So called "gerrymandering" based on political or racial considerations is inconsistent with those goals. Instead of allowing such motives to distort the districting process, I believe the Legislature should adhere consistently to such criteria as relative equality of population, compactness, preservation of local boundaries and communities of interest, and other factors which would result in districts which preserve and enhance the quality of legislative representation. The principle that the legislature should be guided by standards or criteria in reapportioning itself and the State's Congressional districts has a long history. Article IV, Section 6 of the California Constitution, adopted in 1926, provided in part as follows: " Such districts shall be composed of contigu- ous territory, and assembly districts shall be as nearly equal in population as may be In the formation of assembly districts no county, or city and county, shall be divided, unless it contains sufficient population within itself to form two or more districts, nor shall a part of any county, or of any city and county, be united with any other county, or city and county, in forming any assembly or sénatorial district. = Article IV, Section 27 of the California Constitution contains similar provisions for Congressional districts. During the mid-1960's, the United States Supreme Court adosted the rulo that the consideration which should govern State Legislatures in redistricting themselves was the achievement of population equality between districts. United States Supreme this rule where State legislative, as distinguished from Congressional, districting is concerned. Specifically, it held that the Virginia Legislature, in drawing a redistricting plan for the lower house which respected the boundaries of local governmental subdivisions, was permitted greater flexibility in population deviation between the districts. Other decisions of the United States Supreme Court have struck down racial gerrymanders. The California Legislature has set forth in Government Code Section 25001 the criteria which should be followed in reapportioning county supervisorial districts. That section provides that the boards may consider, in addition to equality of population, the following: " (a) topography, (b) geography, (c) cohe- siveness, contiguity, integrity, and compactness of territory, and (d) community of interests of the districts." With the recent Mahan decision further confirming the language of the California Constitution and of my veto messages of January, 1972, I wish to reemphasize criteria which should be considered as a basis for a fair and equal redistricting. These are as follows: 1. Districts should be as nearly equal in population as possible. 2. Districts should be as compact as possible and provide easy accessibility between different areas in the districts. 3. Districts should be composed of contiguous territory. 4. District lines should follow existing county and city boundaries where possible. 5. Districts should be composed of communities which share common historical, geographical, topographic, cultural, to the above criteria and without regard to race or ethnic back- ground. District boundarios should not attempt to exclude or include particular ethnic or racial minorities in one constituency to dilute the voting strength of such minorities, and when such minorities exist in large communities, those communities should not be carved up among several districts in order to protect incumbents of another race or ethnic background. These principles improve citizen access and identi- fication with their elected representatives, facilitate com- munications of representatives with their constituents, and reduce the costs of campaigns. Moreover, these criteria preclude meandering lines which reach out in order to attach portions of other communities which may be many miles away and separated from the heart of the district by mountain ranges or large expanses of unpopulated territory. In summary, such criteria, consistently applied, will produce districts which are fair to all Californians and which enhance rather than impair the representative process. The "one person, one vote" rule was applied to eliminate gross population disparities among districts. By 1971, the courts were requiring mathematical exactness between districts. Unfortunately, many legislatures concluded from this development that population equality was the only yard- stick for measuring the legality and fairness of a redistricting plan that any plan, no matter how absurd, would be acceptable if its districts were precisely equal. Armed with census and political data, applying the equality of population, legislatures developed redistricting plans which made a mockery of the goal of fair and equal representation and reached new heights of sophisticated natiti good one and provides an important starting point for fair and equal districting, but it cannot stand alone. Its use in combination with the computer and without any other cri- teria can lead to a distortion of the entire representative process. Conversely, the computer combined with unbiased criteria can be used to create equitable districts with population variations within acceptable limits. I believe the current controversy over reapportionment in California, now well into its third year, demonstrates the need to restore balance to the redistricting process by requiring the