I'd like to introduce myself and the minority businesses I
am associated with. I've been actively involved with the
minority business enterprise sector in North Dakota since
1975, working, specifically with Native American Indian
businesses. In 1976 I organized and assisted with the formation
of the Minority Contractors Association (M.C.A.) with only
eight (8) Indian Contractors in the state. Today, there are
presently 102 identified contracting firms. Our Association is
a non-profit organization that is Indian owned and controlled.
I've seen this organization grow over the years from 8 to 102
firms and still climbing.
The primary purpose for the formation of the MCA was to give
technical assistance in all areas to all Indian businesses
so that they would become recognized, productive, profit
making, and most of all self-sufficient. The areas of specia-
lized technical assistances we provide to the firms are for an
example; Loan Packaging, Bidding & Estimating, Bonding, Record
and Bookkeeping, Financial Management, Pre-qualification, Labor
Compliance rules, and most important Indian Preference Laws on
contracting and employment.
Because of my close involvement with the five reservations
and the Indian businesses in the state of North Dakota, I am
very much interested in attending the "White House Conference
for Indians" tentatively scheduled for late August. For I feel
I can contribute alot of valuable information that could be of
direct benefit to this conference on business, employment and
economic development for Indian people.
I have been in contact with Assistant Secretary Ken Smith's
office regarding the conference. Ms. LoAnne Wagner, one of
Assistant Secretary Smith's staff, suggested I write your
office in hope of receiving an invitation. I've been added to
the list of names their office is compiling and they are aware
of the type of assistance we provide.
For your information I am enclosing a 1982 MBE Guide and a
synopsis of our services. I hope you find these of interest.

