Dear Mr. Smith:
Herewith copy of letter to Mr. Berry in
regard to a stipulation which he presented for the purpose
of taking testimony of the medical witnesses in New York.
Mr. Lee and Mr. Barker conferred with me yesterday and
stated that these doctors were averse to testifying for
Berry and that Berry represented to them that all of the
attorneys were desirous of taking their testimony. The
stipulation presented was drawn so as to stipulate that the
attorneys for both sides agreed upon the taking of the
testimony.
I think my letter to Messrs. Potter &
Berry, if complied with, will fully protect us and
clearly indicates that these witnesses are called by
Berry and not by us.
