerous and
risky
places where violent thugs abound and that every
encounter is
potentially life-threatening.
Criminal justice experts agree that no matter how
much training
officers get, how they react in a situation on
the streets depends
on their own apprehensions and prejudices, and
police work
tends to aggravate whatever prejudices officers
harbor. Many
black officers have the same prejudices as
whites. They do not
live in, or did not grow up in, impoverished
black
neighborhoods, and they see them as hostile and
alien places.
Many are just as jittery as white cops at the
prospect of an
armed encounter with other blacks.
But black cops killing other blacks isn't the
only problem -- it's
also the blind spot many black police officials
have toward the
shooting of unarmed blacks. This was glaringly
evident in the
aftermath of the killing of Margaret Laverne
Mitchell, a black,
middle-aged, emotionally disturbed, homeless
woman who was
slain in an altercation over a shopping cart in
May 1999 by an
LAPD officer. After demonstrations, marches and
angry
protests, LAPD's black chief, Bernard Parks,
ruled that the
officer used "bad tactics" but had acted within
department
policy in the shooting. But the L.A. Police
Commission defied
Parks and ruled the shooting "out of policy." Yet
more than a
year later, there is still no indication that
Parks has done
anything to punish the officer who shot Mitchell.
There's no reason to expect much will be
different with the
shooting of Lee, who was featured in such TV
shows and
movies as "ER" and "Liar, Liar." Given the
opportunity, Parks
would have instantly discounted Lee's fear that
he'd be the
victim of police racial profiling. While other
police departments
in California and throughout the nation have
agreed to keep
racial statistics on stops, Parks resists. He
lobbied hard in
1999 to get California Gov. Gray Davis to veto a
bill
mandating that law enforcement agencies collect
racial data to
determine if police engage in profiling blacks
and Latinos. It
took the Los Angeles City Council, fed up with
Parks'
obstructionism on the issue of racial profiling,
to finally order
the city's police chief to come up with a plan to
compile racial
stats.
None of this is any consolation to Lee. He
believed he would
be killed because he was black. He did not know
that he
would be killed by a black officer. But he was --
and that's a
warning to blacks that black cops are no answer
to the
corrosive problem of police violence.

This looks perfectly fine to me. One small observation: I recall that we
specifcally didn't refer to the May '99 meeting as WH Summit on Youth
Violence. We'd had similar WH meetings related to youth violence meetings
before (i.e., guns, drugs, school safety, etc.), so we tried to avoid
refering to any of them as a "summit." In any event, I don't think this
matters much anymore. FYI, though I'm sure you've seen this, I've
attached the one-pager we put out the day of the May '99 meeting.

Monday, May 10, 1999
Today, President Clinton will lead a strategy meeting to discuss the
problem of youth violence and develop a strategy for a national campaign
to address this problem. The meeting will include a broad cross section
of Americans, including parents and children, teachers and religious
leaders, law enforcement and government officials, gun manufacturers and
sportsmen, and representatives of the entertainment industry. The
President will announce several initiatives to address the problem of
youth violence, including a Surgeon General,s Report on Youth Violence,
gun industry support for gun legislation in five important areas, and
public and private commitments to ensure the effective implementation of
the V-Chip.
SURGEON GENERAL,S REPORT ON YOUTH VIOLENCE
Today, the President will announce that he is asking the nation's Surgeon
General, Dr. David Satcher, to prepare a landmark report on youth violence
-- the first such study on this subject in more than a decade. This
report will bring together leading experts to review and evaluate existing
research, and build on the findings of the 1972 Surgeon General Report on
Television and Violence, as well as the 1985 Surgeon General's Workshop on
Violence. Much is already known about how to reduce and prevent youth
violence, but this report will add to the nation's understanding in this
field. It also will address media that have emerged since previous
reports, such as the Internet and video games.
GUN INDUSTRY SUPPORTS LEGISLATION IN FIVE KEY AREAS
Today, leaders in the firearms industry will announce their support for
working out legislation in five areas. Specifically, the American
Shooting Sports Council (ASSC), the gun industry,s trade association in
Washington, which represents 350 firearms manufacturers and distributors
around the country, will release a statement supporting legislation in
five areas:

Closing the gun show loophole on Brady background checks. The
Treasury Department estimates that 25-50 percent of the sellers at gun
shows are unlicensed and sell guns without the benefit of a background
check purchasers. As a result, gun shows can provide a forum for illegal
firearms sales and gun trafficking. The President has proposed background
checks, based on the existing Brady law, for firearms transferred at gun
shows.

