ROBERTS JJR\nHUGH HEWITT HIH-H\nWe have reviewed the attached binder on Presidential succession.\nIn addition to providing the draft letters called for at Appendices\n8 and 10, we have made two substantive changes.\nFirst, the discussion of the oath required by the Vice President\nor the Speaker upon assuming the Presidency, Tabs A and F\nrespectively, has been changed. The earlier discussion stated that\n5 U.S.C. § 2904 (c) required that the oath be administered by a\ncompetent official acting within the United States or a territory\nor possession of the United States. Not only did this discussion\nreference the incorrect section -- it is § 2903 (c) -- we have\ndetermined that § 2903 (c) does not apply to the oath for the Office\nof the Presidency. The Vice President or Speaker, even if he is\naway from the United States, may simply swear the oath although\nconsiderations of decorum would probably suggest that an appropriate\nofficial perform the act. The crucial consideration is that the\nVice President or the Speaker does not have to wait to return to\nthe United States to swear the oath.\nSecond, we have added a cautionary paragraph to the discussion of\nthe procedures of the Twenty-Fifth Amendment contained at Tab B.\nAt page 3 of that discussion we have included the paragraph:\nConsideration should always be given to whether\nthe procedures of the 25th Amendment need to be\nactivated. If the President's disability will be\nbrief and it is doubtful that any of his non-\ndelegable powers will have to be exercised, it may\nbe preferable not to employ the elaborate and\nuntested procedures of Section 3.\nThis caution reflects our belief that Section 3 need not be used\nwhenever a President undergoes a brief period of disability such as\nsurgery. ROBERTS JJR\nSUBJECT:\nAlumni Newsletter Article\nCharles Heatherly, Director of the President's Commission on\nWhite House Fellowships, has asked for your views on a book\nreview tentatively slated to be published in the Alumni\nNewsletter. The review, which lists no author, is of\nLincoln Caplan's The Insanity Defense and the Trial of John\nW. Hinckley, Jr. (The review was apparently written by a\npart-time employee of the Commission, Denise Liebowitz.)\nCaplan was a White House Fellow with the 1979-1980 class.\nThe review notes that the Hinckley acquittal prompted calls\nfor reform of the insanity defense by William French Smith\nand Edwin Meese, but that Caplan questions the need for any\nreform \"in a highly sensitive and comprehensive fashion.\"\nThe review of the book is a very favorable one, containing\nno critical analysis of Caplan's positions. For example,\nthe review notes that Caplan documents how infrequently the\ninsanity plea is invoked, and how rarely it is successful,\nbut does not note that, even rarely invoked, the plea\nimposes staggering costs on the judicial system and, since\nit is often invoked in celebrated cases, has an effect on\npublic confidence in the law far out of proportion to the\nnumber of cases in which it figures. The book is clearly at\nodds with Administration policy in this area, and the\nreview, since it is so favorable, could be considered to be\nso as well.\nThe attached memorandum for Heatherly notes that the White\nHouse does not want to get into the business of reviewing\nthe Alumni Newsletter for consistency with Administration\npolicy, and suggests that the surest way of according\nprominence to the book and the review would be to attempt to\nblock the review. John Hinckley's acquit-\nand THE HARVARD CRIMSON, re-\ntal was viewed by many as one more\nviewers have greeted the book with\nexample of American society victim-\nenthusiasm. Chuck Lane in THE\nized by violence that is excused by an\nNEW REPUBLIC says the book,\noverly lenient judicial system.\n\"makes a solid contribution to the\ndiscussion\" of the insanity plea and\nLincoln Caplan, '79-'80, in his\nLincoln Caplan, '79-'80, author of\nNoland Norgaard of THE DENVER\nrecently published book THE IN-\nTHE INSANITY DEFENSE AND\nPOST writes \"Caplan's slender\nSANITY DEFENSE AND THE\nTHE TRIAL OF JOHN W. HINCK-\nvolume is a very useful guide to\nTRIAL OF JOHNW HINCKLEY,\nLEY, JR.\nunderstanding the subject.\" David\nchallenges this popular perception\nPerlman in THE ST. PETERSBURG\nand presents the Hinckley trial, its\ndefense will not significantly reduce\nTIMES cites Linc's \"concise and clear\nvarious players and the legal and\ncrime and when the \"law gives up\nexposition of legal controversies\" and\nmoral implications of the insanity\nsafeguards without any assurance of\nTHE NEW YORK TIMES likewise\ndefense in a highly sensitive and\nimprovement in public safety, the\nrefers to his \"eloquent exposition.\"\ncomprehensive fashion. Noting that\ngovernment takes a step toward\nAs a White House Fellow, Linc\nthe insanity defense long predates\ntyranny.\"\nCaplan served in the Department of\npsychiatry, the author highlights the\nLincoln Caplan is a frequent\nEnergy. He resides in Washington,\nhistory of the legal concept from its\ncontributor to THE NEW YORKER\nD.C. and in addition to THE NEW\nbeginnings in twelfth century\nand this book is an expanded version\nYORKER, he has written for THE\nEnglish canon law. He documents the\nof essays that appeared in that\nNEW YORK TIMES, THE WASH-\nrarity with which the insanity\nmagazine. A lawyer by training, Linc\nINGTON POST AND THE NEW\ndefense is invoked in contemporary\nattended every day of the Hinckley\nREPUBLIC.