Stockdell Gray, Esq.,\nCounsel, Globe Indemnity Co.\n20 Washington Place,\nNewark, N. J.\nDear Mr. Gray:\nWe acknowledge receipt of your favor of the\n15th with summons and complaint in the above together with letter\nof the 14th from Mr. H. H. Barker. This suit is brought in the\nNew Jersey Supreme Court, Essex County and it is my opinion that\nit should not be removed to the Federal Court. This suit will\nnot be reached for trial for over a year and a half if it is\npermitted to remain in the State Court, whereas if it is removed\nto the Federal Court it may be reached for trial within three\nmonths.\nWe now have two cases pending in the Federal\nCourt and we think it wise to keep the suits separated as much\nas possible. We have another case pending in the New Jersey\nSupreme Court, Essex County, namely, Madlinger V. United States\nRadium, but that is by Mr. Weeks, who we understand is in no\nway associated with Messrs. Schneider & Schneider, who bring\nthe present action. As a matter of fact, Arthur M. Karl who\nappears as of counsel with Messrs. Schneider & Schneider, is\nthe real attorney. Apparently he felt that he could not handle\nthe matter alone, so he brought in Messrs. Schneider & Schneider.\nWe are writing to the United States Radium\nCorporation to make the usual reservation with respect to\ncoverage. We are also going to demand a bill of particulars\nby making a formal motion for same and after we have filed answer\nwe shall then attempt to get a testimonial examination before\ntrial as well as a physical examination. We understand that Dr.\nFrederick B. Flinn of New York has already examined this woman\nfor the purpose of determining whether she is radioactive, and\nwe shall try to arrange with Mr. Barker to obtain whatever in-\nformation Dr. Flinn has.\nYours very truly,\nEAM:AG\nCOLLINS & CORBIN."
