This draft Statement of Administration Policy was prepared by the
Legislative Reference Division (Jones), in consultation with the
Department of Justice (Burton, Office of Legislative Affairs) and
TCJ (Sloan). It is consistent with a June 8, 1989, report from
the Department of Justice to the House Judiciary Committee on
H.R. 1048, the counterpart House bill, and with a June 23, 1989,
SAP on that bill that was sent to the House.
As reported by the Senate Judiciary Committee, key provisions of
S. 419 would:
o Require the Justice Department to acquire, for calendar years
1990 through 1995, data on the incidence of criminal acts that
manifest prejudice based on race, religion sexual preference,
or ethnicity;
Specify that the offenses to be included in the data
collection effort include, where appropriate, murder,
non-negligent manslaughter, forcible rape, aggravated assault,
simple assault, intimidation, arson, and destruction or
vandalism of property;
Require that any data acquired be used solely for research and
statistical purposes;
Require Justice to publish an annual summary of the data
acquired; and
Authorize appropriations of "such sums as may be necessary"
for each fiscal year through FY 1994 to carry out the
provisions of the bill.