\nAmerican courts and the even\ntrial. In the graceful and recognizable\nTHE INSANITY DEFENSE AND\ngreater rarity with which it meets\nNEW YORKER style, he recounts the\nTHE TRIAL OF JOHN W. HINCK-\nsuccess. And it brings to\nmind an historic injustice that is within the power of our\nsociety to correct at least as far as the American public and\nthe American government are concerned. Among the victims of the\nNazi carnage were approximately 1/2 million Gypsies who were\ntreated to the same holocaust victimization that Jews were\nsubject to on grounds not dissimilar and in conditions largely\nidentical.\nIt is tragic that no real recognition has been given to\nthe eradication of a large part of this historic people. It is\nalso important that the Gypsies of various religious cultural\nand national backgrounds can come together and in a unity to\nhonor their common dead whose sole cause for death was their\nbeing of Gypsy background and descent.\nThe creation of a place on the United States Holocaust\nMemorial Council for Gypsy representation would be a significant\nstep in the right direction of correcting an historic omission.\nThe present commission consists, we believe, of sixty-six\nmembers who serve by presidential appointment and at the\ndiscretion of the President. To the best of our knowledge,\nthere are no current vacancies.\nWe therefore urge that the White House, by presidential\ndirective, create an associate status for 3 or 4 members of the\nGypsy community leadership which would give them an ex-officio\nstatus with the Commission, allowing them of right access to all\nprivileges of that body, except for voting, and with a kind of a\npriority for filling what places may eventuate in the course of\ntime when vacancies occur on the commission.\nMark Valente, Staff Assistant\nJanuary 30, 1985\nThe White House\nPage 2\nRe: United States Holocaust\nMemorial Council\nWe also believe that it would be of significant value to\nboth the administration in its desire to serve all people with\nall backgrounds in the nation, as well as to furthering the\nunifying goals which are set by Gypsy leadership from various\nsubgroups on the American scene if the President of the United\nStates would create a photo opportunity and be photographed with\nsome of the leadership.\nCertainly this would be status-giving to the Gypsies and\nwould provide the proper news setting for the announcement for\nthe associate ex-officio appointments of Gypsies to the\ncommission.\nThe signators of this letter are not Gypsies but were\namong those who were present in a semi-professional and yet\nlargely personal capacity at the founding meeting of the United\nStates Romani Holocaust Council which was held, interestingly,\nat the auspices of the Simon Weisenthal Center at Yeshiva\nUniversity of Los Angeles.\nBoth writers, being Jewish, understand that somehow or\nother it will be redemptive of a measure of the sorrow of the\ntragedy for the Gypsies to experience that same memorializing\nthat Jews do in Jewish holocaust observance. Further, we note\nhow the Holocaust has been, tragically enough, a unifying factor\nin bringing Jews together with common memories that make for\nelements of a common present and hopefully a more unified future.\nThis same social and spiritual change can come with\nsignificance to the Gypsies of America, and through them,\nperhaps by extensive to Gypsies throughout the world. If the\nPresident of the United States will help create an initiative so\nthat another historic injustice can be met with a response of\ndignity, then something of the evil of the past can be translated\ninto a good for the present and the future as a memorial and as\na warning for all times. Gypsies should be part of the \"Days of\nRememberance\" observance nationally sponsored by the Commission.\nWe hope that this will elicit from you a sense of an\nhistoric commitment. In\nthat letter you related your experiences with Digistat. You\nalso enclosed a copy of Digistat promotional material\nprominently featuring a letter from the President congratu-\nlating Robert Michaud, President of American Stabilis, Inc.,\nand nine other individuals who were chosen by the United\nStates Jaycees as the Ten Outstanding Young Men of 1983.\nThe White House was totally unaware of the misuse of the\nletter from the President and the President's name in the\nDigistat advertisement. The White House adheres strictly to\na policy of not permitting any use of the President's name,\nlikeness, photograph, or signature in any way that suggests\nor could be construed as endorsement of a commercial product\nor enterprise. The advertisement you forwarded to us\nclearly contravenes this policy, and accordingly I have\nwritten Mr. Michaud objecting to the advertisement and\nadvising him to cease immediately this misuse of the letter\nand the President's name.