consistent application of common sense criteria such as those outlined above. Although the Special Masters face an enormously difficult task, they also have an historic opportunity to restore ration- ality and fairness to the districting process in California. As a citizen and voter, I join millions of others throughout the State in the hope that the Special Masters will achieve success in their efforts to provide California with the kind of equitable reapportionment to which it is entitled, under guidelines similar to those presented here. In a day when too many already doubt the ability of government to act fairly in the interest of the voters, it would be tragic should the redistricting process result in the debasement of the voters' franchise through modern versions of the ancient gerrymanders. We look to you to draw Medistricting lines that will enable the people of California to be fairly and effectively represented. The legislative efforts to reapportion the state was contained in Senate Bill 195. This legislation lumped assembly, senate and congressional reapportionment plans together. This was a ploy by the Assembly leadership, because I had publicly stated that the Senate reapportionment was as fair and honest as possible under the conditions, but that the Assembly plan contained gross and indefensible gerrymandering. By lumping all the plans together, the Assembly majority leadership was forcing me into an "all or nothing" situation, similar to the way they foisted an unneeded 1-cent additional sales tax on the people. The fact that California has had a history of gerrymandering which has militated against fair reapportionment or fair districting for the people does not mean that we should settle for it forever more because it has been a custom of the past. When I vetoed SB 195 last June, we didn't hear a word of dissent from the people. In fact, everything we heard from the citizenry urged a veto of the bill. And that included editorial comments from all the major newspapers throughout the state of California, including the L.A. Times. The legitimate goals of reapportionment should be to achieve fair and equal representation in the legislature and in Congress for all the people of California and to improve the capacity of our legislators to represent their constituents. My vetoes of the redistricting plans in December, 1971, were based on the lack of regard for these principles. Because the proposed 1973 Congressional and Assembly districing measures contained no substantial improvements over the 1971 proposals, I was once again impelled, in the interest of equal and effective representation, to veto the -1- legislature's attempts at reapportionment. The Senate districts set forth in Senate Bill 195, however, did improve since 1971. They are not subject in the same degree to the criticisms of the Congressional and Assembly districts and, if I had received a separate bill proposing establishment of these Senate districts, I would have signed it because of the Senate's honest effort during recent months to improve the districts. This effort was an enlightened one in that it utilized population variations permitted in the recent Virginia decision to reach its goal. On the contrary, the Assembly district portions of the bill took no cognizance of this decision. CRITERIA FOR REDISTRICTING The principle that the legislature should be guided by standards or criteria in reapportioning itself and the State's Congressional districts has a long history. District boundaries should not attempt to exclude or include particular ethnic or racial minorities in one constituency to dilute the voting strength of such minorities and when such minorities exist in large communities, those communities should not be carved up among several districts in order to protect incumbents of another race or ethnic background. FAULTS IN S.B. 195 LACK OF EQUALITY OF POPULATION Despite some minor changes in the lines in some of the districts in the Congressional plan, presumably to achieve greater equality than the 1971 Assembly Bill 16 plan, 22 of the districts were unchanged by S.B. 195, and several of these still deviate from the equality of population which a good-faith effort could easily have achieved. Indeed, the difference between the smallest unchanged district and the largest exceeds 3,000 persons. Even some of the altered districts are still deficient in this Los Angeles, respect. In the case of the 21st district in MA, territory was added even though the district was already overpopulated. In another instance, several counties were combined to form three districts (the 1st, 5th and 6th districts), but the combined populations of these counties are more than 2,000 short of the number of persons required for three full districts. Such deviations from equality diminish equal representation for the citizens in overpopulated districts. LACK OF COMPACTNESS Compactness is one of the chief requirements of a rational reap- portionment policy, for compact districts create constituencies that are more easily and effectively represented, that allow the people more direct access to their representatives and that lighten the task of conducting elections. Congressional district 36, located in Kern and Kings Counties, is notable for its long, thin arm which reaches through sparsely populated and unpopulated stretches of San Luis Obispo and Santa Barbara counties to attach the population around