The changes to AFDC generally take effect on July 1, 1997. States have the option, however, to accelerate the effective date by submitting a plan outlining a family assistance program. States who have obtained waivers under current law (usually for demonstration projects) can (1) either delay the effective date until the expiration of the waiver or (2) opt to terminate the waiver and adopt a new family assistance program under the new Act. The bottom line is that a State may adopt a new family assistance program as soon as the law is signed. HHS and the Social Security Administration have 90 days from enactment to submit to Congress a legislative proposal with amendments "as are necessary to bring the law into conformity with the policy embodied" in the new Act. Issues raised by Diana London I'll try to address Diana's questions #2-4 from a legal perspective. Will welfare offices consider national service as satisfying work participation requirements? They should. The Act includes in its definition of "work activities" the following: "community service programs". States have a financial interest in increasing the number of recipients engaging in work activities, so I would expect an increased interest in national service from a participant angle. Is the DVSA income disregard rule still good law? Yes. The DVSA states that "notwithstanding any other provision of law except as may be provided expressly in limitation of [the DVSA provision], payments to volunteers under this Act shall not in any way reduce Page 1 or eliminate the level of or eligibility for assistance or services any such volunteers may be receiving under any governmental program [as long as the payments are less than the relevant minimum wage]." However, ensuring that welfare offices continue to apply the DVSA income disregard presents a challenge. You might consider strategies including (1) requesting that HHS propose some language in its expected legislative proposal; (2) requesting the HHS include language in any waivers under the current Act; (3) communicating directly with State agencies or their designees; (4) communicating directly with volunteers; (5) involving Corporation State offices; (6) involving State Commissions. Does the new law affect the DVSA provision that allows VISTAs to maintain eligibility for governmental assistance regardless of their participation in employment and training programs during their term of service? It should not. The cited DVSA provision includes the sentence: "Notwithstanding any other provision of law", indicating that VISTAs will be continue to be excused from such training and employment. Given the wholesale changes in administration of these programs, however, it is likely that individual VISTAs may face adverse action based on their alleged failure to work or participate in workfare. We should consider a strategy vis a vis the State welfare agencies as well as USDA for Food Stamps to prevent this. I look forward to Friday's meeting. In North Central Cluster, states like Wisconsin are already positioned to pass a state Welfare reform measure very soon (they have been working on this anticipating national/congressional action). For example, in Wisconsin's current welfare reform legislation under consideration right now, National service (Ameri Corps specifically) doesn't fit within the definitions the bill uses, however the bill does identify "community service" as a tool to assist welfare reform efforts. Do we need to survey the land first, and find out which state legislatures are on the fast track, what the various pieces of legislation say, and do they allow room for National Service programs? It's all up to the states now and they'll be struggling to figure out how to help get these folks off the rolls and i nto jobs without hurting kids. Service should become a major tool. I suggested to Dana that he do a piece in the next newsletter on the programs we have already at work. But we should put our heads together on what to do next. It may be t/a should put out an issue paper on this to go to the states. rather than having a meeting - let's do a little e-mail brainstorming. From: London, Diana Sent: Friday, August 02, 1996 4:01 PM To: Jospin, Debbie; Russell, Terry Cc: Scheibel, James A.; Waldman, Steven Subject: Welfare Reform With the advent of the new welfare reform legislation, I think we need to consider a number of policy/legal issues which are likely to be raised: 1) Should AmeriCorps*VISTA, as well as other Corp programs, devote more program resources to projects which are focused on providing employment opportunities for welfare recipients? We already have a number of such projects operating, but should we plan on doing more? The focus here is on the project, not the enrollment of welfare recipients as national service participants. 2) However, will welfare offices, based on law or potential regulations, consider national service as a suitable "employment/training" opportunity which could satisfy the requirements of the new legislation? If so, what will be the Corporation's "stance" on that? 3) For programs covered by AFDC "income disregard" provisions (VISTA and Senior Corps), will those provisions still apply? If so, we need to work with HHS to incorporate those disregard provisions in their new regulations similar to those which exist currently. 4) VISTA has an additonal legal provision which allows volunteers to maintain public assistance benefits without having to "register for, seek, or accept employment or training" during their service. Will the new law affect that in any way? I know that the Policy Group has been temporarily disbanded, but I think we need to meet in the near future to consider some of these issues. Pls let me know. Because many people couldn't make it, we are rescheduling. Await an e-mail on a new time for the forum planning session--- it will be early morning next week sometime between 8:30 am and 10:30am. For our next weekly forum meeting, everyone will be asked to 1) present a progress report on their forum 2) bring draft objectives for their forum 3) bring a draft timeline for their forum --it's okay if the actual adates are tentative, the tasks to be accomplished are important. 4) suggest dates that are good for afterschool and mentoring forum. (Oct. 23-25 won't work for the afterschool forum since it is the swearing in ceremony for the AmeriCorps programs.)
