Contlemen:
Rr. Merkley of Collins & Corbin's office wrote you relative
to the abova dase, sending you information developed at a conference
with le. Laporte and his attorney on June 13th. On August 11th, we
mote you further, relative to this aubject.
During the past fou daya It. Uniger, counselor at Law, who is
representing LaPorto, has been prossing us for a decision as to what
we proposa to do with regard to this case, stating that his client
insists upon our indiesting our dispositions, or else he will start suit
in his client's behalf.
It is our belief that this case con be settled for a rather
nominal sum, say five or six thousend dollars, and possibly less.
The ovidence rather substantiates the fact that liss. LoPorte suffered
from the effects of radium poisoning, and it is possible that it would be a
wise sove to settle this anse without their starting litigation..
It is our understanding fros the conforence held at Evory's
office, in Degember 1930, that the burdon of settling any now cases would
fall to us. De would probably be disposed to settle this case on the
condition that in the event the test case, to be made of Tuck VS. U.S.R.
Corp+, as to the liability, was decided in favor of the S.R.Corp. the
carriers covering the LaPorte onse would reimburso us for such moneys as
wo had expended in the settlement of this case.
will you kindly give this natter your consideration, and advise
us as to whether you would be disposed to agree to such a plan, which is
sinilar in character to the plan agreed to by you under which we settled
both the Stasi and Saxor cases.
In order to preclude suit being started in this case, se must
give them some decision in the matter.
