Dear Mr. Pesinger:
As suggested in our conversation of this morning,
I herewith confirm the points discussed by letter:
Some three or four wecks ago I discussed with Dr.
Humphries the condition of one of his patients by the name of Mrs.
Ruth Saxer, whom he had been treating, and which he had diagnosed as a
"radium poisoning" case.
Dr. Humphries feols that Mrs. Baxer has a legitinate
case and that she should be conpensated. He endeavored to enlist the
services of Judge Clark in her behalf, but Judge Clark declined on the
ground that there were other radium cases in the Foderal Court at the
present time. Dr. Humphries then approached the United States Redium
Corporation, thru lfr. Markley, with the hope that some astisfactory
settlement could be effected without the necessity of Nrs. Saxer resort-
ing to litigation. In casd Mrs. Saxer cannot obtain redress without
going to court, Dr. Humphries feols that she should press her case, and
sufficient time has now elapsed that it is our opinion unless we takd
some stepa to show that we are disposed to at least consider effecting
a settlement, suit will be shortly instituted.
As suggested, we believe that electroscopic tests should
be conducted and that there should probably be taken a testimonal examing-
tion to ascertain more facts relative to when lirs. Saxer first suffered
pain which might have been attributed to Fradiun poisoning", and other
pertinent data. According to ay understanding you approve of making the
electroscopic tests and are willing to bean.your proportionate share of
the expense involved - also any other expense involved for physical
examination, etc.
It is probable that Dr. Schlundt will be in New Yor some
time the latter part of next week or the foropart of the week following,
and Nrs. Saxer should be examined during his visit, which would not entail
as nuch expense as if it were necessary to bring him on for this one esse.
I expect to have a conference with lr. Emory and Markley
to determine the exact technique to be involved, and will advise you as
to the result of this conference.
I hope you will confirm your understanding of our conver-
sation of this morning.