the campus of the University of California at Santa Barbara. Congressional District 42, based in central San Diego County and including parts of the City of San Diego, runs in an irregular pattern north to pick up part of the community of Newport Beach in Orange County, 80 miles away. Congressional District 43, a district based in Riverside and Imperial Counties, unnecessarily includes citizens from distant coastal areas near the City of San Diego, and part of the City itself. Congressional Districts 28 and 37 in Los Angeles both include grotesque appendages and meandering lines which cannot have resulted from any acceptable rationale. The changes which SB 195 made in the 1971 AB 16 plan failed to improve a single one of these deficiencies. Indeed, changes to the 28th, and 37th districts make them even less compact and more absurd than they were in the 1972 versions. -4- In the Assembly Plan, Assembly District 29 extends all the way from the community of Taft in Kern County to the City of San Jose in Santa Clara County, truly a remarkable feat of cartography. Assembly District 23 runs from the San Luis Obispo-Kern County line to the western San Bernardino County communities of Upland and Ontario. Assembly District 69, which has probably elicited more adverse public comment than any other district, runs in narrow, irregular corridors along the borders of Orange and Los Angeles Counties. San Diego County Assembly districts 76, 78, 79, and 80 wander through the county in jigsaw fashion, dividing the urban areas of the county in an irrational manner which is bound to confuse the electorate. UNNECESSARY DIVISION OF INTERESTS These plans blatantly fail to pay due respect to the needs and interests of the different communities and the political divisions in the state. The districts provided for cut across county and city lines, fragment other established political division of the state, and violate the identity of innumerable communities. Again, the sole purpose seems to have been to achieve partisan gains. Numerous examples of divisions of local political subdivisions can be cited, but I will mention only the more flagrant ones in Southern California. But this gerrymandering is rampant throughout the state. Congressional Districts 23 and 34 wind tortously through Los Angeles and Orange Counties, crossing city boundaries with utter abandon and creating districts composed of widely separated fragments of cities and communities of interest. Congressional District 38 substantially divides 6 of the 7 largest cities within its borders including Riverside, San Bernardino, and Pomona. -5- Assembly districts in the eastern part of Los Angeles County seemingly pay no attention at all to the community lines as they wander in random fashion throughout this area. Assembly District 69, of course, notorious for its absure, contorted corridors, is also notable for its division of virtually every community it touches, since few incorporated communities are small enough to fit within such narrow confines. This district could best be described as looking like a circus ferris wheel, distorted by the intense heat of partisan politics. I cannot, in good conscience, tell the people of California that these plans pay due regard for the value of preserving our communities intact within the representative structure or provide the citizens within these communities and immediately surrounding areas with the fair and equitable representation to which they are entitled. It would have been idealist, and totally fair to the people of California if the leadership in the legislature had just sat down and reapportioned the State of California without taking into consideration party registration. Reinecke [Sac. 7917, 7919, 7923] CALIFORNIA SUPREME COURT UPHOLDS MASTERS' REAPPORTIONMENT PLAN State reapportionment plans recommended by three Special Masters were adopted virtually intact by a unanimous California Supreme Court today. The new congressional dis- tricts, and the State Senate and Assembly districts will be used in the 1974 elections and until new reapportionment plans are adopted following the 1980 census. The order is final, and becomes effective today. The opinion was written by Chief Justice Donald R. Wright. Since the new districts were not established for one full year before the 1974 general election, the Court held the one-year residence requirement for state legislators is not ap- plicable. The ruling stated, however, that a candidate must be a resident of the district in which he runs by January 28, 1974. This is the first date specified in the Election Code for filing a declaration of intention to become a candidate. Elections to 20 of the 40 Senate seats will continue to be held every two years. Consequently, elections for Sena- tors from new reapportioned even-numbered districts will be held in 1974, and for odd-numbered districts in 1976. Even though reapportionment will mean that some voters-those moved from an old even-numbered district to a new odd-numbered dis- trict-will not be able to vote for a six-year period, the Court concluded this did not deny them equal protection under the Federal Constitution. Referring to the Commission report, the Court observed that the Masters had reviewed the evidence, listed appropriate criteria, explained why other reapportionment plans were not suitable, and had described their methods and reasoning in reaching the recommended plans. The Court