My dear Barker:
The date set for the trial of Mrs. Metz and
Mrs. Tuck is the date for the opening of the University
after the holidays, but nevertheless, I hope to be able to
arrange to be present at the trial. I know that I can be
on hand to conduct another expired air test on Mrs. Metz
on the third of January and perhaps on the second.
I infer from your letter than plans are on
foot for making a settlement with Mrs. Tuck; if this settle-
ment could be virtually completed by the date on which the
trial is scheduled, I think this point could be made a very
effective one in the plea to the jury. Such a settlement
would give a clear indication of the policy of your company
to do its part in making adjustments. I am, of course, hop-
ing that the test of the expired air of Mrs. Metz will turn
out negative. If these two findings could be properly con-
trasted and brought effectively before the jury, I would
feel more hopeful of getting a favorable decision.
