    "ocrText": "-3=\nabove quotation from said resolution.\nWith these conferences and that determination vividly\nin mind, and in view of the letter and spirit of the resulting\nlegislation, I feel constrained to regard it as mandatory that\nthe said payment shall be made \"to the Indians entitled thereto\nwithout awaiting their action\" upon their proposed allotment and\ncession, and thereby free the negotiations, as the law clearly\nintends, from the unjust and coercive influence of withholding such\npayment until after the proposition has been submitted to the\nIndians.\nFurthermore, the law provides that -\n\"in addition to the allotments in severalty to the Uintah and\nWhite River Utes of the Uintah Indian Reservation in the State of\nUtah, the Secretary of the Interior shall, before any of said\nlands are opened to disposition under any public land law, select\nand set apart for the use of the common Indians of that reserva-\ntion, such an amount of non-iirigable grazing lands therein at\none or more places as will subserve the reasonable requirements\nof said Indians for the grazing of live stock.\nUntil, therefore, the lands in the reservation are\nsurveyed, the allotments cannot be made, nor can the grazing\nlands \"for the use in common of the Indians\" be selected. It is\nprovided that such allotments and selections shall be made \"be-\nfore any of said lands are opened to disposition under any public\nland law.\"\nCongress having failed to make provision for the cost\nof making such allotments and survey in the act authorizing the\nnegotiations, on the sixth of June last, I submitted to the Senate"
