June 24,1927. New Amsterdam Casualty Company, 60 John St. New York City. Gentlemen: We hand you herewith Summons and Complaint in an action instituted in the New Jersey Supreme Court by Quinta McDonald and James McDonald against this corporation. According to our records we carried with you Compensation policy ACU-30093 from November 4,1917 to November 4,1918, and policy (CG-50700 from November 4,1918 to November 4,1919. The Brokers in the transaction were Pease & Elliman Agents, of 55 Liberty St. N.Y.O. You will please note that your policies cover the Radium Luminous Material Corporation - this is the same concern as the United States Radium Corporation. Merely the name was changed September 1,1921, with no structural changes in the corporation. This Summons and Complaint was served on our Agents the Corporation Trust Company of New Jersey, on June 16th,1927. Through an error of ours this was sent to another Insurance Company, whom we thought carried the Compensation Insurance during the time specified by lfr. McDonald that she worked for us. For your gen eral information we may say that we have had considerable experience in suits of this nature, and have always associated wih the attorneys for the Insurance Company our own attorneys - Lindabury, Depue & Faulks, of Newark, N.J. We shall be very glad to give you the benefit of our experience and knowledge in the preparation of the answer and also the defence. We are also in a position to furnish a great deal of expert testimony and data as a result of scientific research on this subject carried on by some of the leading physicians and physicists of the country.
