Dr. Herman Schlundt,
Room New Chemistry Bldg.,
Columbia, Missouri.
Dear Dr. Schlundt:
Briefly the status of the radium cases is
as follows: Judge Fake, of the Federal Court, ruled aome
year or year and a holf ago that the Statute of Limitations
barred former employees from bringing suit unless they could
prove that we practised fraud. Based upon this ruling two
of the litigants have removed their cases to the Court of
Equity and the first one of these, namely, "La Porte VS.
United Stated Radium Corporation", has been set down for a
hearing on June 4th, 1934 at Nowark.
The burden of the plaintiff in these cases
is to prove that we did practise fraud, and I bolieve you
will agree with us, the conmon consensus of opinion by those
familiar with the art at the time sould be to the contrary.
The services of you and Dr. Lind will be high-
ly essential to our establishing this fact, and I should like
to herewith inquire if your schedule is such that it will be
possible for you to be in New York on or about June 4th to
attend this hearing, should your services be desired.