Extending the Brady Law to violent juveniles. Although violent
youth convicted in adult courts are barred from owning firearms as adults,
the same is not true for youth convicted of serious violent crimes in
juvenile court. The President has proposed permanently banning all violent
juveniles from buying guns so that they cannot purchase a gun on their
21st birthday.

Raising the age of the youth handgun ban to 21 years of age.
Federal law generally bans the possession of handguns by juveniles under
the age of 18, and prohibits federal gun dealers from selling firearms to
anyone under 21 years of age. However, it is perfectly legal for 18-20
year-olds to possess handguns or to buy them from unlicensed sellers
even though law enforcement traces more crime guns to 18- and 19-year-olds
than all other age groups. The President has proposed raising the legal
age of handgun ownership from 18 to 21 years, while maintaining current
exemptions for employment, hunting, target shooting, ranching, and
military service.

Holding adults responsible for child access to guns. Child
Access Prevention (CAP) laws promote gun safety and responsibility by
holding adults responsible if they allow children easy access to firearms
and ammunition. The President has proposed imposing felony penalties on
adults who knowingly or recklessly allow a child to have access to a gun
that is later used to cause death or injury.

Helping law enforcement to trace more firearms used in crimes.
Over the past two years, the President has expanded comprehensive crime
gun tracing to 37 cities -- helping them to trace all crime guns to their
source, to identify illegal gun markets, and to crack down on gun
traffickers. Last year, ATF initiated over 300 investigations in these
cities, which involved over 3,300 illegally trafficked firearms. The
President has proposed expanding comprehensive tracing nationwide,
starting by doubling the program to 75 cities.
MAKING THE V-CHIP WORK
The V-Chip is a device that allows parents to block television programming
they consider inappropriate for their children. President Clinton and
Vice President Gore led the successful fight for legislation that requires
that the V-Chip be installed in all new television sets sold beginning
January 1, 2000. At today's strategy session, the President will
announce two new initiatives to make sure the V-Chip becomes a useful tool
for parents.

V-Chip Task Force. To ensure that the V-Chip law is implemented
effectively, the Federal Communications Commission (FCC) will establish a
V-Chip Task Force. The Task Force will: (1) ensure that the V-Chip
requirement is enforced promptly and comprehensively; (2) promote parental
awareness about the V-Chip and work closely with organizations sharing
this goal; (3) encourage adoption of a standard label identifying
television sets that contain the V-Chip and; (4) study the use of the
V-Chip and evaluate the effectiveness of the industry's ratings system.
FCC Chairman William Kennard has appointed Commissioner Gloria Tristani to
chair the Task Force.

The V-Chip Survey and Education Project. According to a survey
released today by the Kaiser Foundation, while many parents (77%) say they
want to use the V-Chip, fewer than four out of ten parents (39%) have ever
seen information on how the system works. The Kaiser Foundation and the
Center for Media Education announced today a major national effort to
educate parents about the V-Chip TV ratings system. The educational
campaign will include free booklets for parents on how the V-chip TV
ratings system works. The free parent information will be available
through a toll-free telephone number and will be promoted through
partnerships with TV manufacturers, retailers, parents' organizations,
newspapers, and television stations.
A NATIONAL CAMPAIGN TO PREVENT YOUTH VIOLENCE
Recognizing that youth violence is a problem that government cannot solve
alone, the President, the First Lady, the Vice President and Mrs. Gore
will call for a national campaign to reduce youth violence. This campaign
will work with all sectors of our society ) the media, education groups,
parents, religious leaders, and young people to focus on this problem,
find what is working, and spread it to new communities, while also helping
to ensure that the media sends the right message to our children.
This campaign is modeled after two extremely successful efforts launched
by the Clinton Administration. Four years ago, the President asked for a
national campaign to reduce teen pregnancy. Today, under the leadership
of Governor Tom Kean, former governor of New Jersey and now the President
of Drew University, that campaign is playing an important role in reducing
teen pregnancy rates nationwide. Two years ago, the President called for
a national effort by businesses to hire people off welfare, to make sure
the welfare reform effort would work. Today, under the leadership of Eli
Segal, the Welfare to Work Partnership has grown to 10,000 companies that
have helped move more than 40,000 people from the welfare rolls to the job
rolls.

