Gentlemen:
This morning Mr. Berry and I went before Vico Chancol-
lor Backes, Mr. Berry's purposa being to have the Vico Chancellor
reservo mora than one day for the hearing of the above casos and
my purpose boing, if possible, to have the Vice Chaneollor set a
day much later than January 12th for the hoaring.
The Vics Chaneallor expressed the viaw that the cases
wore not cognizable in a court of equity.
I told hin that I
thought that under the facts in the cases the vieu expressed by
him was correct. Mr. Berry explained to him his theory of the
cases, The Vica Chancellor declined to resorve, at this time,
noro than one day for the hearing, saying that he might be able
to dispose of the casos without as full an invastigation of the
facts as Mr. Berry seumed to contemplate.
