B. Summaries of FBI Reports for Non-Judicial Nominees
Full FBI reports provided for judicial nominees, U.S.
Attorneys and U.S. Marshals. With exceptions listed below,
summaries of FBI reports would be provided for other non-
judicial nominees. Exceptions are the Attorney General,
Director of the Federal Bureau of Investigation and the
Director of the Drug Enforcement Administration. In
addition, the Chairman and Ranking Minority member shall be
provided with full FBI reports for any other non-judicial
nominee when necessary to the confirmation process.
c. Access to FBI Reports
Access to FBI files shall be avilable to staff listed and
described in the 1989 agreement in accord with the terms and
conditions of that agreement. In addition, the Committee
will designate one person trained by Senate Security with
custodial responsibility over FBI files to ensure their
confidentiality. This responsibility includes maintaining
logs listing all persons who receive access to the file
(including date and time), or who are briefed on the
contents of the file. Logs will contain a notification
stating that in accepting access to the file the recipient
agrees to protect document confidentiality.
Prior written clearance from the Department of Justice must
be obtained for all staff with access to FBI files. The FBI
will conduct full field background investigations of staff
with access to FBI files.
Senate Judiciary Committee will inform White House Counsel
in writing of current roster and subsequent changes of staff
with access to reports.

Notes and Memoranda Derived from Files
Photocopying or verbatim reproduction of FBI reports is
prohibited.
Notes and memoranda on FBI files are secured in a manner
identical to FBI reports. At the conclusion of Senate
action on nomination, FBI files are returned to the
Department of Justice, and notes and memoranda derived from
FBI reports shall be destroyed or continued to be secured in
a manner identical to FBI files.
E. Unauthorized Release of Information From FBI Reports
Staff members with access to FBI files are informed in
writing at time of employment and at departure from the
staff that information from FBI files is to be kept
confidential and that unauthorized release of information
from FBI files is cause of summary dismissal and risk of
civil and criminal penalties.
F. Review
Senators, committee staff and representatives from the
Department of Justice and White House Counsel will
periodically review, either annually or as need arises,

Jon M. Huntsman, Jr. is Senior Vice President and General Manager of the
International Division of Huntsman Chemical Corporation, the largest privately-held
chemical company in the United States. In this capacity, Mr. Huntsman leads Huntsman's
efforts in negotiating joint ventures and licensing technology throughout the world.
Huntsman Chemical Corporation now has nineteen sites around the globe, manufacturing
over 3 billion pounds of petrochemical products each year and employing over 2000 people.
Huntsman's most recent expansions include plants in Taiwan, Thailand. Korea and the
Soviet Union, with approvals now to proceed with plants in Indonesia and India.
In past years, Mr. Huntsman served as Vice President of International Business and
as a member of the Board of Directors. Mr. Huntsman also has served as Vice President
and a member of the Board of Directors of Huntsman's Asian subsidiary, Huntsman Pacific
Chemical Corporation, which is located in Taiwan, where he has spent roughly three years
of his life.
From February 1989 to July 1991, Mr. Huntsman served in the Bush Administration
as Deputy Assistant Secretary of Commerce in the International Trade Administration, and
later as Deputy Assistant Secretary of Commerce for East Asian and Pacific Affairs. He
was the senior official responsible for America's commercial relations with the thirty-some
countries of the Pacific Rim Region. He represented the United States in trade and
investment negotiations and directed U.S. government programs to facilitate the expansion
of U.S. business in Asia. In this position, Mr. Huntsman chaired working groups of the U.S.-
China Joint Commission on Commerce and Trade. He was also the Executive Secretary of
the U.S.-Thailand Joint Commercial Commission, Chairman of the U.S.-Mongolia Trade
Facilitation Working Group and Executive Secretary of the U.S. Pacific Island Joint
Commercial Commission.
Mr. Huntsman's other public service experiences have included serving as an intern
to a U.S. Senator, as a Special Assistant to the Chairman of the Republican National
Committee and on the White House Staff as a Staff Assistant to the President of the United
States. Mr. Huntsman previously worked as State Director for Utab, Reagan-Bush 1984 and
more recently as a fund-raiser for the Bush-Quayle 1988 campaign. Mr. Huntsman has been
a national delegate to two Republican National Conventions Dallas in 1984 and New
Orleans in 1988.
Mr. Huntsman serves as a Director of the Business Industry Political Action
Committee in Washington, D.C., an Associate Director of the Huntsman Center for Global
Competition at the Wharton School of Business at the University of Pennsylvania, and as
a Director of the University of Utah/Brigham Young University International Business
Program. He is a member of the Bush/Quayle '92 National Finance Committee and listed
in Who's Who in Government Service and Who's Who in America. He also serves on the
Board of the Utah Symphony, and as a Director of the Armand Hammer United World
College, the Salt Lake City Area Red Cross and the Salt Lake Committee on Foreign
Relations.
A graduate of the University of Pennsylvania, Mr. Huntsman is married to the former
Mary Katherine Cooper. They have four children.

