My dear Mr. Latta:
The Congress has enacted H. R. 1328, "For the relief of Mrs. Cecilia
M. Tonner."
It is the purpose of the bill to pay the sum of $1,792.80 to Mrs.
Cecilia M. Tonner in settlement of her claim against the United States for
personal injuries sustained and medical and hospital expenses incurred by
her as a result of having been hit by a mail carrier's car at Old Tappan,
New Jersey, on January 18, 1944.
It appears that on the date in question, the mail carrier delivered
mail to the claimant and then pulled away from the parking place without
ascertaining whether the claimant had moved out of the way of his car; that
the rear bumper caught the right leg of the claimant just below the knee,
pulling her away from the mail box, and she fell to the ground and was
dragged about six feet before the carrier's car stopped.
As a result of the accident, the claimant sustained injury to her left
knee joint. She was taken to a local hospital where she remained for thir-
teen days She was employed at the time by the Ford Motor Company of Edge-
water, New Jersey, at a weekly salary of $54.60. She, therefore, had a wage
loss of $709.80. She incurred medical and hospital expenses aggregating
$72.10. The balance of the proposed payment represents an allowance for
pain and suffering and possible permanent injuries.
A facsimile of the enrolled enactment has been referred to the Post
Office Department, and its reply, interposing no objection to the approval
of the bill, is attached.
The evidence of the record indicates that the accident was due pri-
marily to the negligence of the mail carrier.
I am authorized by the Director of the Bureau of the Budget to recom-
mend that the bill be approved.