SYNOPSIS
OF
MINORITY CONTRACTORS ASSOCIATON
OF NORTH DAKOTA
I.
Introduction
The MCA is the Minority Contractors Association of North Dakota.
It is a non-profit association with a predominantly Indian membership
organized by Minority Business throughout North Dakota. The purpose
of the association is to advance the quanity of minority participation in
the construction industry, to protect the welfare of its members, and
in general to engage in all undertakings which serve to advance the
commercial and social value of its membership. The MCA will pursue
all legitimate interests within the construction industry.
Efforts of business development/management have been in the area
of the construction industry; however, the association is now in a
position to offer Technical Assistance to those minority firms starting
up any kind of business venture.
Minorities, female and disadvantaged owned enterprises may qualify
for MCA membership after they are thoroughly screened by the MCA
Screening Committee. The Screening Committee's main purpose is to
protect the active and bonafide members. Minority, female and dis-
advantaged person must own 51% or more of the business as well as
having 51% control of the assets of the business, they must also be
able to show they have an active hand in the daily operations of the
business. Anybody can qualify as an associate member of the MCA
but they do not actively participate in the association.
II.
Services Provided
1. Enforcement of affirmative action plans
2. Evaluate a business or business opportunities
3. Outline the steps involved in starting a business
4. Identify capital requirements, costs of starting
a business, and available financial resources
5. Determine potential of a proposed venture
6. Assist in start-up, licensing, unemployment, etc.
7. Assist in bonding procurement
Loan Packaging
The MCA assists clients in preparing financial documents for sub-
mission to banks, the SBA and other funding sources.
Accounting
The MCA assists clients in setting up a system to generate use-
ful financial records. MCA then helps clients maintain and interpret
their records.
Bid Preparation
The MCA assists contractors in bidding and estimating of projects.
Contract Procurement
The MCA works closely with federal agencies and general con-
tractors to notify members of the MCA of contracting opportunities
of which they made be interested.
Plans and specifications for federally funded projects are on file in
the central office.
III.
History and Accomplishments
The North Dakota Minority Contractors Association is comprised
of some 99 minority businesses. This organization is a major factor
in the establishment (NDMCA) of minority participation in the busi-
ness sector. For example, the business listing in 1980 alone under-
went a 42 percent increase. An additional 40 firms are waiting to
be certified as bonafide minority contractors.
While prior to 1976 the amount of federal funds going to minority
businesses was negligible, the NDMCA in 1980 collectively did in
excess of 28 million dollars worth of construction work, and in 1981,
the businesses had about 70 million dollars in total receipts.
IV.
MBDA/BIA Contract
Description of Services:
The North Dakota Minority Contractors Association will operate
an office for the purpose of:
1. Establishing a regional focal point for Indian businesses
2. Strengthening existing Indian businesses
3. Establishing a Marketing Information Center
These objectives will be accomplished by providing Indian-owned
enterprises management and technical assistance with the necessary
personnel, services, equipment and office space to implement the
program within the terms, conditions and work plan outlined in
the contract.
The MCA's full screening committee, comprised of federal highway
representatives, minority contractors, MCA board members and executive
staff, and an SBA representative meet semi-annually to review businesses
interested in obtaining minority business eligibility in the state of North
Dakota. As well as having representatives on the screening committee
the MCA had developed an excellent working relationship with the
following agencies and organizations.
These organizations or agencies include:
The Economic Development Administration
Through this agencies local field office the representative provides a
continual flow of information, be it in regard to anticipated projects
or in the area of general technical assistance.
The Small Business Administration (SBA)
The department has an open door relationship with this agency and
has been able to maximize its services to participants through this
relationship. The SBA has indicated its willingness to provide tech-
nical assistance to minorities in regard to the agencies Minority
Bonding program.
The North Dakota State Highway Department
This State agency has worked closely with the Minority Contractors
Association in the past in order to insure minority enterprises
opportunities for obtaining various highway contracts. The depart-
ment has been most helpful in the provision of engineering assistance
in minority contractors.
Forms needed by the Screening Committee in order to obtain
recognition as a bonafide MBE, WBE, HBE are as follows:
1. Interview form
2. Documentation requested in the Interview form
3. Legal papers, such as, Incorporation or Partnership Agreement
4. Proof that the minority group member is recognized as such,
for example, enrollment document, birth certificate, etc.
The MCA keeps an updated file on each business in order to
assist them effectively. We are fully aware of the company's
financial status and management structure.
ADMINISTRATIVE STAFF
JAMES LADUCER -- Executive Director
Jim has done extensive work in the concentrations of small business development, con-
tracts and procurement administration, bidding, and estimating, and organizational
management. He has been the active agent in the formation and implementation of the
North Dakota Minority Contractors Association as well as serving as the Executive
Director of the group.
ROBERT GAYTON -- Assistant Director
Rob has a degree in Business Administration. He specializes in loan packaging, finan-
cial and organizational management and motivation. Rob has experience in the area of
financial and marketing analysis as well as bonding requisites and other facets of
enterprise development. He will be serving on the Administration Staff of the MCA
and available for counsel.
TECHNICAL STAFF
JOHN SWANBERG -- MCA Contract Specialist
John's duties under the MCA include: Providing technical assistance to all Minority
Businesses in the areas of contracts, bidding, and plans and specification reading;
acts as an in-state clearinghouse for the state; advocate and enforce affirmative action
compliance for federally funded projects; assist in contract procurement, etc.
JAY GIBSON -- MCA Finance Analyst
Jay graduated from the University of North Dakota at Grand Forks with a Bachelor
of Science degree in Business Education. The premise of his employment is to pro-
vide management and technical assistance in the areas of business management, fin-
ance planning, accounting, marketing, and business packaging on a one-to-one
basis when practical and possible. And when an assistance request cannot adequately
be provided by this organization, he will utilize the resources inherent in the national
MBDA network or other federal or domestic resources to benefit the client's requests.
MARGARET RAMEY MILLER -- MCA Administrative Assistant
Margaret is responsible for screening and assisting applicants for loan packages. Follow-
up on interested minority enterprises and provide assistance in achieving compliance
with state licensing requirements and respond to any problems they may encounter.
Identify new minority firms and inform them of their opportunities in the construction
industry, and act as a liaison between minority firms and relevant agencies.
IRENE MCCLOUD -- Executive Secretary
Irene's performance duties include setting up Board meetings, Screening Committee
meetings, Emergency meetings, MCA Conventions, etc., revises MCA Directory every
six months, keeps information, material all current and up-to-date. Irene also acts
as custodian of documents and records.