approved and adopted the seven criteria used by the Masters as a basis for reapportionment: 1. Strict equality of population for congressional districts, and reasonable equality for legislative districts; 2. Providing districts which are contiguous and compact; 3. Maintaining counties and cities as intact as possible; 4. Preserving the integrity of basic geographic re- gions as much as possible; 5. Considering community of interest; 6. Forming state senatorial districts by combining adjacent Assembly districts, and where practicable, having con- gressional district boundaries follow Assembly district lines; and 7. Using the 1970 census as the basis and using census tracts as the basic unit for district formation. An argument that the existing relationships between incumbents and constituents should also be a criteria was re- jected. While acknowledging the values of such relationships, the Court concluded that "incumbent-neutral" districting per- mits most incumbents to keep their incumbent advantage, but that districting to preserve the status quo "would be unfair both to nonincumbent candidates and to electors of the new dis- tricts who wished to support such candidates." The Court declined to redraw any district lines rec- ommended by the Masters because of "the serious risk of creat- ing side effects which we could not foresee and which adversely affected parties could not call to our attention in time for cor- rections to be made." The opinion pointed out that the Masters had developed expertise in their four months of study and analysis and also had assessed the impact of alternative proposals that had been proposed by the Legislature or that had been submitted to them. The only modification made by the Court to the Masters' recommendations was to interchange the numbers of the new Senate Districts 8 and 9 (Alameda County) and 27 and 30 (Los Angeles County). The State Constitution provides for four-year terms for State Senators with half elected every two years. Thus, the Court reasoned those Senators elected in 1972 are entitled to serve until 1976 and if a vacancy occurs before then, it should be filled by a special election of voters in the "old" 1972 district. Because of this constitutional requirement, some inequality may result, the Court observed. For example, changes of Senate district boundaries may permit some electors to vote in 1972, 1974 and 1976, while others may only be able to vote in 1972 and 1976, and still others only in 1970 and 1976. To test if these differences violate the equal protec- tion clause, the California Court applied standards established by the U.S. Supreme Court that in state electoral districting cases equal protection is afforded if districting is based on claims that a state may "rationally consider." Applying that test the Court concluded that California "may rationally con- sider stability and continuity in the Senate as a desirable goal which is reasonably promoted by providing for four-year staggered terms," and that correction of any resulting inequal- ity would "substantially interfere" with the staggered term system. The first ruling of the Court regarding state reap- portionment was made on January 18, 1972 in response to a suit filed when the Legislature failed to reapportion itself on the basis of the 1970 census. That decision ordered use of temporary reapportionment plans for the 1972 elections but the Court retained jurisdiction to draft new plans for 1974 elec- tions if the Legislature did not. On May 10, 1972 the Court granted the State Senate an extension of time to permit the Legislature to attempt its own reapportionment during the re- mainder of the year 1972. The Legislature did not act and the Court, on March 23, 1973, appointed three Special Masters to hold hearings and develop recommended criteria and districting plans for the Court's consideration by August 31. On October 30 the Supreme Court heard oral arguments concern- ing those recommendations. Today's decision will be published in the official reports of the California Supreme Court. The University of California Institute of Govern- mental Studies in Berkeley was granted permission to store the materials relating to the case for use by the public. Court of Appeal Presiding Justice Murray Draper sat on assignment. Supreme Court Justice Louis H. So called \"gerrymandering\" based on political\nor racial considerations is inconsistent with those goals.\nInstead of allowing such motives to distort the districting\nprocess, I believe the Legislature should adhere consistently\nto such criteria as relative equality of population, compactness,\npreservation of local boundaries and communities of interest,\nand other factors which would result in districts which preserve\nand enhance the quality of legislative representation.\nThe principle that the legislature should be guided\nby standards or criteria in reapportioning itself and the\nState's Congressional districts has a long history. Article\nIV, Section 6 of the California Constitution, adopted in 1926,\nprovided in part as follows:\n\"\nSuch districts shall be composed of contigu-\nous territory, and assembly districts shall be as\nnearly equal in population as may be\nIn the\nformation of assembly districts no county, or city\nand county, shall be divided, unless it contains\nsufficient population within itself to form two or\nmore districts,\nnor shall a part of any county,\nor of any city and county, be united with any other\ncounty, or city and county, in forming any assembly\nor sénatorial district. =\nArticle IV, Section 27 of the California Constitution contains\nsimilar provisions for Congressional districts.