TALKING POINTS
ON THE PERSONNEL FREEZE
The President's FY 1993 Budget proposes to freeze Federal
domestic employment for 1993 at exactly 1992 levels. This
means that the total number of FTE's (Full-Time Equivalents)
in domestic agencies in FY 1993 will be the same as that in
FY 1992.
This freeze would apply to the aggregate employment of all
agencies in the Executive Branch (except FDIC and RTC).
Within this aggregate freeze, some agencies would be allowed
to expand employment while other would have to cut back from
1992 levels.
Each agency head has been provided specific employment
limits for 1992 and 1993 so that increases and decreases in
employment levels can be accomplished in an orderly manner.
Each agency head has already agreed to these limits as part
of the budget process.
Including reductions of over 40,000 civilian employees of
the Department of Defense (DoD) and over 122,000 DoD
uniformed personnel, the President's Budget would decrease
Executive Branch employment by over 162,000 -- or 4% -- in
1993.

THE BUDGET DEFICIT

The President has been tough on Federal spending.
-- In his proposed FY 1991 Budget, his first full budget, total
spending grew by 3.0 percent.
-- In his proposed FY 1992 Budget, total spending grew by only 2.6
percent.
-- In his proposed FY 1993 Budget, total spending grows by only 2.8
percent, and domestic discretionary spending is frozen.

In each of these three years, the growth in spending in the President's
proposed Budget has been below the rate of inflation.
O
Although the budget deficit has grown since 1989, this is due to: 1)
Congressional action to increase spending above the levels recommended
by the President; 2) growth in deposit insurance outlays (and the
failure to dispose of these assets as quickly as was hoped) ; 3) the
continuing growth in entitlements; 4) lower than expected revenues due
to the recession; and 5) the growth in interest payments.

The President's FY 1993 Budget proposes to reduce the deficit from $399
billion in 1992 to $352 in 1993.
o
Only the President has proposed to attack each component of the deficit,
through:
(1) A freeze on domestic discretionary spending. This freeze, which
keeps new domestic discretionary appropriations for 1993 at exactly
1992 levels, will reduce spending below the limits permitted under
the summit agreement.
(2) Complete elimination of 246 programs where funding is not
sufficiently justified.
(3) Specific, identified cuts in defense. An orderly and carefully-
planned further reduction in defense spending of $50 billion by
1997 will make the total real defense cut 29 percent since 1989.
(4) Specific, identified reforms of entitlement programs. These
reforms will reduce entitlement programs by nearly $35 billion by
1997 -- nearly $73 billion including reform of the deposit
insurance and pension guarantee programs.
(5) New caps on the future growth of these entitlements and on the
cumulative subsidies of hidden liabilities. (No one in Congress
has yet proposed such a cap.)
(6) A set of policies that promote economic growth. Congress should
enact these policies promptly.

The President's proposals will, if enacted, reduce deficits as a
percent of GDP from 5.6 percent in 1993 to 2.3 percent by 1997.

The article suggests that the State of Ohio has received less
than its share of appointments in the Bush administration. This
contention is largely promoted by Republican Congressman John

Kasich of Ohio, who is quoted extensively throughout the article.
While it is true that no current or past member of your cabinet
hails from Ohio, current data indicates that Ohio has been very
well represented in the Bush administration.
Kasich is simply wrong in his assertion that the White House only
responds in an election year. I, and members of my staff, have
met frequently with Ohio GOP leaders regarding Presidential
appointments over the past three years. Keith McNamara and Bob
Bennett were frequent visitors during my days in Presidential
Personnel.

