The Probidem Washington, D.C., January 17, 1903. The President Sir: and should We respectfully pray you to request the Hon- orable, The Secretary of the Interior, to withdraw his approval of a certain contract executed yesterday by T.M.Buffington, Prin- cipal Chief of the Cherokee Nation, with certain attorneys, author- izing suit in the Court of Claims in the case now pending in Con- gress, and be fore you, by reference to the Department of Justice on December 22, 1902, (Eastern Cherokee Case, Congressional 10,386) The reason of this request is that the Secretary's action will deprive us of our legal and rightful remedy in Congress and bef ore you by forcing us to intervene in the Courts. The faccts recited below will convince you of the absolute justice of this request and of its vital importance to us. to Under the Cherokee Agreement ratified by Congress March 3, 1893, there is due the Eastern Cherokees $1,111,284.70 with interest. The Cherokee Nation by gross neglect allowed this award to slum- ber five years. Congress dismantled the Cherokee Nation and abolished its author - ity June 28, 1898, In February, 1900, the Eastern Cherokees, by treaty and by com- mon law right organized by repeated well advertised conventions unanimous in action, and took steps for self representation
