Dear Judge Forman: An order was signed for the final hearing of the above equity suit before you at Newark on September 10th. In speaking to Mr. Emmerglick on the 18th Inst., who is in charge of this matter for the complainant, he informed me that the date fixed in the rule had been changed from the 10th to the 12th of September, although we had no previous notice of this change. We would appreciate it greatly if the trial could begin the following week on Monday, September 17th. Mr. Emmerglick has no objection to that arrangement provided the case will be tried and completed on the court days following September 17th. He thinks he will take about three to four days to present his side and we will take about the same length of time for our side. We have taken considerable testimony of our experts in advance of the final hearing, which will considerably shorten the time it will take to conduct the final hearing. If you could fix the trial as beginning on the 17th of September, I would greatly appreciate it.
