I would not bother you with this if I did not think we are at a critical juncture with the tobacco settlement. Indeed, I believe we can let it get away in the next few days unless something is done. First, I hope you understand the importance of your playing a lead role in dealing with the Republicans on this issue. Gingrich, Lott, Bliley and others have indicated to us that they will not deal with anyone else from the White House. The immediate problems are these: 1. Bliley continues to say he has heard nothing from the White House and he is doing nothing to move the ball forward. We really need for you to call him and tell him the White House will be glad to work on a bill with him. His staff tells us this is the only way he is going to make a move. 2. Gingrich has turned against the whole deal. He also needs a call to be assured that the President will not hang him out to dry. 3. There will be a House Judiciary Committee Hearing Thursday (2/5) on the civil liability issue - the only thing the industry gets out of the deal. We have just learned that David Ogden from the Justice Department will testify. If he comes out against any civil liability protections for the industry, or otherwise suggests that the civil liability protections are not an essential part of comprehensive legislation, the Republicans will, in our opinion, run for good.
