Dan Marks THE UNITED STATES TRADE REPRESENTATIVE WASHINGTON DEC'S 20506 December 20, 1985 MEMORANDUM FOR THE PRESIDENT FROM: SUBJECT: Proclamation Establishing G a Cheese Import Quota Clayton Yeutter for Uruguay Attached for your signature is a proclamation which will give a small cheese import quota to Uruguay. Uruguay does not have a quota at present because the country has no historical record of exporting cheese to the United States. The Trade Agreements Act of 1979 allows you to proclaim import quotas on certain cheeses up to 111, 000 tons. You have thus far allocated 109,000 tons of this quantity to foreign supplying countries. The 250-ton quota for Uruguay will come out of the unallocated 2,000 tons which remains. The Trade Policy Committee agencies are unanimous in recommending that this action be taken. The National Security Council and the Department of State are particularly supportive because this action will encourage economic activity of benefit to Uruguay's new democratic government. Attachment THE UNITED STATES TRADE REPRESENTATIVE WASHINGTON 20506 December 28, 1985 MEMORANDUM TO THE HONORABLE EDWIN MEESE, III THE ATTORNEY GENERAL FROM: Clayton Yeutter SUBJECT: Proclamation Establishing a Cheese Quota for Uruguay Attached for your consideration as to form and legality is a proclamation, entitled "To Amend the Quantitative Limitations on Imports of Certain Cheeses," that will establish a quota for the importation of certain cheeses from Uruguay. The procla- mation has received interagency clearance (see the attached TPSC paper). Section 1 of proposed proclamation indicates the legal authority under which the importation of cheese is restricted and the total amount of quota cheese which may enter the United States in any calendar year: 111,000 metric tons. Section 2 indicates which Presidential proclamations imposed the quantitative restrictions that are in effect now with respect to cheese imports and where these restrictions appear in the Tariff Schedules of the United States. Section 3 indicates that modifications in these restrictions are necessary to permit imports of certain cheese from Uruguay and that these modifications would neither change existing alloca- tions nor raise the total above the 111,000 metric ton limit. The operative paragraph proclaims the modification of item 950.10 of Part 3 of the Appendix to the Tariff Schedules of the United States to provide for the entry under this item of 555,150 pounds, or 250,000 kilograms, of cheese from Uruguay. Because of the January 1, 1986 effective date, I ask that you provide an expeditious review. Attachments Ed - Sorry about the tight time frame. TO AMEND THE QUANTITATIVE LIMITATIONS ON IMPORTS OF CERTAIN CHEESES - BY THE PRESIDENT OF THE UNITED STATES OF AMERICA A PROCLAMATION 1. Import limitations have been imposed on certain cheeses pursuant to the provisions of section 22 of the Agricultural Adjustment Act of 1933, as amended, 7 U.S.C. 624. Section 701 of the Trade Agreements Act of 1979, P.L. 96-39 (the "Act") requires that the President proclaim limitations on the quantity of cheese of the types specified therein which may enter the United States in any calendar year after 1979. The Act provides that the annual aggregate quantity of such types of cheese entered shall not exceed 111,000 metric tons. 2. By Presidential Proclamation No. 4708 of December 11, 1979, and Presidential Proclamation No. 4811 of December 30, 1980, I established quantitative limitations on imports of such cheeses as required by the Act. Such quantitative limitations appear in Part 3 of the Appendix to the Tariff Schedules of the United States (TSUS). 3. In order to permit imports of certain cheeses from Uruguay, the quantitative limitations set forth in the Appendix to the TSUS must be modified. This modification does not affect any existing quota allocations nor increase the annual aggregate quantity of quota cheese to an amount in excess of 111,000 metric tons. NOW, THEREFORE, I, RONALD REAGAN, President of the United States of America, acting under the authority vested in me by the Constitution and the statutes of the United States of America, including Section 701 of the Trade Agreements Act 2 of 1979 and Section 22 of the Agricultural Adjustment Act of 1933, as amended, do hereby proclaim that Part 3 of the Appendix to the Tariff Schedules of the United States is modified effective January 1, 1986, as follows: Item 950.10 is modified by adding the following new line immediately after the line beginning with "Argentina": "Uruguay 551,150 250,000". CC: Ron Geisler TRUCK AND BUS SAFETY WEEK, 1986 BY THE PRESIDENT OF THE UNITED STATES OF AMERICA A PROCLAMATION Truck and bus safety is important to all Americans. More than 5 million trucks travel more than 135 billion miles each year on our highways transporting raw materials, finished goods, food, and other essential products and services. Buses annually carry millions of Americans to over 10,000 cities and communities. Clearly, the safe maintenance and operation of trucks and buses is vital to