R. 3121, "For the relief of Elizabeth M. Simmons and Robert H. Simmons, " had been re- ceived at the White House and r equested reports and recommendations as to the approval of the bill. It is the purpose of the bill to pay the sum of $1,034.65 to Elizabeth M. Simmons and her husband, Robert H. Simmons, of Owensboro, Kentucky, in settlement of their claims against the United States by reason of personal injuries sustained and medical expenses incurred as a result of Elizabeth M. Simmons' falling while descending the steps from the south entrance of the Post Office building in Owensboro on April 26, 1944. It appears that, on the date in question, Mrs. Simmons, while des- cending the steps from the south entrance of the Post Office in question, hung the right toe of her shoe on the outer edge of the second landing of said steps and fell forward on the steps, breaking her hip and other - wise bruising herself about the body; and that at the time of the acci- dent the top surface of the landing where Mrs. Simmons hung her shoe was in a broken and chipped condition of repair, which was unknown to her, and which condition was to some extent, if not primarily, the cause of the accident. Mrs. Simmons was 46 years of age at the time of the accident and was a waitress earning $20 a week. It was more than a year before she returned to her work, and she is now employed only a few hours each day. Hospital and medical expenses have been incurred by her in the amount of $400, which have been paid by her husband, Robert H. Simmons. A facsimile of the enrolled enactment has been referred to the Post Office Department, and its reply, recommending approval of the bill, is attached. The Congress has enacted, and the President has approved, a number of bills granting relief by reason of injuries occurring under similar circumstances.