\nDuring the mid-1960's, the United States Supreme\nCourt adosted the rulo that the consideration which\nshould govern State Legislatures in redistricting themselves\nwas the achievement of population equality between districts.\nUnited States Supreme this\nrule where State legislative, as distinguished from Congressional,\ndistricting is concerned. Specifically, it held that the Virginia\nLegislature, in drawing a redistricting plan for the lower house\nwhich respected the boundaries of local governmental subdivisions,\nwas permitted greater flexibility in population deviation between\nthe districts. Other decisions of the United States Supreme Court\nhave struck down racial gerrymanders.\nThe California Legislature has set forth in Government\nCode Section 25001 the criteria which should be followed in\nreapportioning county supervisorial districts. That section\nprovides that the boards may consider, in addition to equality\nof population, the following:\n\"\n(a) topography, (b) geography, (c) cohe-\nsiveness, contiguity, integrity, and compactness\nof territory, and (d) community of interests of\nthe districts.\"\nWith the recent Mahan decision further confirming the\nlanguage of the California Constitution and of my veto messages\nof January, 1972, I wish to reemphasize criteria which should\nbe considered as a basis for a fair and equal redistricting.\nThese are as follows:\n1. Districts should be as nearly equal in population\nas possible.\n2. Districts should be as compact as possible and\nprovide easy accessibility between different areas in the\ndistricts.\n3. Districts should be composed of contiguous\nterritory.\n4. District lines should follow existing county and\ncity boundaries where possible.\n5. Districts should be composed of communities which\nshare common historical, geographical, topographic, cultural,\nto the above criteria and without regard to race or ethnic back-\nground. District boundarios should not attempt to exclude or\ninclude particular ethnic or racial minorities in one constituency\nto dilute the voting strength of such minorities, and when such\nminorities exist in large communities, those communities should\nnot be carved up among several districts in order to protect\nincumbents of another race or ethnic background.\nThese principles improve citizen access and identi-\nfication with their elected representatives, facilitate com-\nmunications of representatives with their constituents, and\nreduce the costs of campaigns. Moreover, these criteria\npreclude meandering lines which reach out in order to attach\nportions of other communities which may be many miles away\nand separated from the heart of the district by mountain\nranges or large expanses of unpopulated territory. In summary,\nsuch criteria, consistently applied, will produce districts\nwhich are fair to all Californians and which enhance rather\nthan impair the representative process.\nThe \"one person, one vote\" rule was applied to\neliminate gross population disparities among districts. By\n1971, the courts were requiring mathematical exactness between\ndistricts. Unfortunately, many legislatures concluded from\nthis development that population equality was the only yard-\nstick for measuring the legality and fairness of a redistricting\nplan that any plan, no matter how absurd, would be acceptable\nif its districts were precisely equal.\nArmed with census and political data, applying the\nequality of population, legislatures developed redistricting\nplans which made a mockery of the goal of fair and equal\nrepresentation and reached new heights of sophisticated\nnatiti\ngood one and provides an important starting point for fair\nand equal districting, but it cannot stand alone. Its use\nin combination with the computer and without any other cri-\nteria can lead to a distortion of the entire representative\nprocess. Conversely, the computer combined with unbiased\ncriteria can be used to create equitable districts with\npopulation variations within acceptable limits.\nI believe the current controversy over reapportionment\nin California, now well into its third year, demonstrates the\nneed to restore balance to the redistricting process by requiring\nthe consistent application of common sense criteria such as those\noutlined above.\nAlthough the Special Masters face an enormously difficult\ntask, they also have an historic opportunity to restore ration-\nality and fairness to the districting process in California. As\na citizen and voter, I join millions of others throughout the\nState in the hope that the Special Masters will achieve success\nin their efforts to provide California with the kind of equitable\nreapportionment to which it is entitled, under guidelines similar\nto those presented here.\nIn a day when too many already doubt the ability of\ngovernment to act fairly in the interest of the voters, it would\nbe tragic should the redistricting process result in the debasement\nof the voters' franchise through modern versions of the ancient\ngerrymanders.\nWe look to you to draw Medistricting lines that will\nenable the people of California to be fairly and effectively\nrepresented.