CABINET MEETING, JUNE 7, 1946
THE PRESIDENT
Has been studying Case bill carefully. Asked for viewpoints
of Cabinet.
CLARK
Bill can be divided in two parts. 1st 5 sections deal with
arbitration and concilation - last part labor policy and punitive
provisions.
Punitive provisions attempt to put activities of unions under
closer control - prevents secondary boycotts. Prevents jurisdictional
strikes. Makes illegal welfare funds to which employer contributes
where funds administered and controlled by the unions.
Supervisory employees - (Foremen according to NLRB are not
supervisory) would be precluded from union membershi p.
Collective bargaining contracts. In some strikes it is prac-
tically impossible to bring suit against a union for breach of con-
tract.
The Case bill provides that suits may be brought in Federal
Courts.
The act does not attach responsibility to the individual -
only to the funds of unions.
Recommendation. Believes that act will encourage "quickie"
strikes. Instead of saying will strike next week - will say strike
right now. This would preclude the operation of mediation machinery.
(2) All this bill does is superimposing 5 man board over Con-
ciliation Service which has been effective since 1913. Has settled
10 strikes a day since reconversion period.
(3) This bill provides a sledgehammer for mediation which will
not make for mediation.
(4) The only new provision will be a cooling off period.
(5) This bill takes out from under the Secty of Labor all
responsibility for operation of Board. Only control by the Presi-