INTRODUCTION
The Minority Business Enterprise (MBE) Directory
was compiled by the United Tribes Educational Technical
Center (UTETC) and the Minority Contractors Association
(MCA) of North Dakota. It contains minority (MBE), women
(WBE), and handicap-owned (HBE) businesses recognized in
North Dakota in highway and other related construction
fields. This Directory affords the MBEs, WBEs and HBEs
greater visibility among Federal, State and local government
agencies, thereby stimulating a more widespread utilization
of their products and services.
This Directory should be used to bring minority,
women and handicap businesses to the bidder's table. This
can only be accomplished by procurement personnel using the
Directory when the need for products or services arises.
Government and industry must lead their support and assume
their initiative for further progress.
Inclusion of an enterprise in this Directory is
for informational purposes and does constitute the endorse-
ment of the concerned. Exclusion of any names of possible
MBEs, WBEs, or HBEs does not necessarily constitute that
those firms are not bona-fide business enterprises,

All persons who use the Directory are urged to
furnish the Screening Committee the names and addresses of
minority, women or handicap-owned businesses not included in
this edition. If they are qualified by the Screening
Committee, they will be added to the next edition.
DEFINITION OF MINORITY GROUP MEMBER
The Committee defines a minority group member as
a citizen of the United States who is American Indian,
Black, Hispanic, Asian, Pacific Islander or Alaskan Native.
Further definition of these minority groups is required to
clarify the many ambiguities associated with their uses.
Therefore, these terms shall be interpreted by the Committee
in the following manner.
(a) AMERICAN & ALASKAN NATIVE - a person having
origins in any of the original peoples of North America and
who maintains cultural identification through tribal affilia-
tion or community recognition.
(b) HISPANIC - a person of Mexican, Puerto Rican,
Cuban, Central or South American or other Spanish culture or
origin, regardless of race.

(c) ASIAN OR PACIFIC ISLANDER - a person having
origins in any of the original peoples of the Far East,
Southeast Asia, the Indian sub continent or the Pacific
Islands. This area includes for example China, Japan,
Korea, the Phillippines Islands and Samoa.
(d) BLACK, NOT OF HISPANIC ORIGIN - a person having
origins in any of the black racial groups of Africa.
DETERMINATION OF A BONA-FIDE BUSINESS ENTERPRISE
For the propose of the MBE Directory, a MBE is
a business at least 51% owned by a minority group member or
other MBEs, a WBE is a business at least 51% owned by a
women, and a HBE is a business at least 51% owned by a
handicapped person. A MBE, WBE, or HBE is bona-fide if the
minority group member, women, or handicapped person's
ownership interests are real, continuing and in good faith,
not created solely to meet MBE requirements.
The Screening Committee will generally rely upon
the statement contained in forms obtained at the United
Tribes and Minority Contractors Association office to
determine whether or not an enterprise is a MBE, WBE, or
HBE and bona-fide.

Eastern Band of the Cherokee Indians reservation is in my
district and already contributes much to the economy of
the area, but which could contribute much more if the oppor-
tunity for industrial growth on the reservation itself
could be realized.

As you are well aware, this Firm has become very
active in a variety of matters related to Native Americans.
Of course, some of what we are doing has involved working
with you.
Unfortunately, due to some circumstances beyond
our control, it has been necessary for Mr. Vincent Lachelli
to discontinue his duties in charge of Indian Affairs for
the Firm.
The focus of the Firm's attention, relative to
Native Americans, has been on matters of economic develop-
ment. We are proud to have as a member of the Firm, Mr.
Larry Schneider, who will continue to provide capable leader-
ship for us in these areas. Larry was previously the
Supervisor of Industrial and Economic Development for the
Bureau of Indian Affairs, and prior to this he was Associate
Director of the federal Economic Development Authority.
Larry served with distinction for many years as the Director
of Economic Development for the States of Missouri and North
Dakota. In addition, there are several professionals
associated with the Firm who have expertise in the area of
economic development affairs and others who are thoroughly
experienced in dealing with Native American matters.
We are excited about the future--and the very
timely opportunities that it offers in relationship to
helping our Native American people make substantial strides
toward economic self-sufficiency and away from total depend-
ency on the Federal government. And, we are looking foward
to continuing to work with you toward our common objectives
in this area.
