Draft Proposal for Submission to the Council of
Foreign Ministera on PosteSurrender Forsign
Acquisitions in Germany
The United States Delegation proposca that the following policies
be presently agreed by the Council of Forsign Ministers and forwarded
to the Allied Control Council for implementation
1. Acquisitions by non-Germans of interests in enterprises
and property in Germany which have been attempted between the
date of this agresment and May 6, 1945 shall be subject to
s.

2. Now acquisitions by non-Germans since May 8, 1945 shall
be disapproved if:
(a) they result from transactions involving the
intervention of the Occupying Powers, respectively, or
their agents.
(b) they result from any other transactions, 8x=
cept those involving (1) new investments in foreign ex-
change or imported goods approved by the Control Gouncil;
succession
(ii) testamentary or intestato/or (iii) purchases made by
non-Germans to regain former positions in permitted in-
dustries where such positions have been diminished or ex-
tinguished by loss or damage arising out of the war or
subsequent capital removals.
3. A moratorium on acquisitions by non-Germans embodying the
principles of 2, abovs, shall be maintained by the four powers
pending the coming into force of a Troaty of Peace with Germany
or such other agreement &S shall provide for the powers and re-
sponsibilities of German governmental authorities with respect
to forsign investments in Germany.