the health and safety of all users of our Nation's thoroughfares. The truck and bus industry is a major employer in our country, essential to the Nation and to the smooth and safe flow of commerce. The safe operation of trucks and buses is of great consequence to the motoring public with which they share the roads. Safety compliance not only saves lives, it is also sound business practice. It improves the image of the industry and enhances profitability. Ultimately, the most important means to improve safe operation are those activities undertaken by the truck and bus industry itself. Therefore, I challenge each and every person, business, and association involved in the industry to make a commitment to encourage safe truck and bus operations. I am convinced that such an effort will reward everyone. The industry must also inform the public that safety is one of its highest priorities. January is a particularly appropriate time to direct the Nation's attention to special care in the operation of vehicles on the highways, because of ice and snow conditions in many parts of the country. Observance of this week should help to establish an increased safety consciousness throughout the entire year. 2 I call upon our State governments to increase their efforts to improve safety compliance, using their own resources as well as funds provided by the Federal government. I call upon industry, labor, and the professional drivers of the country to continue to improve the safe operation of trucks and buses. Very special care must be exercised in seeing to the safe maintenance and operation of trucks carrying extremely hazardous materials. The Congress has, by Senate Joint Resolution 235, designated the week beginning January 26, 1986 as "Truck and Bus Safety Week" and authorized and requested the President to issue a proclamation in observance of this event. NOW, THEREFORE, I, RONALD REAGAN, President of the United States of America, do hereby proclaim the week of January 26 through February 1, 1986, as Truck and Bus Safety Week, and I call upon all Americans to observe this week with appropriate activities and informational programs. Clearly, the safe maintenance and operation of trucks and buses is vital to the health and safety of all users of our Nation's thoroughfares. The truck and bus industry is a major employer in our country, essential to the Nation and to the smooth and safe flow of commerce. The safe operation of trucks and buses is of great consequence to the motoring public with which they share the roads. Safety compliance not only saves lives, it is also sound business practice. It improves the image of the industry and enhances profitability. Ultimately, the most important means to improve safe operation are those activities undertaken by the truck and bus industry itself. Therefore, I challenge each and every person, business, and association involved in the industry to make a commitment to encourage safe truck and bus operations. I am convinced that such an effort will reward everyone. The industry must also inform the public that safety is one of its highest priorities. January is a particularly appropriate time to direct the Nation's attention to special care in the operation of vehicles on the highways, because of ice and snow conditions in many parts of the country. Observance of this week should help to establish an increased safety consciousness throughout the entire year. I call upon our State governments to increase their efforts to improve safety compliance, using their own resources as well as funds provided by the Federal government. I call upon industry, labor, and the professional drivers of the country to continue to improve the safe operation of trucks and buses. This year, approximately one-quarter of us will enjoy boating in one or more of its many and varied forms. Therefore, it is important that all those involved in recreational boating should put a high priority on safety. They should know and obey the rules of safe boating, and show courtesy and consideration on the water. In the first place, all boaters should wear personal flotation devices while on the water. According to the United States Coast Guard, a significant percentage of those who drowned in boating accidents last year might have been saved had they observed this rule. The theme of this year's National Safe Boating Week -- "Be Smart! Take a Boating Course!" -- emphasizes the importance of learning the safe way to enjoy the sport of boating. Every year, more and more people engage in a variety of boating activities and our Nation's waters are increasingly crowded with a growing assortment of watercraft ranging from sailboards and canoes to high-speed motorboats. Lack of knowledge on the part of boat operators makes them liable to expose themselves unnecessarily to hazards, thus endangering not only themselves, but others as well. A review of fatal boating accidents shows that over two-thirds were the fault of the operator. And less than one-quarter of these operators had received any kind of boating education.
