I have yours of the 29th ult. in the
above entitled matter.
of course, while in this particular
suit I am merely sitting in with you, the answers filed
in the new suits which Berry is contemplatirg bringing
in the Court of Chancery will be in all probability
quite similar to the answer filed in your suit. I have
looked it over and it seems to me to be in proper shape.
I do not quite understand, however,
what you mean when you say that you thought it wise to
answer that upon the face of the bill there appears no
equity, and you refer to the cases of Lamb vs. Martin,
43 N. J. Eq. 34; Clark vs. Augustine, 62 N. J. Eq. 689;
and Freeman VS. Conover, 95 N. J. L. 89, 94. It seems
to me that if the statements set forth in the bill were
true, the complainant might have a case. Won't you
please let me hear from you on this point?