This December the National Highway Traffic Safety Administration (NHTSA)
will begin implementing a rollover rating system for automobiles.
Republicans in Congress nearly killed the measure this year, but finally
dropped their opposition in the wake of the recall of certain Firestone

Police Misconduct Report Released

WASHINGTON (AP) * Attempts to stop police brutality and misconduct
through agencies like
civilian review boards have failed, so state and federal government
action will be necessary
to stem the tide, a civil rights agency said Friday.
"The use of solicitors general, independent auditors and federal
oversight present viable
alternatives to the failed attempts that have been used in the past to
control police abuse,"
the U.S. Commission on Civil Rights said in a draft copy of its report
obtained by The
Associated Press.
The agency said the news was not all bad. "Law enforcement agencies have
made great
inroads in reducing crime and use in deadly force but such progress comes
at a cost," the
report said.
``An agonizing reality exists alongside statistics showing a decrease in
the use of deadly
force by police officers and reduction in the number of incidents of
crime in many
communities: the persistence of police misconduct."
For example, the fact that 11 people were shot down by police officers in
New York City in
1999 compared with 41 in 1990, ``does not remove the haunting specter of
impending doom
that visits ordinary, law-abiding people of color in street encounters
with police officers in
that city," the report said.
The report, "Police Practices and Civil Rights in America," is a
follow-up to the commission's
1981 report, "Who is Guarding the Guardians?" But the agency, pointing
to current problems
in cities like New York City and Los Angeles, says not much has changed.
"The problems reported twenty years ago persist with very little
meaningful change over
time," the report said. ``Instead, other problems like racial profiling
developed. Despite
repeated recommendations to make significant internal changes that would
considerably curb
police misconduct and improve police-community relations, few police
departments seem to
have resulting in continued abuse of civilians at the hands of police
officers."
Communities have tried things like civilian review boards and local
prosecution, but it hasn't
worked in all cities, the commission said. The civilian review boards are
chronically
underfunded and don't usually have authority to act on their own, local
prosecutors have to
depend on the same police they are expected to prosecute and the police
themselves are
usually uncooperative, the report said.
"Police misconduct remains largely unchecked because a majority of
officers and police
officials view any form of outside 'interference' as unnecessary and
intrusive," the report said.
The commission suggested Congress make it easier for people to sue
abusive police officers
and for the federal government to step in and investigate police
misconduct.
The federal government should also collect national statistics on racial
profiling, the agency
said. ``More can be and must be done to assure that there is no room for
misconduct by the
very people we have entrusted to protect us," the report said.

Strengthening Enforcement of Our Nation's Gun Laws
Since the beginning of my Administration, we have successfully helped turn the tide on
escalating rates of crime and gun violence in America. Our comprehensive crime-fighting
strategy of more police on the street, more federal resources than ever before to state and local
law enforcement, tough federal enforcement and common sense gun laws has led to record
declines in crime and countless lives saved. Today, America is experiencing the longest
consecutive decline in crime ever recorded, the murder rate is at a 33-year-low, gun violence is
down 35 percent since 1993, and we're getting tougher than ever on gun criminals -- federal gun
prosecutions are up 16 percent since 1992.
One of our Administration's most important accomplishments to reduce gun violence has been
the passage of the Brady Law. This vital law requires licensed gun dealers to conduct
background checks on all firearms purchasers to ensure that they are not felons, fugitives,
domestic abusers or otherwise legally prohibited from possessing guns. Since its passage in
1993, the Brady Law has been remarkably successful, preventing firearms sales to over XXXX
criminals and other restricted persons. In addition, the National Instant Criminal Background
Check System (NICS), which was implemented in November 1998 under the Brady Law to
ensure that checks are conducted accurately, quickly and efficiently, has processed over XXX
million background checks and has prevented over XXXX sales to prohibited persons since it
took effect.
NICS has served as a valuable tool for law to help keep guns out of the wrong hands. In (X
year), approximately 77 percent of NICS denials prevented illegal gun sales to persons with
criminal convictions, 15 percent to persons with domestic violence misdemeanor convictions or
restraining orders, four percent to persons with histories of drug abuse, three percent to fugitives
from justice and one percent to illegal aliens, persons dishonorably discharged, individuals with
histories of mental illness and other restricted persons. By stopping easy access to over-the-
counter sales for criminals and other potentially dangerous individuals, NICS has prevented
countless gun-related crimes and tragedies.
Through the NICS and numerous other initiatives at all levels of government, we have made
tremendous progress in reducing gun violence. However, despite our success, we still lose
30,000 American lives -- including 10 children every day -- to gunfire. That is why it is
imperative that push on every front to further reduce gun-related crime and violence in our
country.

