Dear Dr. Schlundt:
Out attorneys advise that at a preliminary
hearing before the Vice Chancellor in Newark yesterday,
relativo to the evidence admissible at our hearing on January
12th, it was the Vice Chancellor's opinion that it will not be
necessary to have any out of cown witnesses present on that
date.
It seems that there is a point at lam to be
sottled in these cases before the evidence will be taken, and the
Vice Chancellor's opinion is that January 12th, will be devoted
to this phase or the cases. The Vice Changellor has set aside
only one day in January, and in the event thet the cases are
continued in the Court of Equity it probably will be a matter of
months before the expert testimony will be required.
As you realize the courts act at their own
pleasure in these matters, and as soon as we have anything
definite, when evidence such as you can give is to be taken we
will comunicate with you. In the meantime should you be in the
City I trust that you will ive us a call.
