Sir:
I am in receipt by your reference with request for report in
duplicate and return of papers, of a communitation from the Presi-
dent enclosing a letter addressed to him, from Rev. J.Phelan, of
Sibley, Iowa, in which complaint is made that the loss of the land
embraced in the homestead entry made by him in Hyde County, South
Dakota, will work hardship.
In reply I have the honor to inform you that the records of
this office show that Phelan, on October 12,1901, made homestead
entry No.16702, for SEZ SW2, SWz SEZ Sec.10, NE+ NW2 and NW> NEZ
Sec.15, T.109 N., R.71 W., at the Huron, South Dakota land office.
On September 8,1903, one Witcher filed contest against said
entry charging abandonment &C. Hearing was had December 16, 1903,
and when Witcher rested a demurrer was filed to the evidence, and
which demurrer was sustained.
