The Special Counsel of the Merit Systems Protection Board
has written to advise you that he has completed his
investigation into an allegation that

violated personnel statutes in the course of "RIFing"
an employee. Special Counsel O'Connor has concluded that
the allegation is unsubstantiated.
This notice to you is in one sense gratuitous, since the
pertinent statute only requires a report to the President by
the Special Counsel when he determines that a Presidential
appointee has committed a violation. 5 U.S.C. $ 1206 (g) (2).
0' Connor has advised us, however, that he prefers to notify
our office when he determines that an allegation is
unsubstantiated as well. He has explained that since these
allegations often become public it is only fair to the
individual involved to at least let our office know when the
Special Counsel has completed an inquiry and determined that
no violation took place. I have drafted a brief
acknowledgment.

Anonymous Allegations Concerning
New England ICC and FHA Office
Mr. Baker received an unsigned letter, purportedly written
on behalf of "many regulated motor carriers,' alleging that
several ICC staff members from New England use government
cars to travel between their homes and work. The staff
members are identified with some specificity, one by name.
The letter asserts that a similar situation exists in the
New England area involving Federal Highway Administration
staffers.
Although there is much to be said in favor of a general rule
of ignoring anonymous complaints, I suppose we should
forward copies of the letter to the ICC and Transportation
general counsels, for whatever action they deem appropriate.

On behalf of many regulated motor carriers, by the Inter-
state Commerce Commissions, we would like to bring to your atten-
tion the following information.
In the New England area some of the staff members have
government cars assigned to them which they use to travel to and
from their homes at the tax payers expense.
For Example, at the Portland, Maine office of ICC

He has a government car
and uses the same to travel to and from his home to his office,
driving about 35 miles a day.
At Springfield, Mass., two staff members use government cars
to travel to and from their homes to the Springfield, Mass. office.
Such travel involves about 20 miles per day. One staff member lives
in Holyoke and the other resides in Wilbraham, Mass.
Another wasteful practise involves that of

James Perry, who lives in Westfield, Mass. and is the District Super
This transportation of a government car
to and from his work is about 70 miles daily.
There are other incidents of wasteful practises in the New
England area, and we are sure if other regions were investigated,
the same situations would exist.
A similar situation exists in the New England area involving
staff members of the Federal Highway Administration of the U. S.
Dept. of Transportation. In the interest of the tax payers, these
agencies, as well as all Federal agencies, should be looked into
with a view towards eleminating wasteful practises of these govern-
ment cars.

Holtzinger Correspondence
Your former partner John Holtzinger has written, sending the
AEI analysis of natural gas proposals he forgot to send on
some previous occasion, and a report of certain FERC public
meetings. He states that FERC is dominated by a
non-Republican majority sympathetic to the FERC bureaucracy,
and indicates that this will affect the views FERC presents
in the legislative battles on decontrol. I think a
substantive response would be inappropriate, but have
prepared a brief "thank you" note.

I am sorry I forgot to send the attached AEI
publication analyzing natural gas legislation pending
before Congress. The AEI analysis is a fairly succinct
and accurate description of the gas problem. Whatever
the merits of the various legislative approaches, it is
clear that this legislation will have enormous economic
significance, and will attract political attention this
year.
Also enclosed is a recent Open Commission Meet-
ing Report which Jackie Jaffe prepares each week. I in-
vite your attention particularly to the comments of Com-
missioner Richard in the Mich Wisc case. (We are not in-
volved in this matter.) It is very clear that the working
majority on the Commission now is Richard, Hughes, and
Sheldon, not a Republican majority. Even the confirmation
of a new chairman may not change this alignment much. It
is clear from Richard's comments that he will reflect the
views of a well entrenched FERC Staff bureaucracy, and
those Staff views will be the ones provided to the Con-
gress in the upcoming legislative battle on natural gas
policy. I have no specific suggestions. However, leaving
this Commission in the hands of the other side at this time
makes little sense to me.

