Deconpentration and Decartelisation
A Deconoentration-deoartelisation law was promulgated for the Bizonal
area early in 1947. This program, which is being implemented by the German
bisonal authorities under Military Government supervision, has established
certain criteria by which excessive concentrations of economic power may
be determined. All concerns employing more than 10,000 persons are con-
sidered prima facie as excessive concentrations. In addition certain
anti-trust standards have been ast up to which German enterprises will
have to conform. However, once an enterprise has been cited as being an
excessive concentration opportunity will be given to the subject enterprise
to show why it should not be deconcentrated, or failing that, it will be
given an opportunity to prosent a program which will bring the concern
within the law.
For two years quadripartite nogotiations were pursued for the purpose
of securing a deconcentration program applicable to all of Germany. Failure
to agree was occasioned by the position here-to-fare taken by the British.
An initial list of firms to be deconcentrated was drawn up with support
of the French, Russians, and U.S. and opposed by Great Britain. Another
point of disagreement centered around the question of who should have the
power of implementation, the British holding that this was a question for
the zonal commanders to decide, and the other three powers consistently
maintaining
