Dr. Herman Schlundt,
University of Missouri,
Columbia, Mo.
Dear Dr. Schlundt:
Mr. Markley and Mr. Smith appeared before
Judge Runyon in the Federal Court this morning requesting
that we be allowed a Struck Jury for the Metz and Tuck
trial, also complete physical examination including X-ray
plates of the plaintiffs.
The Court saw fit to grant our request in
this matter, and inasmuch as it requires not less than thirty
days to impanel a Struck Jury it is obvious that we could not
possibly go to trial on April 22nd. The matter of making
proper physical examination and X-ray study also would involve
considerable time, and it is highly probable that these cases
will not be set down on the calendar for trial before late
summer or early fall.
In the meantime we shall keep you advised
as to what is happening, and at such time as a trial date has
again been set we shall communicate with you to ascertain
whether or not you will be available at that time. You
probably are quite familiar with all the delays involved in
legal actions such as these and realize that at the present
moment we have no idea as to the exact time when these cases
will come up.

Easter Time.