CFCs and international environmental policies
On Friday you asked me to write down the bullet points I
ticked off orally concerning how the U.S. has been a leader in
responsibly addressing the CFC/ozone depletion problem. What
follows is the text of a one-pager I sent to Senator Wallop on
Thursday for his use in the Senate Floor debate which summarizes
these points:
THE BUSH RECORD ON INTERNATIONAL ENVIRONMENTAL ISSUES: CFCs
*
President Bush was one of the first world leaders to endorse
the total phaseout of CFCs by the year 2000.
*
The U.S. was the first nation to actually legislate (in
President Bush's Clean Air Act) to complete phaseout of CFCs.
*
The U.S. was the first nation to actually pay in to the
Montreal Protocol Fund to help the LDCs meet their obligations.
*
The U.S. has already reduced CFC emissions by 42% just since
1986
-- far ahead of the internationally required schedule.
*
The U.S. enacted (in the FY 1990 Reconciliation bill, fall
of 1989), a tax on CFC production of over $1.00 a pound. No
other country has done this. That -- a Bush proposal -- is what
has put us ahead of schedule on the phaseout.
*
It is also critical to get other countries to sign up to the
phase out under the Montreal protocol. For example, India --
signed up.

Europe is meeting its initial obligations to phase out under
the Protocols by phasing out aerosols -- something the U.S. did
in 1978.

The Administration, in light of the science, is already
considering speeding up the Montreal Protocol time schedule. But

has already done more than anyone else.

Administration Statement re: FBI Reports
We are very pleased that the Judiciary Committee has agreed to
make substantial improvements that will help protect the
confidentiality of FBI background reports on nominees before the
Senate for confirmation. These improvements were shown to be
necessary by the unauthorized disclosure of material from the
confidential FBI reports on Judge Clarence Thomas' nomination as
well as from Anita Hill's confidential statement to the
Committee. The Committee agreed to the changes as a result of
the President's refusal to continue providing raw FBI background
reports to the Senate Judiciary Committee in the aftermath of the
disclosures.
We are hopeful that by agreeing to these improvements in the
procedures for handling and protection of these FBI background
reports on nominees, the Committee can avoid a repeat of the leak
of confidential FBI information during Judge Thomas's Senate
confirmation process, which created such a public outcry last
fall.

Improvements
--Committee will designate one custodian trained by Senate
Security with responsibility for maintaining the confidentiality

--Logs will be maintained on those who review or are briefed on
the reports, including date and time.
--Logs will notify those with access that by accepting access
they agree to maintain the confidentiality of the rpeorts.
--Xeroxing or reproduction of FBI reports prohibited.
--FBI background summary reports only (not full FBI report) will
be provided on executive branch appointees, except the Attorney
General, the FBI and DEA directors, and U.S. Attorneys and
Marshals.

U.S. Senator Jack Danforth (R-MO) welcomed announcement today of
measures to protect the confidentiality of FBI reports on nominees
who are before the Senate for confirmation.
Danforth, the Senate sponsor of Justice Clarence Thomas'
nomination to the Supreme Court, stated:
"The leaking of material from FBI reports and Anita Hill's
confidential statement was a gross breach of trust. This breach of
trust inflicted unimaginable pain on Justice Thomas and his family.
It damaged the Senate in the eyes of the nation. It embarrassed our
system of government in full view of people around the world. The
Senate Special Counsel is investigating this leak.
"To strengthen the integrity of the nominating process and
hopefully spare future nomineas from such 'hit jobs,' the President
insisted on changes in the way FBI material is handled in the
Senate. It is my understanding that new Judiciary Committee
procodures will include the maintenance of logs to record who is
briefed on FBI reports or reviews these reports, a prohibition on
photocopying, and other steps.
"These are constructive changes, and I commend the
Administration, Chairman Biden and Senator Thurmond for reaching this
understanding."

