Gentlemen:
We hand you herewith copy of Summons and Complaint in an
action instituted in the New Jersey Supreme Court by Orace Tryer against
this corporation. We also enclose an action of Katherine Schaub against
this corporation.
In the case of Orace Fryer service was made on our Agent the
Corporation Trust Company of New Jersey, May 18th,1927, and in the case
of Katherine Schaub service was made June 16th,1927.
It is rather unfortunate that we did not call these two suits
to your attention sooner, but we were under the impression, until recamtly
that the Aetna Life Insurance Company carried our insurance during the
entire period of employment claimed in each action.
The Aetna Life Insurance Company, through their attorneys
Collins and Corbin filed answer to the Grace Fryer suit on June 9th, and
to the Katherine Schaub suit July 7th, so these two cases are properly
covered so far as answere are concerned.
We trust that our oversight in not sending you these documents
at the time they were served on us will in no way influence your attitude
towards any possible liability which may arise under our policy with you.
