1. Inviting attertion to the opinion of the Judge Advocate
General of the Army, May 6, 1918, to wit:
"PAT AND ALLOWANCES 1 B 1: orfice 111 B 5: Nocessity of
Accoptance of office.
Since appointiments in the National Guard drafted into tho Federal
service are made by selection, rathor than according to soniority, no
officer is ontitled to the pay and allowences of an advanced grade therein
until he de actually appointed thoreto and accepts his comission, oithor
expressly or impliedly, by entering upon the duties of tho position. It is
not nocessary that the accoptance of the now office be actually
it may be indicated by entoring upon the duties or the office. I have

perforning the duties of the office ever since appointment