labor at White House
Teamster President Jackie Presser is scheduled to meet at the
White House Oct. 12 with Edwin N. Meese, White House counselor.
Presser, one of the few union leaders backing Reagan for re-
election, will discuss "labor issues in general" with Meese, sources
said. It was unclear whether the 1984 election will be discussed.
Reagan has not declared his candidacy but is expected to run again.
The president is not expected to be at the meeting, sources
said, but they did not preclude a meeting between Reagan and Press-
Fer at a later date.
"If Meese can handle it, he'll handle it," one administration
rofficial said. "If it requires a decision only the president can make, it

the 42nd General Army Hospital. The hospital building, that
had been occupied by the U. N. Forces from 1945' to 1956, was
returned to our St. Luke's Hospital on ilay 25, 1956, through
the procurement agency of the Japanese Government, but none
of patients, who had been treated there, were transferred to
our hands. And we know nothing concerning the outcome of
the treatment of the atomic blast victims.

We have received your letter of October 5 to the First Lady,
along with the invitation to the Quality of Life Ball. In
that letter you announced that the First Lady had been
selected to receive the first "Quality of Life Award of
Merit.' The printed invitation to the ball indicated that
the ball was being held "to honour First Lady Nancy Reagan
and to benefit The Northern Kentucky Diabetes Association

We appreciate the kind and supportive sentiments expressed
in your letter, and certainly applaud your charitable
activities. The invitation to the Quality of Life Ball,
however, could be construed as suggesting that the First
Lady is associated with the ball, the Dixie Jaycees, the
Northern Kentucky Diabetes Association and the Paul I.
Hoxworth Blood Center. It also conveys the impression that
the First Lady will be in attendance at the ball, which as
you know is not possible. It is unfortunately probable that
some individuals decided or may decide to attend the ball
and make donations to the organizations involved on the
basis of these false impressions.
Established White House policy generally prohibits use of
the President's or First Lady's name in connection with
particular private charitable fundraising efforts. As you
might imagine, we receive countless requests that the
President or First Lady participate in such efforts. We
cannot accept them all, and out of fairness it has been
necessary to adopt a policy of uniformly declining such
requests, no matter how laudable the objectives of the
charitable organizations involved. In fact, if you had
advised us of your plans before proceeding, we would not
have been able to approve the use of the First Lady's name
on the invitation. It is now necessary to correct the false
impressions that unfortunately may have been created by the
use of the First Lady's name, and to take steps to guarantee
that no funds were raised on the basis of those false
impressions.
I assume that the invitations have already been mailed. If
not, they should be recast so as not to suggest that the
First Lady is involved or will be attending. Anyone who has
received an invitation should be contacted, to the extent
possible, and advised that Mrs. Reagan will not be at the
ball, and that she has no association with the Dixie
Jaycees, the Quality of Life Ball, the Northern Kentucky
Diabetes Association, or the Paul I. Hoxworth Blood Center.
It would also seem necessary to offer to refund donations to
any invitees who may have thought otherwise.
Please let us know what steps you have taken to correct the
problems inadvertently caused by the invitation. We regret
that action of the sort outlined above is necessary, but I
trust you will appreciate the reasons we must adhere to our
policy of avoiding associations with particular fundraising
efforts. Our adherence to the policy in this instance
should in no way be construed as an adverse reflection on
you or the Dixie Jaycees. You have our best wishes for what
I am confident will be a successful event.

This was originally staffed to H.P., and you sent an

stirring and patriotic tribute to the Medal of Honor
winners. I do not know if you want to view it, or what you

Dear Fred:
I have enclosed a cassette of the television
show HEROES -- THE OFFICIAL STORY OF THE MEDAL
OF HONOR which aired in 95% of the country on
the Fourth of July weekend. It is also being
seen throughout the world by servicemen through
Armed Forces Broadcasting.
Donating my time and effort for one year to make
this happen was one of the most rewarding experi-
ences of my career. The comments by Medal of
Honor recipients and the reaction of viewers
from throughout the country has been incredible.
It is the greatest evidence I have seen of the
renaissance of patriotism among Americans of all
ages and diverse interests. I would very much
like you to see it and would enjoy your sugges-
tions as to how we might further utilize this
material.
It has the endorsement of the Congressional Medal
of Honor Society, the Secretary of the Army and
the public affairs offices of all branches of
the military as well as the Freedoms Foundation.