\nThe legislative efforts to reapportion the state was contained\nin Senate Bill 195. This legislation lumped assembly, senate and\ncongressional reapportionment plans together. This was a ploy by\nthe Assembly leadership, because I had publicly stated that the\nSenate reapportionment was as fair and honest as possible under\nthe conditions, but that the Assembly plan contained gross and\nindefensible gerrymandering.\nBy lumping all the plans together, the Assembly majority\nleadership was forcing me into an \"all or nothing\" situation,\nsimilar to the way they foisted an unneeded 1-cent additional sales tax\non the people.\nThe fact that California has had a history of gerrymandering\nwhich has militated against fair reapportionment or fair districting\nfor the people does not mean that we should settle for it forever more\nbecause it has been a custom of the past.\nWhen I vetoed SB 195 last June, we didn't hear a word of dissent\nfrom the people. In fact, everything we heard from the citizenry\nurged a veto of the bill. And that included editorial comments from\nall the major newspapers throughout the state of California, including\nthe L.A. Times.\nThe legitimate goals of reapportionment should be to achieve fair\nand equal representation in the legislature and in Congress for all\nthe people of California and to improve the capacity of our legislators\nto represent their constituents.\nMy vetoes of the redistricting plans in December, 1971, were based\non the lack of regard for these principles. Because the proposed 1973\nCongressional and Assembly districing measures contained no substantial\nimprovements over the 1971 proposals, I was once again impelled, in\nthe interest of equal and effective representation, to veto the\n-1-\nlegislature's attempts at reapportionment.\nThe Senate districts set forth in Senate Bill 195, however,\ndid improve since 1971. They are not subject in the same degree\nto the criticisms of the Congressional and Assembly districts and,\nif I had received a separate bill proposing establishment of these Senate\ndistricts, I would have signed it because of the Senate's honest effort\nduring recent months to improve the districts. This effort was an\nenlightened one in that it utilized population variations permitted in\nthe recent Virginia decision to reach its goal. On the contrary, the\nAssembly district portions of the bill took no cognizance of this\ndecision.\nCRITERIA FOR REDISTRICTING\nThe principle that the legislature should be guided by standards\nor criteria in reapportioning itself and the State's Congressional\ndistricts has a long history. Article IV, Section 6 of the California\nConstitution, adopted in 1926, provided in part as follows:\n\"\nSuch districts shall be composed of contiguous territory,\nand assembly districts, shall be as nearly equal in population\nas may be\nIn the formation of assembly districts no county,\nor city and county, shall be divided, unless it contains\nsufficient population within itself to form two or more districts,\nnor shall a part of any county, or of any city and county,\nbe united with any other county, or city and county, in forming\nany assembly or senatorial district.\"\nArticle IV, Section 27 of the California Constitution contains similar\nprovisions for Congressional districts.\nHere are the guidelines which the legislature should follow to\narrive at a fair and equal redistricting:\n1.\nDistricts should be as nearly equal in population as possible.\n2.\nDistricts should be as compact as possible and provide easy\naccessibility between different areas in the districts.\n3.\nDistricts should be composed of contiguous territory.\n-2-\n4.\nDistrict lines should follow existing county and city\nboundaries where possible.\n5.\nDistricts should be composed of communities which share\ncommon historical, geographical. topographic, cultural,\nand other interests.\n6.\nDistrict lines should be drawn solely with regard to the\nabove criteria and without regard to race or ethnic back-\nground. District boundaries should not attempt to exclude or\ninclude particular ethnic or racial minorities in one\nconstituency to dilute the voting strength of such minorities\nand when such minorities exist in large communities, those\ncommunities should not be carved up among several districts\nin order to protect incumbents of another race or ethnic\nbackground.\nThese principles improve citizen access and identification with\ntheir elected representatives, facilitate communications of representatives\nwith their constituents, and reduce the costs of campaigns. Moreover,\nthese criteria preclude meandering lines which reach out in order to\nattach portions of other communities which may be many miles away and\nseparated from the heart of the district by mountain ranges or large\nexpanses of unpopulated territory.\nFAULTS IN S.B. 195\nLACK OF EQUALITY OF POPULATION\nDespite some minor changes in the lines in some of the districts\nin the Congressional plan, presumably to achieve greater equality than\nthe 1971 Assembly Bill 16 plan, 22 of the districts were unchanged by\nS.B. 195, and several of these still deviate from the equality of\npopulation which a good-faith effort could easily have achieved.\nIndeed, the difference between the smallest unchanged district and\nthe largest exceeds 3,000 persons.