Dear Dr. Lind:
This is to confirm my telegram sent late on
Tuesday afternoon. We were very nuch disappointed that we
could not proceed with this case, as we have spent weeks
in preparation and felt that we were ready to proceed. How-
over, there is nothing that can be done to alter the course
of the Courts. The Judge who was to sit in this case is 6
hard working man, and I understand that he is so involved
with other cases that he folt he could do a much better job
by holding the case over until the Fell Term of Court. Also,
he was in the midst of another case which would take an ad-
ditional week or ten days to complete, and he did not feel
like interrupting this case.
I know how very annoying these things are to both
you and Dr. Schlundt, as we appreciate the inconvenience you un-
doubtedly went to in arranging a trip to New York at this time.
However, we trust that you will bear with us in this matter, and
as soon as we have more information ns to the date in September
when the case will be heard, we shall comminicate with you prompt-
ly. We do feol that the time set in September will be final and
that there will be little or no question that the case will go on
at that time.