WASHINGTON (AP) The White House has dropped its refusal to SAVE F31
reports on judicial nominees to the Senate Judiciary Committee - is rule
IMPOSED after Supreme Court Justice Clarence Thomas' bitter confirmation

Sen. Strom Thurmand. R-S.C., said the two sides were close to an
agreement to resolve the dispute, which fisred up Following White House
charges that FBI reports containing Anita Hill's allegations of sexual
harassment against incmas Mad ben leaked to the press.
Thurmond gave no details of the dear 21 making the announcement at a
committee meeting.
But officials familiar with the talks said an agreement in principle
had been reached to resume the old procedures under which FBI reports were
given to the committee.
The agreement was expected to be signed Friday by White House Counsel
C. Boyden Gray and ranking committee members, said the officials, who spoke
on the condition of anonymity.
As part of the agreement. the Judiciary Committee has accepted several
White House recommendations for tichtening procecures for keeping track of
who reads the FRI reports, said the officials.
The White House will furnish FBI reports of background investigations
on 36 nominees pending before the panel and future nominations for the
lifetime posts. FBI reports will also be forwarded to the panel for U.S.
attorney and U.S. marshal nominees.
But the panel will receive only summaries of FBI background reports on
other officials, such as assistant attorneys general, officials said.
President Bush announced last fall that he would withhold raw FBI
reports on judicial nominees and said that in the future the panel would
receive only summaries of the FRI reports, similar to the procedure
followed for nominations under the jurisdiction of other Senate committees.
The disclosure of Hill's sexual harassment charges propelled the Senate
into holding an extraordinary set of weekend hearings.
Thomas was confirmed on a 52-48 vote and the fight has left a bitter
aftertaste in the Senate. A special counsel is currently investigating the
alleged leak and has subpoenaed the two reporters who broke the story.
Nina Totenberg of National Public Radio and Timothy Phelps of Newsday
have 3R10 through attorneys they will refuse to identify their sources.
Bush's refusal to give the panel FBI reports has stalled processing of
nominations as time grows short in this election year for the president to
put more Republicans on the federal bench. There are 88 vacancies that Bush
nas not moved to fill in addition to 42 nominees pending in committee.
Last fall, the committee's eight Democrats and six Republicans
unanimously passed a resolution asking Busn to change his mind.
The resolution said that without the FBI reports, the panel's
investigation of nominees would take much longer. Sen. Joseph R. Bioen Jr.,
D-Del., had threatened not to Move any nominees without background checks.

SENATE JUDICIARY COMMITTEE AND WHITE HOUSE COUNSEL
FEBRUARY 7, 1992
1.
Reinstate the 1989 agreement, as described in the
exchange of letters between Counsel to the President,
C. Boyden Gray, and Chairman of the Senate Judiciary
Committee, Joseph R. Biden, and Ranking Minority
Member, Strom Thurmond, dated April 12, 1989, and
April 24, 1989.
2. Add the following clarifications not detailed in the
1989 agreement:
A.
Physical Control of Files
Document control experts from Senate Security
periodically review the effectiveness of
procedures used to maintain physical custody of
files.
B.
FBI Reports and Summaries
Full FBI reports provided for judicial nominees, U.S.
Attorneys and U.S. Marshals. With exceptions listed
below, summaries of FBI reports would be provided for
other non-judicial nominees. Exceptions are the
Attorney General, Director of the Federal Bureau of
Investigation and the Director of the Drug Enforcement
Administration. In addition, the Chairman and Ranking
Minority member shall be provided with full FBI reports
for any other non-judicial nominee when necessary to
the confirmation process.