One important way in which we can help strengthen law enforcement's hand against gun
criminals is to make the NICS a more powerful tool against felons and other prohibited
purchasers who attempt to buy guns. Now that NICS has completed it's second successful year
of operation, technological progress can help take this success even further. In addition to
fulfilling its statutory goal of preventing illegal gun sales, NICS also provides immediate notice
to state and local law enforcement of denied firearms sales to fugitives and persons under
restraining orders, and the FBI and the ATF ensure that all denials are investigated at the Federal
level. However, the current system does not have the capacity to transmit information to the
same authorities on denials to other categories of felons and restricted persons. As NICS enters
its third year of operation, we should expanding its capabilities and the information it provides to
state and local law enforcement on NICS denials in their communities.
Several states, including Illinois and Oregon, currently run state notification systems that provide
local law enforcement agencies with information (in a timely manner) on individuals denied
firearms sales through background checks. This gives valuable information to state and local
law enforcement-- who are often the most familiar with offenders in their communities - which
they can use to assess potential public safety threats posed by local individuals who have
illegally attempted to purchase guns and to improve coordination with federal law enforcement
agencies. We could improve our federal instant background check system by providing similar
information to state and local law enforcement immediately after the NICS denies a firearms
sale. Therefore, I direct you to:
(1) strengthen the NICS by developing a National Instant Notification (NIN) system to ensure
that the appropriate federal, state and local law enforcement agencies have (instant) access to
information on criminals and other prohibited persons who fail NICS background checks
during illegal attempts to purchase firearms in their communities; and
(2) provide technical assistance to states that run their own background check systems to help
them develop State-run systems that notify law enforcement of rejected firearms purchases.

President Clinton: Commemorating and Strengthening the Brady Law
November 29, 2000
Today, with Jim and Sarah Brady at his side, President Clinton will
commemorate the signing of the Brady Law seven years ago and announce two
new efforts to strengthen enforcement of this landmark legislation. The
President will announce that, to date, criminal background checks
authorized by the Brady Law have blocked the sale of firearms to over
600,000 felons, fugitives, or domestic abusers. He will also make
enforcement of the Brady Law even more effective by: (1) calling for a new
system to promptly notify state and local law enforcement officials of
prohibited purchasers that have tried to illegally buy guns in their
communities; and (2) naming 12 new cities to participate in the
Administration,s initiative to crackdown on illegal gun trafficking by
tracing all crime guns to their source.

Following up on attempted illegal gun sales. Although the FBI

with state and local law enforcement to immediately apprehend dangerous
fugitives and armed career criminals identified by the NICS, information
on every blocked sale doesn,t always make it to the local law enforcement
official where the prohibited purchaser resides. Today, the President
directed the Treasury Secretary and Attorney General to develop such a
system within the next 60 days.

MD Erbach called. She indicated that Sylvia wanted to check with Lew.
She also asked why we did not object to early transmittal of the report.
I responded that we were ok with it because transmittal wasn't harmful.
However, I indicated that we would not be troubled if the decision were
made NOT to transmit the report.
If we don't have an answer today, I suggest you inquire at tomorrow's
senior staff meeting. Agency comments are due today, and, if we are going
to pull the plug on the Strategy, we should do so earlier rather than
later. Furthermore, ONDCP staff have been bugging Ron on a daily basis.

ONDCP Annual Drug Strategy
Issue. Should the Administration (ONDCP) release the required annual
Anti-Drug Abuse Strategy in the next couple of weeks (prior to McCaffrey's
departure on January 6).
Background. By law, the annual drug strategy is to be transmitted to
Congress by February 1. However, recent practice is for the Strategy to
be transmitted at about the same time the Budget is transmitted because
the Strategy contains Presidential budget requests for anti-drug abuse
accounts. That means that it is usually transmitted after the statutory
deadline, with little Congressional complaint. This past year, the
Strategy was transmitted in late February.
General McCaffrey is anxious to transmit the latest Strategy in late
December, earlier than it has ever been transmitted. ONDCP has drafted
the Strategy, and it is currently in inter-agency circulation. Due date
for agency comments is December 19. Generally, the Strategy is "plain
vanilla" it is essentially a recitation of current policy The few
problems in the current draft will likely be ironed out amicably with
ONDCP staff (e.g., the draft states that more funds will be needed for
"Plan Colombia," but we are striking the reference). The only oddity of
this year's draft Strategy is that ONDCP is bifurcating the discussion of
drug funding and drug use prevalence within the 1993-2001 period. Instead
of discussing the period as a seamless whole, ONDCP discusses 1993-1996
and then 1997-2001. 1996 is when McCaffrey was appointed drug czar.
Funding increases and drug use prevalence decreases were more pronounced
in the 1997-2001 period (when McCaffrey was on the beat) than in the
earlier 1993-1996 period.
Conclusion. We don't have a problem with an early release, but wanted to
check this with you. We understand that McCaffrey has mentioned this to
Podesta, but has not received a clear response.