\nEven some of the altered districts are still deficient in this\nLos Angeles,\nrespect. In the case of the 21st district in MA, territory was added\neven though the district was already overpopulated. In another instance,\nseveral counties were combined to form three districts (the 1st, 5th and\n6th districts), but the combined populations of these counties are more\nthan 2,000 short of the number of persons required for three full\ndistricts. Such deviations from equality diminish equal representation\nfor the citizens in overpopulated districts.\nLACK OF COMPACTNESS\nCompactness is one of the chief requirements of a rational reap-\nportionment policy, for compact districts create constituencies that\nare more easily and effectively represented, that allow the people more\ndirect access to their representatives and that lighten the task of\nconducting elections.\nCongressional district 36, located in Kern and Kings Counties,\nis notable for its long, thin arm which reaches through sparsely populated\nand unpopulated stretches of San Luis Obispo and Santa Barbara counties\nto attach the population around the campus of the University of California\nat Santa Barbara.\nCongressional District 42, based in central San Diego County and\nincluding parts of the City of San Diego, runs in an irregular pattern\nnorth to pick up part of the community of Newport Beach in Orange County,\n80 miles away.\nCongressional District 43, a district based in Riverside and\nImperial Counties, unnecessarily includes citizens from distant coastal\nareas near the City of San Diego, and part of the City itself.\nCongressional Districts 28 and 37 in Los Angeles both include\ngrotesque appendages and meandering lines which cannot have resulted\nfrom any acceptable rationale.\nThe changes which SB 195 made in the 1971 AB 16 plan failed to\nimprove a single one of these deficiencies. Indeed, changes to the\n28th, and 37th districts make them even less compact and more absurd\nthan they were in the 1972 versions.\n-4-\nIn the Assembly Plan, Assembly District 29 extends all the way\nfrom the community of Taft in Kern County to the City of San Jose in\nSanta Clara County, truly a remarkable feat of cartography. Assembly\nDistrict 23 runs from the San Luis Obispo-Kern County line to the western\nSan Bernardino County communities of Upland and Ontario. Assembly District\n69, which has probably elicited more adverse public comment than any\nother district, runs in narrow, irregular corridors along the borders\nof Orange and Los Angeles Counties. San Diego County Assembly districts\n76, 78, 79, and 80 wander through the county in jigsaw fashion, dividing\nthe urban areas of the county in an irrational manner which is bound to\nconfuse the electorate.\nUNNECESSARY DIVISION OF INTERESTS\nThese plans blatantly fail to pay due respect to the needs and\ninterests of the different communities and the political divisions in\nthe state. The districts provided for cut across county and city lines,\nfragment other established political division of the state, and violate\nthe identity of innumerable communities. Again, the sole purpose seems\nto have been to achieve partisan gains.\nNumerous examples of divisions of local political subdivisions can\nbe cited, but I will mention only the more flagrant ones in Southern\nCalifornia. But this gerrymandering is rampant throughout the state.\nCongressional Districts 23 and 34 wind tortously through Los\nAngeles and Orange Counties, crossing city boundaries with utter abandon\nand creating districts composed of widely separated fragments of cities\nand communities of interest. Congressional District 38 substantially\ndivides 6 of the 7 largest cities within its borders including Riverside,\nSan Bernardino, and Pomona.\n-5-\nAssembly districts in the eastern part of Los Angeles County\nseemingly pay no attention at all to the community lines as they\nwander in random fashion throughout this area. Assembly District\n69, of course, notorious for its absure, contorted corridors, is\nalso notable for its division of virtually every community it touches,\nsince few incorporated communities are small enough to fit within\nsuch narrow confines. This district could best be described as\nlooking like a circus ferris wheel, distorted by the intense heat\nof partisan politics.\nI cannot, in good conscience, tell the people of California\nthat these plans pay due regard for the value of preserving our\ncommunities intact within the representative structure or provide\nthe citizens within these communities and immediately surrounding\nareas with the fair and equitable representation to which they are\nentitled.\nIt would have been idealist, and totally fair to the people of\nCalifornia if the leadership in the legislature had just sat down\nand reapportioned the State of California without taking into\nconsideration party registration. Reinecke\n[Sac. 7917, 7919, 7923]\nCALIFORNIA SUPREME COURT UPHOLDS\nMASTERS' REAPPORTIONMENT PLAN\nState reapportionment plans recommended by three\nSpecial Masters were adopted virtually intact by a unanimous\nCalifornia Supreme Court today. The new congressional dis-\ntricts, and the State Senate and Assembly districts will be\nused in the 1974 elections and until new reapportionment\nplans are adopted following the 1980 census.\nThe order is final, and becomes effective today.\nThe opinion was written by Chief Justice Donald R. Wright.