Access to FBI Reports
Access to FBI files shall be available to staff listed
and described in the 1989 agreement in accord with the
terms and conditions of that agreement. In addition,
the Committee will designate one person trained by
Senate Security with custodial responsibility over FBI
files to ensure their confidentiality. This
responsibility includes maintaining logs listing all
persons who receive access to the file (including date
and time), or who are briefed on the contents of the
file. Logs will contain a notification stating that in
accepting access to the file the recipient agrees to
protect document confidentiality.
Prior written clearance from the Department of Justice
must be obtained for all staff with access to FBI
files. The FBI will conduct full field background
investigations of staff with access to FBI files.
Senate Judiciary Committee will inform White House
Counsel in writing of current roster and subsequent
changes of staff with access to reports.
D. Prohibiting Reproduction of FBI Files; Provisions for
Notes and Memoranda Derived from Files
prohibited. Photocopying or verbatim reproduction of FBI reports is
Notes and memoranda on FBI files are secured in a
manner identical to FBI reports. At the conclusion of
Senate action on nomination, FBI files are returned to
the Department of Justice, and notes and memoranda
derived from FBI reports shall be destroyed or
continued to be secured in a manner identical to FBI

Unauthorized Release of Information From FBI Reports
Staff members with access to FBI files are informed in
writing at time of employment and at departure from the
staff that information from FBI files is to be kept
confidential and that unauthorized release of
information from FBI files is cause of summary
dismissal and risk of civil and criminal penalties.
F. Review
Senators, committee staff and representatives from the
Department of Justice and White House Counsel will
periodically review, either annually or as need arises,
procedures for access to FBI files.

Thank you for your letter of February 7, 1992, indicating
that you both have introduced H.R. 4200, the Economic Growth and
Job Creation Act of 1992. It is my understanding that H.R. 4200
contains a modified version of Title I of H.R. 4150 (the
President's Economic Growth Act of 1992), as well as selective
provisions from other titles of H.R. 4150, and has been referred
to five Committees of the House. It is my further understanding
that you have changed the President's proposals by modifying
Title I of H.R. 4150 with respect to the treatment of capital
gains under the minimum tax. In your letter, you suggest that
H.R. 4200 be used as the starting point for the Ways and Means
Committee markup scheduled tomorrow.
As you know, in my letter of February 6, I requested that all
three revenue titles contained in the President's economic growth
package -- Title I, Title II, and Title III of H.R. 4150 -- be
introduced as a separate bill as a starting point for the
Committee's markup. As I have consistently stated, the
suggestion that there may be two tax bills this year implementing
the President's economic growth package and budget proposals is
totally unrealistic. Given the legislative commitments of the
Ways and Means Committee with respect to trade and comprehensive
health care reform, I remain convinced that there will be only
one such tax bill this year -- written by March 20 as the
President has demanded.

For these reasons, I find your introduction of H.R. 4200,
containing only a modified version of Title I and other selective
provisions of H.R. 4150, both surprising and regrettable. It is
surprising because the first modifications to the President's
revenue proposals have come from Members of his own party in the
House, and invite selective modification and cherry-picking from
others in the Congress. It is particularly regrettable because
by failing to introduce Titles II and III, you are asking
millions of hard-working, middle-class Americans to wait until
some indefinite time in the future for a tax cut that they
desperately need and richly deserve.
In addition, such selectivity among the revenue provisions of
the President's program suggests postponing consideration not
only of much-needed tax relief for the middle class, but also of
such other important revenue initiatives as the permanent
extension of the research and development credit, the
deductibility of student loan interest and the repeal of luxury
excise taxes. Along with many Members on both sides of the
aisle, I believe that these and all other revenue provisions
contained in the President's revenue package should be considered
contemporaneously, not selectively, as you suggest.
After consulting with my Leadership, it is my understanding
that Majority Leader Gephardt has introduced today H.R. 4210,
containing the first three titles of H.R. 4150 in a separate
bill, that was referred exclusively to the Committee on Ways and
Means. It is my intention to use H.R. 4210 as the starting point
for the Ways and Means Committee markup tomorrow. H.R. 4210 puts
all aspects of the President's revenue proposals officially
before the Committee. This new bill will, of course, be open to
amendment, and could be amended by H.R. 4200 if you choose and a
majority of the Committee agrees. Of course, in such an event,
the Committee would have to consider the implications of deleting
the proposed middle-class tax cut and other important revenue
proposals contained in Title II and Title III of the President's
program.
As I indicated at the Ways and Means Committee hearings last
week and in my previous letter to both of you, we have every
intention of trying to meet the President's March 20 deadline. I
look forward to reporting the President's revenue proposals to
the House as expeditiously as possible.
