My dear Barker:
I have been following the trial of your case in the
newspapers during the last few weeks and I admit frankly that
"trial by journalism" instead of trial by jury is far from being
satisfactory. I am not quite sure yet why the case had to go
to trial before a jury when the defense had not put in its side
on the question that was involved at the last trial. In other
words, did the judge decide the case on the prosecution evidence
without that of the defense?
I sail from Montreal on June 28th and I am not sure
that I will be in New York. Do you consider it still worth while
for me to look up the things in Europe that we talked about when
I was in the East last. I think that you are quite right concerning
the fact that you have not heard the last of this whole situation.
To what an extent your compromising will help a future fight is a
matter for the lawyers to decide.