\nSince the new districts were not established for one\nfull year before the 1974 general election, the Court held the\none-year residence requirement for state legislators is not ap-\nplicable. The ruling stated, however, that a candidate must\nbe a resident of the district in which he runs by January 28,\n1974. This is the first date specified in the Election Code\nfor filing a declaration of intention to become a candidate.\nElections to 20 of the 40 Senate seats will continue\nto be held every two years. Consequently, elections for Sena-\ntors from new reapportioned even-numbered districts will be\nheld in 1974, and for odd-numbered districts in 1976. Even\nthough reapportionment will mean that some voters-those moved\nfrom an old even-numbered district to a new odd-numbered dis-\ntrict-will not be able to vote for a six-year period, the\nCourt concluded this did not deny them equal protection under\nthe Federal Constitution.\nReferring to the Commission report, the Court observed\nthat the Masters had reviewed the evidence, listed appropriate\ncriteria, explained why other reapportionment plans were not\nsuitable, and had described their methods and reasoning in\nreaching the recommended plans.\nThe Court approved and adopted the seven criteria\nused by the Masters as a basis for reapportionment:\n1. Strict equality of population for congressional\ndistricts, and reasonable equality for legislative districts;\n2. Providing districts which are contiguous and\ncompact;\n3. Maintaining counties and cities as intact as\npossible;\n4. Preserving the integrity of basic geographic re-\ngions as much as possible;\n5. Considering community of interest;\n6. Forming state senatorial districts by combining\nadjacent Assembly districts, and where practicable, having con-\ngressional district boundaries follow Assembly district lines;\nand\n7. Using the 1970 census as the basis and using\ncensus tracts as the basic unit for district formation.\nAn argument that the existing relationships between\nincumbents and constituents should also be a criteria was re-\njected. While acknowledging the values of such relationships,\nthe Court concluded that \"incumbent-neutral\" districting per-\nmits most incumbents to keep their incumbent advantage, but\nthat districting to preserve the status quo \"would be unfair\nboth to nonincumbent candidates and to electors of the new dis-\ntricts who wished to support such candidates.\"\nThe Court declined to redraw any district lines rec-\nommended by the Masters because of \"the serious risk of creat-\ning side effects which we could not foresee and which adversely\naffected parties could not call to our attention in time for cor-\nrections to be made.\" The opinion pointed out that the Masters\nhad developed expertise in their four months of study and analysis\nand also had assessed the impact of alternative proposals that\nhad been proposed by the Legislature or that had been submitted\nto them. The only modification made by the Court to the Masters'\nrecommendations was to interchange the numbers of the new\nSenate Districts 8 and 9 (Alameda County) and 27 and 30\n(Los Angeles County).\nThe State Constitution provides for four-year terms\nfor State Senators with half elected every two years. Thus,\nthe Court reasoned those Senators elected in 1972 are entitled\nto serve until 1976 and if a vacancy occurs before then, it\nshould be filled by a special election of voters in the \"old\"\n1972 district. Because of this constitutional requirement,\nsome inequality may result, the Court observed. For example,\nchanges of Senate district boundaries may permit some electors\nto vote in 1972, 1974 and 1976, while others may only be able\nto vote in 1972 and 1976, and still others only in 1970 and\n1976. To test if these differences violate the equal protec-\ntion clause, the California Court applied standards established\nby the U.S. Supreme Court that in state electoral districting\ncases equal protection is afforded if districting is based on\nclaims that a state may \"rationally consider.\" Applying that\ntest the Court concluded that California \"may rationally con-\nsider stability and continuity in the Senate as a desirable\ngoal which is reasonably promoted by providing for four-year\nstaggered terms,\" and that correction of any resulting inequal-\nity would \"substantially interfere\" with the staggered term\nsystem.\nThe first ruling of the Court regarding state reap-\nportionment was made on January 18, 1972 in response to a suit\nfiled when the Legislature failed to reapportion itself on\nthe basis of the 1970 census. That decision ordered use of\ntemporary reapportionment plans for the 1972 elections but the\nCourt retained jurisdiction to draft new plans for 1974 elec-\ntions if the Legislature did not. On May 10, 1972 the Court\ngranted the State Senate an extension of time to permit the\nLegislature to attempt its own reapportionment during the re-\nmainder of the year 1972. The Legislature did not act and the\nCourt, on March 23, 1973, appointed three Special Masters to\nhold hearings and develop recommended criteria and districting\nplans for the Court's consideration by August 31. On\nOctober 30 the Supreme Court heard oral arguments concern-\ning those recommendations.\nToday's decision will be published in the official\nreports of the California Supreme Court.\nThe University of California Institute of Govern-\nmental Studies in Berkeley was granted permission to store\nthe materials relating to the case for use by the public.\nCourt of Appeal Presiding Justice Murray Draper\nsat on assignment.
